  • He was deleting GPS locations in his phone - pretty pointless IMO. This was before the mobile phone laws so there was no chance of him being prosecuted for a mobile phone offence - there was no interactive communication. Holding the phone and swerving in the lane, though, that's a due care and attention offence, and I suspect that is what he was prosecuted for.

    As a passenger I've asked taxi drivers to stop touching their phones whilst driving. Usually I get a grumbled apology but sometimes I get a mouthful of abuse so I report them to my local council. Nice one Mikey. Keep up the good work.

      From the gov website: You must wear a seat belt if you’re pregnant, unless your doctor says you don’t have to for medical reasons.

      It does indeed. I've been stood next to the driver side window of phone using drivers for prolonged periods of time. Hi viz jacket, dayglo orange gloves, gopro stuck to my helmet like I'm some kind of flipping 6ft4 tellytubby and they still don't notice. But then quite commonly they don't notice when the car directly in front of them moves on so what hope the person standing next to them......

    Just last night the Uber I was in was involved in a crash. A moped had stopped at a zebra crossing to let someone across and a car plowed into the back of him with such force that the moped was airborne for over 15 metres before slamming into the side of the Uber I was sitting in!
    It’s my firm belief (without proof though) that the car driver at fault was probably distracted by something like a phone.
    The moped rider was lying in the road for over 40 minutes while paramedics treated him and the road closed for over an hour, luckily the police said his injuries were not life threatening but will surely mean recovery time and no income for him!
    So keep up the good work Mikey, never let anyone say you are not doing good and performing a public service. Take care and stay safe…..

      For such a serious accident the police will check the car driver's phone records to see if it was in use.

      I was out to day and saw many with their phone on their lap trying to hide the phone and looking up then down while waiting at the traffic lights.
      It has become the norm.

      If the Uber driver was using his phone for anything other than reading something already on the phone, I am fairly sure the data transfer would be logged by the phone system just like a phone call, text-message, whats-app or anything else which uses the data network. There will be a record of the data, time, rough location etc.
      Maybe the police should do their job properly and investigate what appears to be a case of careless driving?

    The old rule of “no interactive communication” makes no sense. I’m glad it’s changed. Under that rule it sounds like you could play a game or watch a film, ridiculous.

      The daft thing was it was really a failing of case law rather than the initial law. It seems the problem was a law written in a manner where the judges didn't understand the terminology, and lawyers able to argue it meant a specific thing that really was the least likely interpretation.
      Data sent to the device following a request for data is "Interactive communication". So you use your device to request a website, play a game that runs adverts or communicates with an online server, play your Spotify playlist etc. Any time you initiate a data request on the device, that is interactive communication. But the technology jargon was perhaps not clearly relayed to the judges, and so we seemingly ended up with case law that represented communication to mean from person to person. Thus, sending text messages and participating in phone calls.
      Fortunately the new law is much plainer, but has created a new problem all of its own. You can use your device if it is in a cradle, even by touch, providing it is not distracting. It is amazing how many drivers think that reading and writing text messages or emails on a cradled device isn't distracting...

    Doing that can be worse than using your phone when constantly moving because he had no idea what was going on around him. He didn't even look up when pulling off and a child could have stepped out in front of him while he was stationary and he would have ran them over

      TBF the Met did fine by this - it's the result of a poorly defined mobile phone law from 2002. The phone laws have since been updated and nowadays this would be an easy phone driving prosecution.

    What amazes me isn't the uber drivers on the phone but the black taxi's. Perhaps I'm naive but somehow you expect better from a black cab. Caught two black cabs within 2 hours both using a hand-held phone. Both had passengers in the back as well which makes it particularly egregious.

    Appalling driving, especially with a (paying?) pregnant passenger. At least three time he pulled away with no hands on the wheel and totally engrossed in his phone. Hope they throw the book at him!

      Just be aware that evidence from safety studies demonstrates that answering a phone call hands free (whether a Bluetooth earpiece or in car system) causes worse reactions from a driver than being in excess of the drink drive limit.
      I cannot urge people strongly enough, if you are in a vehicle and the driver receives a call, ask them not to take it. Hands free options may be legal, but they are still ridiculously dangerous.

      Masks aren't worn to protect yourself. If his passenger had sneezed, the airborne droplets can get into his eyes directly or via his own skin if he rubs his eyes. If he sneezed, the mask would contain the droplets. Masks help other people.

    I'm greatful for my partner as when he is driving me and our daughter he even tells us as passengers and one of us in even in the back seat not to be on our phones as its a distraction to him aswell, its normal now for us all not to be on any of our phones while we r in the car and tbh its less stressful and our attention is on each other and having fun together playing games like I SPY

    also at 2:15 the pregnant passenger only started putting on seatbelt , should'nt the driver be responsible for ensuring all passengers wear seatbelts before driving away, not sure if theres a different law regarding pregnant passengers but im sure its the same law for everyone to wear one, and another thing is how can he not get done for having handheld device (phone) while driving just because there was no interactive comunication, isnt what he was doing the same as driving while texting

      It's only the driver's responsibility for any passengers under 14. Otherwise, it's the passenger's responsibility, and the passenger who may get fined.
      Pregnant ladies must still wear a belt, unless they have a medical exemption from a doctor.

      Surely if you do anything other than look at the screen, i.e. scroll, enter any data or respond to a prompt etc that is "interactive" because you are interacting with whatever is appearing on the screen?
      I expect some smart-arsed lawyer has argued this in court so a precedent which contradicts common sense has been set😡

At first I thought it might be something where he gets money from people clicking on a link so was clicking on it himself many hundreds of times throughout the day.     Im sure TFL licencing ensure that drivers have a good knowledge of the English test, that driver didnt have a call what you was talking about. He is gonna have a hard time communicating in English in court. You will be getting 3 penalty points ....... Ya ya , clear, clear, look look

    I get this is not right to do but, I don't understand why people like this guy he just causes problems for no reason. This is like calling the police for someone jaywalking

      Stationary phone drivers are still dangerous for many reasons:
      1) Should a child or shorter person cross in front of them they wouldn't even see them, and would likely then move off, running them over. Notice how WFN364 (google for videos) drives forwards whilst looking at his phone? This is common behaviour from phone drivers. Here's an example someone else caught where the driver almost takes out a pedestrian at a crossing:

      2) They are entirely unaware of filtering cyclists and motorcyclists. These drivers are often slow to react when the queue starts moving, and then when someone behind them beeps they drop the phone and hastily move off without even looking.
      3) If you imagine these people only use their phones when queuing at the traffic lights, that's terribly naïve. The gardener in LM63BTZ was on the phone whilst driving along, and quite likely had been doing it for some considerable part of his journey. These phone users are constantly using their phones, but it's just much easier to catch them when they're in the queue.
      4) Phone distraction lasts for a good time after you put the phone away. Even if you're only using the phone in each traffic queue at each junction (which is highly unlikely), then you're constantly topping up your mental distraction and are basically as disabled as a drunk driver.
      5) Phone driving is worse than drink driving for distraction rates, and that's why it's part of the #Fatal4 behaviours that police target heavily.
      6) Here's a police officer telling you that he has been on the scene for 3 fatal RTCs involving drivers who were stationary whilst using their phones, and then moved off and caused a collision: twitter.com/markandcharlie/status/1604073330751197184?s=20&t=uj8sgu7spu4cTyDqqqds2g
      7) People who knowingly break minor driving law will likely also break more serious laws. Strong policing of minor traffic offences has a strong effect on reducing collisions resulting in killed and seriously injured people. It's good to police these phone drivers.
      I'm really not interested in this nonsense of "it's not dangerous when stationary, because it clearly is and it's clearly still very appropriate to catch these drivers.
