In all maintenance related cases, both the parties i.e. husband and wife need to submit an affidavit of their income, assets and liabilities as per the lasted judgement of Supreme Court of India.
Payment of Interim Maintenance
The Affidavit of Disclosure of Assets and Liabilities annexed as Enclosures I, II and III of this judgment, as may be applicable, shall be filed by both parties in all maintenance proceedings, including pending proceedings before the concerned Family Court / District Court / Magistrates Court, as the case may be, throughout the country.

कोर्ट कभी भी 498 ए के केसों पर अपना निर्णय नहीं सुनाता है सालों साल लग जाने के बाद दोनों पार्टियां दुखी होकर आपस में ही समझौता करती हैं कोर्ट से न्याय नहीं मिलता है कोर्टों को बंद कर देना चाहिए न्यायाधीश केवल लोगों को परेशान करने के लिए बैठा रखे हैं कोई भी एक केस वता दो जिसमें कोर्ट ने दो या तीन साल में फैसला सुनवाया हो, कोर्ट की भी एक समय सीमा तय होनी चाहिए 498a केसों का फैसला एक निर्धारित समय के भीतर हो जाना चाहिए 🙏

Hello Diana....if you have proof that he has not disclosed all his assets then you need to submit that proof before the court...it will help in fixing the right maintenance...also if you have got the proof then you can file criminal complaint against your husband....kindly read the declaration at the bottom of the affidavit...so complaint can also be filed...thanks...good luck...god bless....

Hello Pritam....agar aap apne parents ko apne par dependent show karoge money wise to unki income batani padegi...agar wo independent hain money wise to aapko unki income batane ki jaroort nahi...aap kuch dekhiye income assets affidavit ko..usme word use kiya gaya hai dependent....aur dependent wo money wise use kiya gaya hai...socially aur morally to hum sub ek doosre par dependent hote hain...so main point is aap unko kis capacity main show kar rahe hain...dependent or independent....dependent ki info bhi insliye maangi gayi hai kyu ki aapka expenditure ho raha hai dependent par wo court consider karega...i am attaching the affidavit...kindly take a look urself...you will understand...agar aapke father money wise aap par depend nahi hai to aapko unki details dene ki jaroort nahi....good luck..god bless...

Hello Sheela..yes family court can be used for 125 crpc....I have seen in some places 125 crpc cases are being taken up by family court and at some other places its been taken up by magistrate court...so till today there is no uniformity and the reason is because 125 crpc is a semi criminal type case which belongs to magistrate...so it all depends upon the District Judge orders in that particular court...Thanks...good luck...god bless...

yes court ko inform kar sakte hain about incomeplete information....court can direct other party to give full information or court can say to you that you give your information and they will see at the time of arguments....and who ever has given incomplete info can be at loss.....good luck....

Hello Vikas...you need to fill all the details of the property you transferred during marriage...if there is registered sale deed then you need to fill the amount mentioned in it....if you get employment after filing affidavit then you need to inform only if other party raises any objection....but you will have to prove that you got the job after filing of affidavit...it will be proved either by your appointment letter or salary account...so there should not be any worry....if other party donot raise any objection still at the time of evidence you need to disclose that now you are employed and got the job after such and such date....thanks...

Sir I don't have job, I am not earning. I am staying in my parental home. Every month my brother give some amount for my parents house needs. My brother transfer that amount every month to my bank account. I will withdraw and I will give to my parents through ATM. Sir in affidavit if i submit my bank statement it shows that my brother is sending amount. It creates any problem in my maintenance case when I submit bank statement copies in affidavit. Pls clear my doubt sir.

Hello Ratika...agar doosri party ye kehti hai ki wo house wife ke naam hai to iss baat ko prove karne ke liye ki wo father ke naam hai tab registry ki copy lagani pad sakti hai...but normally doosri party aisa objection nahi leti...monthly expenses kuch general hote hai but agar kuch specific expenses dikhaye hue hain to evidence ke time par unka proof dena hoga...like school fee...medical expenditure...any coaching fee or those expenses which are high...baki day to day expenses ka proof nahi dena hota...Thanks...good luck..god bless...

Sir what if wife declares false education qualification in declaration of assest and liablities will it be treated as case of 420 or divorce on metal cruelty because in the biodata during marriage educational qualifications were something different then what is was shown in declaration of assets and and liablities in domestic violence case. Can she change it later by giving some vague excuses. Please answer my question
