      I overpaid by 3,000+ and was told that the state I live in is a "windfall state" and that any overpayment is water under the bridge. It's gone and I will never get it back.

      This man likely had his wages garnished and sent directly to the state. Absent a termination order, the garnishment will continue unabated until the order has been adjudicated. Unfortunately, this means that he has a credit to his account and the recipient is unable or unwilling to compensate. Men need to watch when nearing the end of support obligations and be proactive with their attorneys in a timely filing of a termination order request to prevent overpayment. The state won’t repay an overpayment, and in some cases like Pennsylvania, consider it as a gift. Good luck trying to recoup that money. The pandemic caused a lot of problems in these cases as hearings were postponed while wages were still garnished.

    this case is infuriating. not only did the judge & the AG offer the women multiple opportunities(bordering on coercion)
    to claim she was destitute so she could get out of returning the overpayment. It's a perfect example of how men are treated unequally. If the man owed back child support do you think the AG's office would pander to him. no, he'd go to jail.
    WAKE up men! the child support system needs to be revamped to treat everyone equally regardless of gender

      Yes and no. I used to think it should be monitored more but at the end of the day if child lives with mother and dad just has visitation EOWeekend then no it shouldn’t.
      And visa versa, some of these cases get so complicated bc adults can’t coparent or one parent is still hurt and wants to punish the other parent by controlling the children and blocking access.

    Unbelievable that her only excuse for doing this was "emotional needs". There was a reason the father stopped seeing his kids. Most likely because of her. He did not get the benefit of the love of those kids while she did. If her kids were a burden, that's on her. She's the one who raised them. If they were troublesome it's because of her. Her problem is that she's butthurt because of it all and gladly took advantage when he kept paying for the kid after 18. You don't get to say later that he wasn't in the child's life. That choice was made by her when she put him on child support. If he had been in the child's life they would've had joint custody and been 50/50. In which case he wouldn't have paid child support. You can't have your cake and eat it too.

    Child Support/Family Court reform is definitely needed at this point! For a mother/woman to say I am not going to pay back the money that was sent after the child 18th bday is crazy! No jail/prison time, no garnishment of wage, or lend on any property that she possesses is in insane! Because if this is a man/father/non custodial parent, all the things I mentioned he would force to do or pay!

      It just shows how convoluted the justice system has become! Simple cases get so bogged up with legal jumbo that one is almost forced to hire a lawyer because judges don’t like dealing with regular people maneuvering through the system!

    Same thing happened to the comedian 'Earthquake' he overpaid child support by 10's of thousands of dollars. He took her to court & the judge put it on the backend so that he'd be finish paying support 6 months early. Plus his son was already living with him the last few years. She tried to appeal claiming that she coildn't maintain her household without that income.

    If the state was garnishing his checks. They are responsible for the repayment. They knew the record showed the child turned 18. The garnishments should've stopped upon the child turning 18 automatically. Then the state should go after her for accepting and using money illegally. Any hardship she has because of families medical issues is not his problem. He was only responsabile for the child alone. Not for paying family bills or funerals

    This was a sad case, but the correct outcome. Mr. Guy was pissed that Miss Williams put him on child support, so he distanced himself from their son, who ultimately paid the price of not having a meaningful relationship with his father. Sad for their son, but oh well for Miss Williams. Return the money, sis; you picked him.

      Because the kid stops needing things at 18. I know someone who received two payments after the child reached 18. That man refused to do anything extra for that child for 18 years but took her to court for the two payments. Luckily she showed where she used it to pay for housing fees and a new laptop for the child because he was going to college. She also showed where she had to take out a student loan in her name for the child’s college tuition. The judge looked that man in the face and told him he ought to be ashamed and dismissed him smh

      Texas is a “mothering” state. A friend of mine spent $60,000 in attorney fees to get his child back from a woman that was prostituting herself for drugs with her child in the car/home. He had documented proof, but it wasn’t until he paid for her hair to be tested for drugs that he got any foothold.

    I don’t know if it’s the state where I live, but my husband overpaid and he’s receiving checks from the state still to this day and his daughter is 25. It’s sad what these fathers have to go through. I know what we went through and what he did as a father and was still dealt a bad hand. Mom tried 18yrs to keep her away. She’s 25 now and we can’t get rid of her so just be mindful, kids don’t stay kids forever.

    My ex-husband overpaid $23,000 to his ex-wife, over the course of 5 years. When the state audit found it, the state sent a letter asking if he wanted to make a “gift” of it to the mother since it would be a hardship for her to pay it back. She knew it wasn’t her money.

    She should have taken it to trial and got a jury. She would have been able to show he never paid child support until age 9 on. I have seen it done so many times. He probably would have owed her more than that $13,000. She should not have let the judge intimidate her with “I can only talk about 2011 on”.. the child was around before 2011.

    Why wasn’t the CS payments automatically stopped, everything is computerized today. It should be programmed in to stop the payments as soon as the child turns 18. If he wants to continue to support him, that’s on him to do so.

    This is why the system should have an automatic termination date entered into the system so no payments are received after the age of 18 or the date of a projected completion of HS. Just like women have rights there need to be laws that's for men as well.

    Child support normally terminates by operation of law when the child turns 18 and graduated from high school in most states. Child support agencies rely on parents to notify them of the graduation date in order to stop any withholding order. This lady has no legal right to this money. She thinks she deserves the money because she feels wronged by Dad. You can hear the anger in her voice. Revenge isn’t a valid, legal excuse.
