Technically they shouldn’t even hold the copyright for that tune because it’s not their original tune anyway. It is from a 1911 song called “Steamboat Bill”

They held the copyright claim over their version of that song, but not after Jan. 1, 2024. I’m guessing it got claimed since TH-cam’s copyright claim systems are automated and they haven’t updated it.

I think it's possible for sound and music falls under a different copyright then film does. What is it... Music is for the lifespan of the musician + 70 years after death?
We have to remember that just because something is in public domain does not really mean 100% of its is in public domain for there is multiple copyrights to one thing.

@@somebodykares1 This only applies to works published after January 1st 1978. Any creative work registered with the united states copyright office in 1928 or before is in the public domain. It does not matter if it is images, music, books, paintings, movies, etc.

This is going to be a repeat of Sherlock Holmes. When he entered the public domain, but some stories remained copyrighted, the owners of the remaining copyrights tried everything to sue people. They said you couldn't portray Sherlock as having emotions, since he became more emotional in later stories. Disney is going to do the same. (All original Sherlock Holmes stories are now public domain.)

I would imagine the strike was probably automated. It would take a while for the system to be updated to not pick up Steamboat Willie as copyrighted music.

TH-cam's system of copyright claiming is completely broken.
A few years ago me and a friend of mine got permission to use a song by a local band for our videos. When we tried uploading videos with the song included we were struck by automated claims on the band's behalf. Speaking to the band they assured us they had nothing to do with it and wanted us to use the song for our videos. They even tried contacting TH-cam about our permission to monetize the song but received an automated response that didn't resolve shit. We ended up never using the song on TH-cam but I'm still pissed we couldn't use a song we had explicit permission to use and monetize through our videos. Now that's a properly broken system made to benefit large copyright holders while screwing small creators.
I'm so sorry this happened to you. This is why I just use covers of songs that are available. You don't have to worry about any copyright claims this way.
It seems that TH-cam havent updated its content ID system. Some people uploaded the full Steamboat Willie clip, but their is no copyright attached to it in terms of music.
I do think its possible that TH-cam hasnt really considered what to do when a video in the content ID system's copyright *expires.* the content ID system is a separate system from the US copyright system, so it can still treat something as being copyrighted even if its uncopyrightable.

Mickey and Minnie Mouse are now in the public domain and you can do whatever you want with them. If someone was so inclined they could animate a video of Mickey shitting his balls out his ass while saying "I'm Mickey Mouse and boy howdy did Walt hate the Jews" and the Disney company couldn't do anything legally, especially if it's the version of Mickey shown in Steamboat Willy
@@ironhell813Disney does not have copyright on the music. It is public domain too. It was just an automatic system and if he appealed it he would be accepted if a real human even checks and not just a computer.
It's important to note that a lot of these claims popping up aren't actually from Disney. I uploaded a selection of public domain cartoons to my channel, privately, and received a copyright claim on Gallopin' Gaucho and Steamboat Willie from "UMG on behalf of Disney Records. "

Yes it is. Companies submit their request and youtube automatically flag your video and act according to their will.
Even if they are not right it dosen't matter unless you fight a civil court against them. Witch you loose even if you win, bc it is fucking expensive

The automated systems are directed by people behind desks acting "on behalf of Disney Records". So Disney and/or its agents need to update their auto-claim directives because the song and the video are in public domain now.

It's unconstitutional to use trademarks in ways that copyright covers. Trademark is only used for identification of the source of production.

Second they started using steamboat willie as the opening logo I knew it was a hail mary attempt to keep him from entering the public domain

It isn’t, the tune and the version in the short are public domain. Trademark would only apply if the creator is trying to deceive consumers into thinking Disney made it. This is just TH-cam’s copyright system not being updated.

It seems like it's more something to do with TH-cam's content ID system not having the Steamboat Willy soundtrack cleared out of it than an actual copyright infringement

No, it definitely isn't copyrighted. Hell the song itself didn't even originate from Steamboat Willie and was already fully public domain a few years before this. Not even his color scheme and gloves are protected anymore, just the more "modern" 1939 design until around 2034 and anything else after it. (And other characters until the shorts they were introduced in have copyright expired as well) I think it's just a result of either Disney or TH-cam being stupid... or both. In any case you should definitely fight for your rights to get it monetized again, even if TH-cam won't do shit about it as always. Lol

There's a lot of fake groups that send false claims for music. They are a fake Warner Bros, a fake Sony, a fake Sega, a fake Nintendo, and probably a fake Nextone among others. These trollers are known to cause trouble.
Usually, it's "Warner Music Group" or "Sony Broadcasting Org" but "Nextone Inc" is a real annoying one.
Copyright and Patent law in this day and age need a total reworking. Both really hold progress back all in the name of profit. I'm surprised corporations haven't fudged a way for them to pay for indefinite patents and copyrights.
“Turkey in the straw”, aka the song whistled, has been in the public domain for a LONG time, many people claimed to have made it and a piano cover of it is totally legal. What isn’t legal is a copy write strike for using it. They can be sued for claiming its theirs because it is newly generated content using something in the public domain. And even if it wasn’t in the public domain, they would need to prove they made it, which they didnt.
They may have made the whistling cover, and where they have made a piano cover, they can not claim the song itself as theirs.

It’s either automatic or could be worth noting that copyright laws may vary in other countries. In the US it’s free game but in others may still have that copyright.

The reason could be because of Disney Animation Studio using the whistle as a intro for their movies so maybe using the whistle by itself infringes on that copyright.

As an experiment, I uploaded a copy of Steamboat Willie to my TH-cam page yesterday (1/3/2024) and it was instantly flagged for copyright violation by Disney. I suspect that they have an AI that searches for Disney content and they're just too busy to tell it to ignore Steamboat Willie after 1/1/2024. Because that would take all of two minutes.
So the reason for this is probably the music modernization act. Tldr song recordings published prior to 1973 have a 100+ year copyright. Therefore, although the film is public domain the song recording is copyrighted for another 5 years. Recording your own cover of the song is perfectly legal though.
Other people also got copyright claimed by Disney for the music, but have since had the claim lifted. I wouldn't be surprised if yours gets lifted as well.

The song itself isn't copyrighted, but it could be due to the music modernization act. Covers of songs are protected for 100+ years after the recording.

There’s so much weird misinformation in this comment section. Any work created between 1923 and 1977 will be protected under copyright for 95 years, after that they become public domain. Anything released after January 1st, 1978 will become public domain 70 years after the author’s death. Trademark only applies to a public domain works if the author is trying deceive consumers into thinking another company or person made it. Everything about this person’s original video is legal, it’s just TH-cam’s content ID system not being up to date.
Can’t escape from Disney
Every time I use Public Domain performances of classical or other old music, it gets flagged for some random recording of it. It's infuriating, and delays video releases for 1 month while I appeal.
I believe Public Domain applies to US only. Amosdoll is in Austrailia.

I'm not surprised by this. TH-cam's copyright system is so bad that I just use people's covers of songs whenever I find them. Maybe TH-cam is readjusting the automated system. Give it some time and we'll see if things change but I wouldn't get my hopes up.
