People love HOA's or they would not exist. They are the most popular in conservative areas that would rather have privatized government rather than have the county do it. The HOA can act quicker than the county, but there is not the check and balances of government. The rise of AirBnb has essentially rezoned neighborhoods into hotel zones and it seems only HOA's can block AirBnb, so they have become important than ever. Non-HOA in Florida seems to have the issue of people putting mountains of junk , boats, cars, dune buggies, multiple work vehicles etc in the front yard and HOA blocks that quick. I don't live there, but I like the way Gulf Gate neighborhood does it , with deed restrictions but not a heavy handed HOA, seems like the best of both worlds. There are no common areas or central park in Gulf Gate though, that could change with the golf course purchase.
Don't agree. HOAs are demanded from developers by the cities and counties. They have LOTS to gain from HOA. The HOAs become a child of the local government. Read my prior comment. HOAs are popping everywhere becuase the developers are being extorted to build HOAs vice non-HOA. The county says, no HOA, no permit to build.
Are you saying they can foreclose on your home, even if you own it outright and owe nothing to the bank? They can take a 400K home away from you if you don't pay a $200 HOA fee on time?

I ask because I'm looking at a 55+ community in southern CA, and one house seems to be a bank repo and sold by HUD. Could that home just have been taken away from the owner without even paying them?

In HOA, you own the air inside the walls. Then you are responsible for the interior plumbing/electrical etc. And guess what? That water/sewage line under all roads of the property are owned by the HOA. No one will tell you these things. The reason the HOA can foreclose so quickly is because the CORPORATION is the true owner and must remove those who occupy the corporation property. Therefore, the judge is returning what the INC owns, not you (you take the mortgage in your name with you when you get evicted from the HOA). Who benefits? The city, the county, they charge all same taxes with less responsibility. Think of an HOA as a city without rights to police/fire etc. The HOA is an artificial child of the city and county... I hope this helps you NOT to buy in HOA.

There is a legal process they have to go through but it is possible.

Those days are over.... The cities/counties have way way more to gain having HOAs than not... Read my other comment here to understand why.
HOA suck! If ever I can sell my condo and buy a home, I will never, ever buy into an HOA property every again!

Correct me if I’m wrong, but in Florida, they cannot foreclose on your home in order to collect their dues. That may be true in other states.
However, when you sell the home, they take all fees and dues off the top of the sale.
Yes they can. It is a process and they give you ample notice but they have the legal right to foreclose if necessary.
