Warhammer, Games Workshop's premiere tabletop wargame, is about as full of scandals as you would expect from a game that expects you to spend hundreds of dollars on small pieces of cheap resin. Interestingly, unlike some of the other scandals we've covered in other Many Scandals episodes, Warhammer's dramas are less so caused by their player base, and more from it's producer, Games Workshop. An infamously litigious company about as opaque as a block of wood, for decades fans have been left to try and divine the inner workings and bizarre decisions of their favorite hobby. These include making it so that nobody can make their own fan animations online, all so they can trick people into paying for their proprietary streaming service Warhammer +, as well as throwing the rich lore and backstory of Warhammer Fantasy in a bin, in order to reboot it as the now-infamous Age of Sigmar.

      The End Times; *SPOILERS*
Archaon BTFO's Kislev and the Northern Empire but then AFK's in Middenheim while the Skaven and Nurgle carry the war effort.
Dwarfs and Skaven initiate Call of Duty. Queek gets stomped by Thorgrim. Ungrim goes Super Saiyan and snaps Ikit's neck before getting sniped. Deathmaster Eshin survives and stabs the High King before running away and cackling.
Thanquol pledges his allegiance to Archaon.
Tyrion gets "Madness of Khaine" debuff trait from holding the Sword for 5 turns.
During this madness, High Elves have 2nd civil war. Everyone swaps sides, Malekith is now the true king, Imrik simps for Tyrion while Teclis is advised by Ladrielle, last living Elven deity, to join Malekith and unbind the vortex.
Tyrion tries to claim Alarielle as Everqueen, but is stopped by Orion, they proceed to arm wrestle. As Orion is getting pinned, Alarielle duels Morathi. Both knock eachother out as Durthu saves Alarielle and gets chopped by Tyrion.
At this point, world tension is maxxed. Clan Pestilens goes full Battle of the Somme and attacks Lustria. Many Rats are swallowed whole by Sotek. Ikit drops Morsleibb on Lustria. Mazdamundi activates the final protocol with his last breath and sends some skinks and kroxigors into starship temples. Kroak, finally bored of his existence, sacrifices himself with the Old Ones Shield and stops Morsliebb from destroying the rest of the world.
The Elves make a final stand on the Vortex as Tyrion attacks with Mortathi. Malekith is about to loose before Alith Anar chooses the Sigma method and shoots both Tyrion and Malekith. "Madness of Khaine" fades as Tyrion dies. Malekith lays mortally wounded as Morathi starts spell spamming and releases the Vortex.
Fire Magic binds itself to Ungrim, ascending him to Doom-Slayer-King
Metal magic binds itself to Thorgrim as he reads THE B00K.
Life magic gets bound to Allarielle
Teclis tries to bind Heavens magic but miscasts.
Shadow Magic binds itself to Malekith, saving him from death at the cost of turning him into the Emo-Prince.
As the vortex is unbound, Ulthuan sinks, and Slaanesh devours all the waystones, and all the elven souls contained within. Slaanesh also eats Morathi.
Alarielle sheperds the last of the Elves to Athel Loren via Worldroots, and Teclis sinks with his brother.
Meanwhile in Altdorf, Each college has their power rangers moment fighting the Great Unclean Ones, before they are finally smushed by Ghal Maraz. Humans recollect in Altdorf after the first wave of skaven attacks before Archaon appears on the Horizon.
Nagash is rezzed by Arkhan, and then vores Usirian, God of the Dead.
Nagash raises his legions once more and takes over all of Nehekara. Settra allows Nagash to rez because he's bored. Battle of the Dead ensues, Nagash tries to subjugate Settra, who does not serve, so he instead breaks all of his bones and casts his skull into the sand to watch as Khemri is destroyed. Nagash is about to proclaim victory, when Mannfred teleports behind him, uses the Blessed Blade of Ptra to banish Nagash, and Khemri falls silent. Settra is ressurrected by the last 4 Magic Winds, and the EndTimes lore ends here.

The *actual* reason behind fanfic and fanart still being allowed is somehow even worse: They would have made it not allowed if several court cases hadn’t been won on the very subject. In the 90’s or 00’s Anne Rice tried to get fanfic and fanart of her work taken down, and a big court battle was fought over it that came down definitively on the side of fan works. Archive of Our Own, one of the bigger fanfic sites on the net, is descended from the Organisation of Transformative Works, a non-profit which has fought and is still prepared to fight legal battles if it ever came down to it.
Games Workshop only stopped at banning fanfic outright because legal precedent would thoroughly destroy them. Really someone should talk to that organisation about this whole debacle again, since even the rules seem really restrictive in a way Anne Rice would’ve approved of.

FYI, it wasn't only Anne Rice. David Webber (Honorverse), Anne McCaffrey (Pern AND Kilashandra/crystal singer), and from personal knowledge one Richard Garfield (Magic, the Gathering) all went toe to toe with Wizards of the Coast (formerly TSR) over various fanfic 2nd ed AD+D scenarios. If memory serves, starting in 1992 there was an option to write up a scenario, playtest it with your buddies, then submit it to WotC for review and potential publishing. If your work was selected, you would gain royalties off the sales. At least two scenarios that were eventually slated for release contained copyrighted materials from outside sources. Prof. G had seen one specifically using creatures from Magic as the NPC "baddie" spawns, and we also were reading some of the other entries under consideration in the WotC newsletter. There were scenarios from the Pern series (thinly veiled and near plagerisim) as well as the crystal singer series. Then a few months later another rose up using AD+D rules and character sheets to run Honorverse.
Also, if memory serves, these actions were what led up to the D20 system being released opensource. Shadowrun no longer required 15lbs of D6, with the D20 adaption, although finding the D20 adaption was pretty dang rare...

Fair Use does require quite a few things.
Factor 1: The Purpose and Character of the Use
Factor 2: The Nature of the Copyrighted Work
Factor 3: The Amount or Substantiality of the Portion Used
Factor 4: The Effect of the Use on the Potential Market for or Value of the Work
These are the four factors and they get balanced mostly in every individual case.
Fan Art will get a bit favorable in the first Factor, as long as it is not monetized, but not guarenteed. Under that Factor a work that is Transformative will likely also be a bit favorable for non-monetized fan art, especially if it portrays situations not present in the stories.
Factor 2 might also be a bit favorable.
Factor 3 is likely also a bit favorable since you use little of the IP.
      Factor 4 is heavily individual.
But mostly, if you are monetizing it, most of your favorable arguments fall apart.
So a clause like that is likely more to deal with monetized examples, like Astartes, or animations with ads enabled, etc.
Earning money of an unlicensed IP is a big nono.

I could make a 1-to-1 copy of Counter-Strike if I wanted, but technically not even allowed to show it off.
Also copyright fair use is incredibly vague, so you have little to no idea whether it is breaching until you go to court.
Sharing pictures of Homemade Projects in the IP can actually be a breach of copyright, while most companies don't do anything about it.
On the other hand, most companies have strict rules like this, so they can try and enforce them in certain situations, instead of making more lax ones that could contain loopholes.

TTS was probably the biggest blow because it was TTS that opened a lot of people myself included into the world of 40k
While being a lot more comedic it actually respected and was pretty accurate to The lure outside of a few things but even those things where in character and entirely believable based on what we know.
It brought the attention of thousands of eyes into 40k and no doubt boosted their numbers incredibly, it was literally free advertisement that probably would have brought them more money in the long run than putting it behind a paywall

      @lukeduran12 11 หลายเดือนก่อน +3

@@rakelodakel The problem with taking Warhammer seriously is its just so painfully dumb if you take it at face value. Its like the edgy kid at school who constantly goes on talking about their knife collection, while also at the same time having some of the most contradicting plot points, characters and power scaling. Don't even get me started on everything needing to be so "Grimdark", as if everything is this over the top edgy nonsense than none of it is, theres no real point of comparison.
Don't get me wrong, I love warhammer, I think they have a lot of cool IDEAS, but they fail at execution in the long term a lot, one half because of forcing this edgy attitude on every aspect, the other hand because of corporate greed.
I think probably the biggest thing I actually appreciated about TTS was they were trying to move the story forward, past the comedy, past the poking fun at the series, TTS actually was trying to progress the story line in a direction that may include finality. The primarchs were returning, Chaos was rallying it's champions, the Eldar gathered Magnus to assist in the birth of Ynnead with Eldrad, big steps were being taken to give the Emperor a new life to rule again, and so forth. My dreaded relationship with Warhammer, past their bad corporate practices, past derpy and edgy writing, past their blatant favoritism, was that the series stagnancy. How it was always 5 minutes till minute, how no side can gain any true ground, and nothing will truly ever change or end, because if it does it means GW loses money.
Now, they have always teased progress, and in some cases actually made some. I personally think the returning of the primarchs is a good thing, Cadia being destroyed was a good thing, but it still doesn't help that these are side steps, never actual steps towards finality. Ynnead can never truly be born, chaos can never truly take Terra, nor can the Eye of Terror ever actually be closed.
Now with that said, I genuinely hope this doesn't come off as rude, I simply wanted to add why I like TTS, and genuinely can't find major interest in their long running books or novels. If you dispute any of my points as well I'd be more than happy to hear out your reasoning as well!

    • @rakelodakel
      @rakelodakel 11 หลายเดือนก่อน +5

@lukeduran12 that's a long way to say you don't read the novels. Warhammer 40k isn't a story, it has never claimed to be, and I really hope it never becomes one. It's a setting. I know you don't read the novels because if you did, you would know this, and you wouldn't have this issue with a lack of finality, direction and "story". EVERY novel I have read from 40k is a story with a beginning, a middle and an end. It has finality, contained themes and so on.
I don't know what you mean by "taking warhammer seriously". I take it seriously as the tongue-in-cheek, over-the-top and fun satire that it is. I don't need a youtuber making funny voices for the Imperium to understand that they're a corrupt, dysfunctional, evil empire of fascists, oligarchs and fanatics. That's literally the whole point of 40k, that it's funny. The setting is satirical. It doesn't become more funny with someone making that point even MORE on-the-nose. It is, in my opinion, condescending, and boring.
TTS doesn't further 40k's story. It furthers its own soapopera, and has taken 40k's setting and MADE a story up around it. Again 40k isn't a story, never was. Its a setting in which literally several hundred stories are set. And the novels are good, in general. Quality varies. But in relation to other fiction sharing it's themes, it's either just as good or just as bad.
And if your idea of good storytelling is TTS, then again, just wait till you pick up a 40k novel and meet the character's in there. Novel, not "lore video", not "lore breakdown", not wiki-pages, not parody videos, not fan animations, not reddit threads.... a warhammer 40k novel, written by professional writers like Dan Abnett or Aaron Dembski-Bowden.

It's true that GW was on the push to simplify all their games but to first make the unpopular decision to stop supporting warhammer fantasy and then release this new game that had rules but no way to play. It was comically open ended. Imagine a board game where it gives you the most barebones of rules possible and then it says figure out how to make the game work yourself.

They also told them that all such material must adhere to content guidelines. Which were basically all ripped off from the Comics Code.

If we're doing less community scandal than company bullshit with this one, then I feel like you could have an entire second episode based on the cluster that is Games Workshops squandering of their license with video games. Several DOZEN games and yet they always, ALWAYS license it out to some middle shelf at best publisher. On top of that t's almost always some jank mid to low budget developer and often times when it's not just a strategy game it's something that plays like a knockoff of a not-even-recent higher profile game (thinking of you Deathwing and Necromunda!). That's the other thing, despite having tons of potential for all sorts of different genres considering the rich lore and worldbuilding, just like MTG they do this thing where they don't even try and just put out top down strategy games or recreate the exact same thing in virtual space. And shooters, obviously for Warhammer. The only non-strategy games (plenty of which are still very much jank and/or mediocre) I can think of off the top of my head that arent jank as hell or flat out garbage are Vermintide (like you said those games are AMAZING) and Space Marine...oh, maybe save the episode until after they almost certainly fck that up-

Seems quite appropriate for this, now seeing as the GW video game IP seems to be a pretty decent state. Yeah, there are still a stack of absolute garbage mobile games, but the main titles are going pretty solid. The Total Warhammer series is the best thing Creative Assembly has done in years. Mechanicum is just straight up amazing. Vermintide playerbase seems to be growing, or at least it's still very easy to find a game. Darktide is on the horizon for that 40k taste of the Vermintide cake. Bloodbowl is great. That Hired Gun game could have been better, but was still pretty fun. And Space Marine 2 is coming in the next year or so. Hopefully they can keep doing enough to make the shitty mobile games a distant memory. Here's hoping for a Total Warhammer 40k soon too.
There were a few standout mobile games, Silver Tower and Freeblade were pretty fun, but both required cash to be spent on loot boxes if you wanted any of the good champions or weapons.

@@redinfernal_ i made sure to put the non strategy qualifier because yeah, Space Hulk Tactics, Mechanicum, and Blood Bowl are all great. It just really irks me it could be so much more if they weren’t so obviously trying to cut every corner when licensing it out. The main reason those games are so good is because to a certain extent they’re recreating how the actual tabletop plays in virtual space, which is cool but Vermintide and Space Marine 1 is proof there could be a lot more to it. Necromunda and Deathwing capture that same spirit of using the complex worldbuilding to indulge a completely different genre, but have far more flawed execution because they were clearly made a far too tight budget.

I guess if it was an official match, but I usually would play with friends, and if we wanted to use, for example, a green ww2 army toy soldier for a space marine, we would.

well, the problem is trying to understand an emotional response as rational.
i guess that guy must be regretting burning thousands of dollars in a game that just came back, lol. (and could always play regardless).
Games Workshop did a great job turning board games into live services and brainwashing their customers in buying new editions of the same game every 3 years.

Definitely all the Space Marine stuff, between the copyright woes and the way they remade the kits to be biggerer and betterer and make old casts look like manlets, "forcing" people to rebuy armies
Or that time they made a trade embargo for online retailors, blocking off access to not ridiculously over costed models
Or any time they jacked up prices like lunatics, where a box of 10 guys was $50, then a box of 5 of those guys.... was $50. Now $55.
Take your pick. Personally it'd be a disservice to not point out how hecken expensive the game is if you were doing another vid

The worst part is the content creators were lied to. The rules they put in place have no authority outside of their own sites, nor do they have any authority to stop free use profit free fanfic art and videos. They never had any legal right to stop it, so long as you didn't make any direct profit from that video. IE, should you have a patreon or something akin to it, the video can't be apart of such, nor can you get ad revenue on it. However, outside of that, there was nothing GW could do to stop you besides threaten legal action that would never make it past the judge. Yet they bought into the lies, took the chaos offering and now they're trapped doing 2-3 minute trailers and some of the worst animations Ive ever seen.
