      For real, Kolee was spot on legally, and also outclassed every one of them. The Terrorism Act stipulates that all public filming is passive reconnaissance until it's presupposed on intent to commit a terror offence: only then does it qualify as hostile reconnaissance. Further, the Terrorism Act uses the phrasing "hostile reconnaissance is by nature covert". In this case, Kolee was the very contrapositive of covert. Therefore, the Police carried out the search under a false premise, which makes it an illegal detainment and illegal search.
      Based on the above, the Police Officers were guilty of false imprisonment, and assault under Section 39 of the Criminal Justice Act 1988. Given this, they should be arrested and charged with a criminal offence. However, we all know that won't happen (the Police look after each other).
      It was clear from their behaviour that they did not have any suspicion whatsoever that Kolee was a terrorist, or planning any act of terrorism. If that were the case, they'd have already called in an armed unit and had him on the floor in cuffs. Their demeaner was calm and relaxed; which implies they did not feel any threat. If they believed he was a terrorist, it would have been a different story. Therefore, it can be deduced from their actions that they abused the law to put a member of the public back in their place, i.e. as a subservient to the Police, to restore their egos. Tyrants gonna tyrant.
      In conclusion, Kolee has a strong case for civil action against the Officers; which, he pretty much has a 100% of winning given the entire incident was caught on camera, and the Police will almost always settle out of court in such cases. Kolee should thank the Officers for facilitating a substantial increase in his bank balance.

    Even though they abused their powers it was so satisfying watching you tear them apart. They looked more and more defeated/sheepish. There aren’t many auditors who actively learn the law and conduct themselves in an exemplary manner. I look forward to hearing about the success of your civil claim.

    That’s probably your best video yet , you were cool composed and knowledgeable in the facts pertaining to the law , witch the police did not . Absolutely disgraceful behaviour from both the male officers, simply making it up as they went along . The female knew they were acting outside the boundaries of section 43 and still chose to do nothing to correct her male counterparts. They frankly haven’t a leg to stand on . Well done . This video shows when you are on top of your game you are an outstanding auditor. Thanks for sharing.

      This really was a textbook example of how an audit should be carried out:
      1. He remained calm and courteous at all times.
      2. He exercised his rights.
      3. He explained to the Officers why they were invoking Section 43 incorrectly.
      4. During the search he still remained calm and courteous, which is hard when you know you're being assaulted illegally.
      This video needs to be used as a training example for Auditors, and also for the Police to educate the Police on how NOT to act towards members of the public exercising the right to engage in lawful activity.

I would only suggest one thing, when the cops say 'the grounds are that you were filming the police station', then ask them 'so are you saying that in your opinion filming the police station constitutes suspicion of a terrorist act?'. Then it's black & white as the grounds are not reasonable.

    We’ve seen it in many audits. A police officer misuses section 43 of the terrorism act in order to learn the identity of an auditor. And, as viewers, we often feel angry on behalf of the auditor and annoyed at the obvious ego driven behaviour of the police. But there’s always good news at the end of the day, because we get to see the look of frustration on the police officers faces, when they realise that for the first time in quite a while, they are dealing with a citizen, who is not carrying ANY form of ID on them at all , and so they are faced with the frustrating reality, of having to let the auditor go, and at the same time exposing the fact that they never really believed the auditor was a terrorist, because we all know, that if they really believed that, then they simply could NOT let the auditor go after the fruitless search was completed. Think about it. If you genuinely believed that a person outside your police station was in fact a terrorist, would you allow the fact that they don’t have any form of identity in their pockets, stop you from arresting them and interrogating them or handing them over to the antiterrorist branch. So, there is the proof that we all see time and time again, section 43 of the terrorism act is being misused, simply as a tool to try to circumnavigate the problem of a citizen declining the request to give up their rights and identity. Shame on every police officer that misuses their powers in this way. We can all see you for what you really are and the look of embarrassment on the faces of these officers as they took the “walk of shame” was clear to everybody watching this video.

      Very well summed up. These bellends even found someone having an empty rucksack suspicious. If filming outside a police station was an actual danger/threat it would be illegal.
      I am seriously hoping that in the next few weeks/months Kolee starts releasing some videos with progress/results of court cases otherwise all this effort is pointless.

    Their lack of professionalism is appalling and I fully agree with how you reacted, which was the best option in the circumstances. They are nothing but a taxpayer funded gang and they operate from a position of paranoia and an almost total lack of understanding of the very laws they are supposed to be enforcing. Everything seems to come down to a zero sum game where they have to feel like they won because their idiotic egos are so fragile. I have been watching these audits for well over a year now and with every episode my total distaste and lack of trust for the police is growing. Your behavior throughout this interaction was calm and measured and you came from a position of legal knowledge while everything they did was childish, vindictive and ego driven. I sincerely hope you can pursue a civil action against these petulant idiots and hopefully one day they will start to learn that policing is by consent only! In the interim keep posting the videos so we can all see just how totally stupid they make themselves look.

    The sergeant really screwed up, he searched Koleeberks' phone after the Section 43 search had been completed by the other male constable, this is unlawful and violates the legislation of that specific act, he had no powers of authority to do it and if the sergeant had seized Koleeberks' phone he would of further continued to break the law which wouldn't of gone well for him in court. This is what happens when you refuse to play ball with the police, it's disgusting how corrupt, incompetent and uneducated constables and officers have become, that they are deliberately willing to violate a person's civil rights, just so they can make an arrest and score another Brownie point with their superiors. The police have gotten away with way too much accountability over the years, it's reached a point now where they simply don't care of the consequences because there aren't any consequences for them should they mess up. I hope Koleeberks takes some kind of formal/legal action against the 3 officers, this type of despicable conduct needs to be exposed, addressed and stamped out as it is totally unacceptable, unlawful and wrong.

    Although you warned them on several occasions and gave them a chance to get out of wrong doing they still went ahead and did it anyway. How many other peoples rights have they violated where it's not been filmed. That sergent was a clown, away reading up on terrorism legislation and bringing his phone over excited as he found something he could try and uses against you

I can’t believe the sergeant searched your phone after you had been told that the search was over and that you were free to go.     At 07:30 into the video he said "I've completed the search now" then at 07:34 he said "No your not detained any-more no", they decided to examine your phone when they checked the legislation at 09:00 into the video.
    When the other copper examined your phone it was clearly a second search and as you was not detained at that point it was clearly an illegal search.
    You have nothing to apologise for, making it clear that you was letting them examine you phone under duress of it being stolen by them was exactly the right thing to do 👍

    Well done for holding your own. I know you let him look at your phone but it was done under duress and illegally which will increase the value of your claim. I have noticed recently lots of auditors seem to have lost there way and just seem to go straight into attack mode when confronted by the police and also do not seem to have a purpose to their audits except hostile confrontation, you play the game the way it should be played, keep up the good work!

    I personally would demand two sets of documents for the two separate detainments and the two separate searches. They were two very obviously separate things even if the officer chose not to listen to that fact. Ignorance of the law is no defence. CRIMINALS MUST BE BOUGHT TO JUSTICE NO MATTER WHAT UNIFORM THEY WEAR.

    Once the first search under S43 had taken place you could see the awful reality of the futile abuse sink in. The Sergeant does a brilliant job of barging in and abusing S43 all over again, and wrongly assuming you were detained. What a cluster, as the new searching officer he did not follow any procedures.

    In order to check a persons information upon a secure database or records, you have to have a legitimate and lawful reason to view/check that data.
    Therefore, demanding it from a person to then check their info upon a whim to see if there a gambling chance of they are known criminals is unlawful

    To reiterate, they do not want your details to "run you through the system" they want your details to PUT you on system thus giving you a criminal record which could have enormous repercussions for the future.

    Another good video. You should've asked the Sergeant to listen to you, explained to him the search was complete and you were free to go. It's important that you tell him clearly so he understands. You then ask him, like before, for the grounds of his new search and what he expects to find. At the conclusion, you ask for a search record. You'd have 2 separate search records within minutes. You'd also see that the Sergeant legally detained you then used section 43 with 1 minute of the detainment. All of this would greatly assist you in what ever course of legal action you wished to take.
    Again, good job. I know its hard to think sometimes because they don't want you to have time to think. Something to remember for next time.

    If they have no legal grounds for an action, it's unlawful... and you do not have to surrender to illegal actions being done against you

    10:16-10:19 the big gulp moment and guilty look in his eyes whereby he knew they screwed up. Also that was clearly 2 independent searches from two different officers. The Sargent who took your phone did not conduct the initial search so he should present you with a copy of the illegal search that he conducted. That was clearly an illegal search.
