      Binasa ko and Criminal Law ni Luis B. Reyes. The best Criminal Law books available for students and lawyers. Makapal but worth it because the two volumes extensively discuss the crimes and the Supreme Court cases.

      Ang ibig sabihin ng "moot and academic" ay wala ng issue o controversy na dapat i-resolve dahil marahil nag settle na ang magkabilang panig, binawi na yung kinukwestiyon na utos o batas, namatay na ang complainant o ang defendant, etc. Madalas, ididismiss na ang kaso.

    Atty. what about strict construction? How does it differ from Statcon?

      Strict construction is applied in certain laws or cases. For example, criminal laws are strictly construed against the State. Labor laws are strictly construed against the employer but liberally construed in favor of the employee. Just two of the laws given strict construction. By strict construction, the law shall be applied to the letter, without regard to other circumstances.

    Confuse on divorce abroad. If the filipino file, how it work? is there a jurisprudence?. Plan to proceed to law school.

      When a Filipino files for divorce in a foreign country, it should be in accordance with the law of that country. Then the divorced Filipino should file a petition to recognize the divorce decree here in the Philippines so that the said Filipino can remarry.

      Follow up po atty what if they’re both filipino applicable po un divorce? Acknowledge po b ng korte suprema? Meron b need construe sa family code sa usaping divorce abroad? Salamat po

      Ah. Kung parehong Filipino, hindi recognized ang divorce nila sa ibang bansa dito sa atin. That is against Article 1 of the Family Code which states that marriage is an inviolable social institution. The only grounds available to terminate the marriage are death, annulment and nullity of marriage.
