Hello Dipesh...yes...husband income will be considered...if its almost same or similar then husband might not have to pay maintenance but if there is huge difference between the income of husband and wife then as per the status of the husband maintenance will be fixed...thanks...

What if some isolated incidents of slappin etc happened 5 years back that too in outside of India and after that it never happened and husband took care of wife very well specially giving her more than sufficient economical supports and residential freedom separated from in-laws for last 5 years ? All these can be proved very well. Can the husband quash 498a case in this case ?

For Non payment of Maintanence if husband sent to judicial custody then what will happen to than amount for which he was sent to judicial custody.

Hello Bharti....you will have to defend those cases....yes these cases can run parallel...so heir a good lawyer and defend those cases....if you want to get her back then you can file section 9 hma case otherwise just defend these cases....thanks...

Hello...depends ki husband ka status kya hai....look...maintenance now depends on the income affidavits of both of the parties....if there is too much difference in the income and status of each party then maintenance will be fixed....but if both are earning around same then no maintenance....thanks...good luck....

Mera intrim 2,20K civil court ne lagaya hai covid me na kuch janch hua na kuch document 60000 salary hai bol kar 10K every month lagu hua hai jise lekar mai HC gaya hu ,iske alawa DV ka 1 case hai usme v paisa mang rahi ,plus 125 me v paisa mang rahi hai jabki only 2 din rahi hai and pura filmy style me 25 pg ka 4,5 case kar di hai , 498 case me gavahi nahi kara rahi hai sirf paisa wale cases me present ho rahi iske alawa maine 12 2 Biii ka case kiya hua hai jo process me hai but civil court ne aisa kiya becoz bar president sath de raha hai mere mummy papa 70 yrs ke hai aur mai berojgar mai apna pan card bhi de sakta hu us se to pata lagega hi ki kitna income hai .overall totaly paise ka game hai pls guide sir..thanks

Hello ....a husband cannot demand interim maintenance except in divorce case....moreover you should file maintenance case...even if you are earning and he is not earning even then you should file maintenance case...you can write that he is earning such and such amount...let the case go on...let him prove that he is not earning...thanks...good luck...

I & old age parents are victim of wife's cruelty and mental harassment. She also did Fraud ( took alimony of 2 lakhs from previous husband and did hide this fact to us during marriage). How to prove in court about the cruelty on me and my parents and fraud that she did. If cruelty is proved and divorce can be granted based on that ( I can apply after 1 year of marriage) and will there be still interim maintenance and post that or will lower court say No interim maintenance.
