    Should I call witnesses that are lying about the meeting that led to my grievance, the last act of discrimination...... I went to doctor that day and rung acas. I’m going to try and get a witness statement from my friend who was “let go” I think she is scared. Should I make the lying employees face the judge, I know at least one of them will struggle lying. I’m in the uk no lawyer.

    My employer discriminated against my religion in the workplace I opened a EEOC Charge against my employer, my employer placed me unpaid leave, I recently lost my home from their actions I was having anxiety attacks I requested to seek medical attention via Worker Compensation claim since I no longer have medical insurance from being placed on unpaid leave. One week after requesting to open a worker compensation claim they issued me an intent to terminate and will terminate my employment May 24th. Every action they have taken against me from the start has been in retaliation my employer will not even wait to see the outcome of the active EEOC investigation
    Everything is documented.

    if i was hired with a 1 year contract, paid per diem to move to where the job is, and signed a lease, plus paying a lease where i live, but the employer work is completed before the contract is up, and now they let you go, but now your stuck with both lease, and is not being paid for the rest of the contract term.

    Is it illegal to get terminated after reporting an alleged assault situation by another regular employee and was deemed after an investigation by the company to be my word against the other persons due to no witnesses or any other proof? I then refused to go back to the same location to avoid any further future problems of any kind. They said I could apply for other job openings which I did for several of them with no success and now they tell me my times up and I'm being terminated while the other person still has his job at the company.

    • @ArkadyItkin
      @ArkadyItkin  ปีที่แล้ว

      This is a tough call for the employee and a tough situation for the employer. If they can't find another position for you and you aren't willing to work near the alleged perpetrator, it's not clear what else the employer can do to help. They certainly don't have a legal obligation to keep you on (paid or unpaid) leave on this basis indefinitely. They must only take reasonable measure to prevent and remedy any possible violence. This could of course mean different things in different situations.

    My warehouse recently made the incentive rate harder to hit. So the employer is saving alot of money now because they changed the order selecting and the rate. 90 percent are killing our bodies trying to hit a rate thats impossible. We basically have to beg for downtime. There are is no downtime paperwork at my job. Is this legal ?

      Generally it's not illegal to talk to employees, but there are ethical caveats to this, especially if the case has already been filed and the employer is represented by counsel.

    I was just terminated without a warning or write up for not being able to work overtime one time and I reason I couldn’t was I found out my son forgot his key to the house and he’s 11 so I had to be home at 4pm and my shift is 7-3pm . They said I was supposed to tell them ahead of time but I myself didn’t find out till mid day and though it shouldn’t be a problem because i should be home by then . Do I have a case for wrongful termination?

    • @ArkadyItkin

      This sounds like an unfair and harsh termination but not unlawful, at least under California law.

    Just to reiterate what happened, Sunday night feb 27th, i was arrested for dui. I was held for 2 days then released Tuesday night march 1st at 5pm. While I was locked up, I made a few attempts to contact the only co worker who's number I had memorized to see if he could let them know I wouldnt be able to work my shifts but was unable to contact him. Upon being released, I contacted my boss Greg Pardon, to let him know what had happened. At that point HR had already wrote the termination letter. I have been discussing this with cliff and we went through the contract many times to understand if they have validation.
    The first sentence in the letter HR wrote to me states” they made multiple attempts to contact me the 28th and march 1st via phone/ text message.” Well I did not recieve there messages because I did not have access to my phone. There was no way to retrieve messages at that point and as I stated, I made attempts to have someone reach out to them and let them know I wouldn’t be able to work my shift. Greg knows I would never just not show up for my assigned shift without contact. When I told him this over the over the phone upon release he said” yes I know, we were concerned about you that you were ok”.
    The second part she claims”I have abandoned my job, and voluntarily resigned “. That’s obviously not true. I absolutely did not resign. If I had abandoned my job intentionally and voluntarily resigned, why would I have called to explain my situation at all? Why would I have asked Greg on the phone if I could work the next day? And if I had resigned I would have had to sign paperwork. I 100% did not resign and was expecting them to understand I was not able to contact them during those 2 days.
    In our termination section of our contract states we can be terminated for “failure to report to work without just cause”. I obviously have just cause and made an attempt to explain. But HR’s letter to me was emailed at 4:56 pm on Tuesday March1st. This was sent without giving me a chance to explain, and Greg was aware what had happened and where I was even before I called him because one of my supervisor saw I was listed on the ccdc website for dui.He had this information by sometime mid day on Tuesday march 1st from what I understand. I was released 4 min after that email and contacted Greg about 6:30 pm. For her to have that email sent without giving me a chance to give “just cause” when they know I couldn’t communicate itself does not justify rightful termination.
