Hello Aman...now a day, court is taking notice of such transactions...and if these transactions are done just to defeat the rights of a female or wife like rights of maintenance or right to residence then court can give the female that right irrespective of those transfers...like right to residence...thanks...good luck...

Sir is it mandatory for wife or her advocate to follow the exact guidelines/format of SCmandated Rajneesh vs Neha affidavit format? In one of the maintenance case in the wife's affidavit the individual questionnaires and Declaration part has been completely tampered in complete meaning and interpretations. Could the wife be liable for criminal prosecution?
Hello Rahul...you can raise objection before court....it is for the court to decide which format to use or not....good luck....

Hello....out of court kabhi paise nahi dene chahiye....aur agar compromise ho gaya hai to usko maintenance case main court ke saamne rakho....ho sakta hai koi baat ban jaye....but agar oral compromise hua tha to court shayad hi uspe yakeen kare....written compromise hona chahiye....good luck....

Sir I have file an case against my wife and his parents on October under IPC 323,452,147,148,506,315.
But due to awaiting report it's still pending till now, no hearing started.
I have file case with all proof of cctv and documents proof.
But now in December my wife file an case of dv. Now all councelling has done and case is gone on court.
She file an false dv case on me.
My wife gone from my house in September with herself only. That proof also I have.
So how can I quashed it's FIR, and can I get benefits that I am file an case before her. I file an case in October and he file an case in December after 3 months.
So can I get benefits of it.
Please suggest sir
Hello Himanshu....case will not be quashed just because you file earlier and she filed later....it will be quashed only if its based on false facts...so if you can prima facie prove that allegations are false then you should go for quashing....good luck....

Kyuki tehsildar ne kaha k agar jab tak aap intkaal nai krvauge tab tak record aapki mother ke naam se hi niklega.

Sir if leaving abroad salary hardly 35 to 40 thousand expenditures rent food taxi medical treatment bus/metro pass etc cost around 38 k per month with all details of bank and salary slip so how can court decide interim maintenance in this ?
Hello Dupinder....every husband claims like this in court....court says that if you have married then taking care of wife , maintaining wife is also the responsibility of husband....in this case if 38k is expenses and 40k is income...then if wife come to husband how will he be able to maintain wife....court will look into all things but in a neutral way....court is much clever than husband or wife....good luck....god bless....
@@LegalGurukul well court is clever it’s fine so u mean to say medical salary slips expenditures all is not enough to prove from the last 2 years I have all bills my all savings gone and wats app chats of wife where she want to kill my mother plenty of things for me she said in to her sister in wats app chat . So court is clever and even give maintenance I hope you know that in abraod nothing gonna be fake .. and everything’s is online so court wanna check k can show the proof of everything . So my question was in this scenario if court for for interim maintenance how it would be as per your knowledge ?
Hello dupinder....wife right to maintenance is all together different from her other rights....even if husband is not earning it is the responsibility of husband to maintain wife....its only in case of husband body disability that court can think in favour of husband....moreover whatever you said has to be proved by way of evidence....and evidence stage comes later so till the final decision of the case court will fix maintenance....your health problems can help you in fixing less maintenance but it very rare that it interim maintenance won't be fixed or declined by court altogether....good luck...god bless....

सर् मेरी शादी सन 2009 मे हुई थी और सन 2010 मे एक पुत्र का जन्म हुआ , जन्म के ठीक 6 महीने के बाद वो पुत्र को लेकर अपने मायके चली गयी और फिर कभी नही आई। परिवार वालो से बात करने पर पता चला कि उसको पैसा और डिवोर्स दोनो चाइये । सन 2013 section 13B के तहत हम दोनों ने mutual divorse फ़ाइल किया और 6 month के period के बाद हम दोनों का mutual डिवोर्स हो गया जिसमें मैने one time aluminy और समस्त स्त्रीधन वापस कर दिया।
बच्चा भी उसी के पास है।मैन अब दूसरी शादी करली और उससे भी मुझको एक पुत्र का जन्म हुआ।
2022 मे मेरी पहली पत्नी न अपने 11 साल के बेटे के लिए sec 125 maintenace case किया है वो 25000 rs की डिमांड कर रही है मेरी पहली पत्नी भी लगभग 40 हजार रुपये महीना कमा रही है।
मुझको अपना मार्गदर्शन दे

Hello Faisal....aap muslim hain to aapko muslim tarike se divorce dena hoga aise main aapko apne kisi maulvi se baat karni hogi...kyu ki ab 3 talak khatam ho chuka hai....second marriage kar sakte ho ki nahi wo bhi wahi batayega....but aapko inta jaroor bataunga ki wife ne jo case daale hain wo aapko defend karne padegne aur maintenance bhi dena padega....good luck...god bless....

Hello Debashis....yes all these will affect the maintenance....as per affidavit...husband wife both need to file details of property held at the time of marriage....any property disposed after marriage....so the court will look into circumstances in which property was transferred...if the sole intent was just to avoid maintenance and such other things court will take due note of it...also all perks have to be mentioned in affidavit...post is also to be mentioned....even if you are working in bpo...but basically its the income or the sources of income that will matter....position of manager is not relevant it will be just for the sake of argument but the main thing will be your income and living status....thanks...good luck...god bless...
