  • Confirmation of child support arrears
    Dad makes $25 an hour and only works 50 hours per week but generally he works 60 hours a week
    the court order states this child support ended as daughter graduated from high school although there is another child that's still under the age of 18
    the court order that was done in 2019 didn't order Dad to pay child support for the child unemancipated minor
    the way this court order is written dad doesn't have to pay child support for that child
    Mom cries and says that's not fair
    Apparently Daughter was not fully enrolled in a accredited high school education program that allowed for child support to continue past her 18th birthday
    home schools generally are not accredited

Most frequently, child support is paid by the non-custodial parent to the custodial parent, but this is not always the case. Depending on where you live and the agreement you reach, the child support you pay or receive and what expenses it should cover will vary.

      You must not have been paying attention, at the very end there the judge clarify that was an issue for a separate government entity to handle. Odds are if he brings it up she'll have to pay him back and if she doesn't have the ability to do that then the swbt owed here could be used in place of if the parties agree to it. It's also his responsibility to know his payment schedule, he should have stopped paying months earlier and she should have stopped receiving it early. In the end his claim against her is called something like unjust enrichment. It was clearly an error

      He will get an offset or refund from the state. Trust me they won't keep the money. It may go towards administration fees once the child ages out.

      Having have dealt with this, the state will call them voluntary over payments and as such the state doesn't have to pay them back to the father or give him a credit for them.
      The states position is that any errors or over payments are on the father to address in court in a timely manner.

      One, child support shouldn't exist. Two, if it's going to be done it should be fixed like tax deductions and credits for children. A child can easily be provided for around 300-500 dollars a month; especially, if it's not full coverage, so that's what it should be regardless of income. Not to mention, if the mother isn't working, then the father should have full custody, since it makes no sense to pay for them to live with someone else.

      in my state 300 will cover food and thats about it. plus the added cost of a second bedroom place clothing and any other expenses. i can see 700 being more than resonable, but like anything it would depend on the sate/location@@litigioussociety4249

      If a guy oays for one child, that child gets between 25%-50% of the man's income. If he pays for two, child 1 gets 15-22% and child 2 from 5-10%. Each amount goes down, until the 10th kid gets like 1% of the income.
      You can praise the fvkked up system of "justice" in America.

    I got one for ya fellas. My name is Donterry Woods, my daughter was kept from me so much that I only saw her about 10 times within 11 years. I went to jail at one point for missing payments. Little did I know, my daughter was being abused and had a cyber relationship with a man in his 20s when she was 11. I LEGALLY kidnapped my daughter since there was no court order giving sole custody to her mom took her to court and won custody!!! My daughter has been with me almost 5 years now. She went from Ds and Fs to being in college at UNCW at the age of 16! Keep fighting dads!! I hope this made you guys feel better!

      Bc that's how CS works, when you have say 2 kids and your monthly support is 800 a month and one ages out and owes no arrearages when the one child drops off they aren't going to half it, they will take maybe 50 bucks off or so...my dad was to pay 100 a week for 2 kids (this was late 90s early 2000 (I was 18 in 2002) when I dropped off, dad had thought it would go to 50 a week and when the judge dropped it to only 80 a week my dad throw a shit fit in the court room... Btw my dad has been at the same machine shop since I was like 6 I'm 40 now and he's still there he will be 60 in Nov 2024. And has always made well above average he just didn't want to pay mom shit...

      I suspect Mom does have a job. But she has the child the vast majority of the time and likely makes way less than 57K.

      I hate it when people assume the money should just go into a little kid wallet or purse for them. Lights, gas, car expense, rent, clothes, cable, wifi, new bedding, toothbrush, soap, laundry supplies, on and on, extra curriculum activities, etc. All that goes into a child's life. And they set it based on what is earned by both. Women who don't work( yuk BTW if you get away with not having a job on this day) goes to minimum wage number.
      If you put a baby in someone, then leave, or however it happened ya split, ur child deserves to live the standard of life you are capable of providing. If you think baby mama gets a " come up" from this, well oh well. Too bad. Deposit ur seed in a woman who makes more then you. Then go work for minimum wage urself. And get custody of the kid and she will have to pay you. It's just what it is. Wrap it up next time or don't divorce till they grown.

      Most of what you listed should already be provided by yourself in the first instance, in order to be considered a fit parent. If you can't afford detergent independently, you can't provide clean clothes for your child. If you can't afford your utilities, you can't provide them for your child (heating/AC being a necessity dependant upon state). If you can't afford internet independently, you can't provide it for your child, and realistically, just shouldn't have it, if you can't afford to provide it.
      The other parent has to provide these things whilst they have custody of the child, and they're not getting support of the other parent.
      As stated, most of what you listed, you should be capable of providing independently of child support payments.
      I mean the big one is rent - your housing/living arrangements are your own responsibility, if you cant afford the rent independently, you need to find a place you can afford, or, face homelessness and a potential loss of custody

      When I owed child support, the state of NY said that they didn't care if I lived in a cardboard box on the street, the only thing that matters was the child support, not whether I had a roof over my head or not. The system is rigged in favor of the mother. My ex worked for her lawyer, and even got an increase to keep her high expensive living routine.

      That's the thing; She WAS receiving CS...This was a modification hearing (She was asking for more CS...) Sounds like he was paying the months that he could, and went into arrears for a month or two. All that $ + interest + fees must be credited back to him...

      As both parties stated.. Neither ask for this case to be before the judge. The state of Texas simply wants it's cut of the money that get processed through the system. It's a self serving system. Conflict of interest and a reason the "system" will never be fixed. It's another income producing source for the state.

He now has to pay the 765 plus for the one kid going forward. He owes like 2 grand back however he paid for that year and the state has that money. He will ask the state for it back and In a perfect world he would get it minus the arrears and continue paying for the one kid going forward. The state will probably deny this and at that point he can sue the state for it or let it go and the state keeps it but it won't go to the mother (supposed.to be for the kids) because there wasn't an order for it.

Dad will have to request for the child support the state is holding to be sent back to him. If he’s a decent guy, he’ll send it on to the mother for his son, but he has no legal obligation to do so.

      He said she lived with him for half of 2019 & actually had gotten married. If she was married, then child support should automatically stop for her, there is absolutely no reason this woman should get any back child support for her married daughter, even if the girl was married before her 18th birthday!! The day I turned 18, during the fall of my senior year of high school, my dad quit paying child support because I was 18. This was WAY back in 1971.

      Child support isn't calculated strictly on a per child bases. You get a set amount laid out by a formula for the first child, then they add an additional percent onto it for each additional child, something like $500 for child 1 and $250 for child 2. This is because the extra expense of housing is typically covered by the payments on the first child. If calculated at the same rate of pay he made in 2019, it would likely be paying closer to $500 but since he almost doubled his income, the amount of support for the 1 child is increased.

      I would say the previous order was written based on wages and formulas in place at the time. At the current time his wages are probably higher and the formula for calculating the amount may have changed. The Dad didn't have to pay back child support. So it isn't really that unfair. After all his younger daughter deserves his support even though she was born later.

      Texas child support is 20% of income up to the max amount of 1849 for one child. They cap the amount of the earner at 9,200. If Mr. Smith made 15,000 thousand a month, he would still only pay 1849 dollars for the child.

      Actually, the judge followed the law for Texas. This woman was expecting to be awarded 2 years of back child support and she left with nada.... further, I can say the father absolutely would get credited for the continuation of the child support beyond the original end date of Oct 2020. He would just have to go court to get it addressed. I wouldn't be surprised at all if the whole "arrears" that he has on the books was wiped out by that too.

      How in the world does a parent who has custody of their child not know when their child graduated?? I have 4 and know to this day when they each graduated. First she disagreed with dad on the year then wants the judge to do the math based on when the child was born?? Lol Some kids don't graduate at the exact age that most kids do either due to repeating a grade based on their grades or lack of attendance. Parents really need to get it together, especially if they're going to go through this process of court. Document & keep copies of EVERYTHING in chronological order.

There may be mental health issues contributing, and then there’s just the simple fact that they are in a court hearing right now. That can be extremely stressful, and when some people get nervous they have a problem thinking straight.
      I don’t think we can really judge a complete stranger off of that. I know that I love my child more than anything in the world, and I gave my everything to raise her and give her the absolute best she could have (and still do even though she’s an adult herself now). But if I’m in a stressful situation, I wouldn’t just be able to rattle off her graduation date to you if you asked. There are some things like that that seem to stick in your head for eternity (for example I’ll never forget her birth time, birth weight and length, and phone numbers from my childhood!), but sometimes I can’t even remember how old I am! That doesn’t have any bearing on my ability to love and provide for my child.
      You look way too old to be playing this character of the shaming villain. So let’s not play the judgmental mom to other parents, Debra. It’s a disgusting look in the absence of anything serious. She’s a woman in distress, whether we understand or agree with the reason she’s in distress or not. She’s obviously not going to be at her best right now.       I’d love to see payment sheets done for both parents. majority custodial parent can pay more if they spend more time with the child. Parents paying hundreds of dollars and only seeing their kids one or two weekends a month when they aren’t incurring the costs is nuts. Support shouldn’t be a penalty for not being with their kids 24x7. Each parent should just pay for expenses when they have the kids and split custody fairly. Then both parents need accommodations for the kids and are spending the same amount.

Neither parent should ever have a financial incentive to divorce. Neither parent should ever be able bludgeon the other with the threat of financial ruin and an every other weekend "parenting" plan.

      I doubt she read it. It's a very atypical court order, and the judge said it wasn't fair, so it shouldn't even be the way that it is. She probably assumed that the child support order was just standard, but this one isn't. It's wrong. It's not supposed to say what it says. The attorney general didn't screw up, the attorney who wrote the child support order is the one that screwed up. Even the judge said so.

      Only in that particular order. Circumstances vary and most orders are not written this way. Unless it's a special needs child financial support is required until the age of majority. Very often provisions are made to continue portions of support through college. I

      my children were raised by a mother that took off across the country. both my kids dropped out of school at 16 and moved out of thier mothers house. my daughter was 23 and married and i was still paying child support. 7 years i unjustly paid child support. i would have been fine with it if i was paying it to my children.

    It infuriated me how her face changed when he said she WAS going to get a check. This order still isnt fair AT ALL, hes paying the same amount he was for 2 kids for 1. And in all reality hes supporting his ex. Plus he paid when he had them full time and after the order should have stopped. I hope he takes it back to court she needs to support herself.

      The state receives $0.66 on from the feds for every dollar it collects in child support. The state doesn't make any money if it were to aware physical custody to the father. Even though common sense says he has the monetary ability to rear his son without the intervention of the court. This arrangement isn't in the best interest of the state.

    1:40-ish - I would never tell anyone with Child Support I work more than 40 hours a week. It is just WRONG that they force people to continue to work overtime because they so happened to be getting overtime when they were in court.       It absolutely does cost that much and more. Especially if a child is in private school, daycare expenses, don't even get into sports! If the child has a chronic illness.like asthma, ADHD, special needs, need braces, glasses, tutoring for the God awful state Staar Test, needs a car for school, car insurance, school field trips, basic toiletries, school uniforms, their feet grow every year, a high school senior year is HELLA EXPENSIVE. Even college applications are costly. Even elementary kids require wifi for daily homework...However she does need a job.

      @@mrshappilymarried1 both parents jeed to pay for day care and tye child can go to public school and medical is usually covered with the parents job. Just because one has the kid for two more days doesn't cost 700 a month for the one parent , there is a lack of holding both parents accountable.

      @@Whatsthe_dill I have 4 children and daycare alone for our twins was more than $700 a month. You really don't have any idea the money public school cost in a year. School uniforms, school supplies, fundraisers, PTA events, you must have no idea. Health insurance is astronomical. My coverage is better so I carry everyone and it's over $300 per pay period. Our son was born with an eye condition and has had 3 surgeries since birth. There are out of pocket expenses BEFORE your deductible pays their portion. His glasses alone are $400.
      I could go on but I won't. Bottom line is Children are Expensive yet Priceless Little Blessings that cost more than $700 per month.

    It's so stupid that he paid child support for 2 yrs and then hits him with a 1700$ that he missed but doesn't go back and credit him for the amount he already paid when he was not suppose to. People forget that child support is for the child, so the mother is crying acting like a victim is crazy to me.

The parent receiving support shouldn't expect to pay their own rent and have all expenses covered for child support, that's not what it's for. It's to support the essential needs of the CHILD.
      Whatever food that CHILD needs that month, clothes that CHILD needs each month.

      @@pii-chan8804 I don’t have an issue. I have an opinion. As a child of teenage parents I know how growing up can be more difficult. As a mother to a 20 year old college student. I’d kick my child’s butt if she even thought about getting married and moving in with a boy at 18 dropping out etc… I want her to be set up for success in life. But some kids just want to get out of crappy homes. I get it. Hell I did it. But it’s bc my parents were 16/20 when they got married and struggled my whole life. I did a little better. I at least went to college and made sure my kid had no excuses. You always want better for your kids.
