MP Sylvia Lim on the handling of the Mr Iswaran’s corruption case

  • MP Sylvia Lim asked subsequent questions to seek clarification on the handling of the Mr Iswaran’s case, which she said raised more questions than it answered. She argued that the public could well conclude that the corruption case against the former Minister was weak due to the reduction of charges under the Prevention of Corruption Act to charges under S165 of the Penal Code. She also highlighted that the lack of an open trial in favour of a plea bargain had given rise to a lot of speculation in the public sphere as to what precisely happened on the facts and also between the AGC and the defense. Residents had also expressed to her their doubts about whether the public prosecutor had defended the public interest adequately since the sentence was double what the prosecution had sought. Minister Chan Chun Sing later said that a charge under Section 165 was a corruption charge which Sylvia disagreed with, stating that corruption was not required for Section 165.

      The explaination from CCS should be better than this. Pay him millions and yet he did not improve his English after all these yrs.
      The simple reason was, to prove without any reasonable doubt based on the corruption charge, the onus is for the prosecution to prove that was a favor rendered in return for the gifts Iswaran took.
      They check the F1 side and the Lum Pah..err..i mean Lum Chang side and there was nothing that can be used as concrete evidence as such.
      So conviction under this corruption act will not be 100%.
      So rather than PP lose face, gov lose face and integrity rep, they would rather proceed with a charge under 165 to secure a 100% chance of conviction!
      Tio boh ah Chan?😆😆😆

    MP Sylvia Lim didn't ask the question for herself per se but on behalf of the people of Singapore, most who are not lawyers.
    And yes, she as a lawyer would know but the rest of Singaporeans are not all lawyers hence she asked.

    My view is that the matter has been handled lightly against the written Prevention of Corruption Act thus reducing the maximum sentence possible from $100,000 or to imprisonment for a term not exceeding 7 years or to both to a sentence of only 12 months which I think is a very lenient punishment for a High Level "Cabinet" Minister.

      You can tell there is no thoroughness in the investigation and constant reduction of charges better than Great Singapore Sale which has also been scrapped several years ago when Singaporeans finally realised it was to clear lousy stock time.

    He said at the end that there does not need to be a quid pro quo, just the fact that public servant received the items. Was there no hard proof that iswaran received the items? If no, than why charge his under 165?
    Current government and their ministries are showing their incompetence with these fuck ups

      Ask the so-called "clean" governments what did govt employees do to Sarah Sophia (9-12) years old, for 3 years, taken away against her will just because allegedly she has suicidal thoughts (at age 9!) which she herself denies, no transparency, they even willing to commit absolute clearcut perjury, not to mention clearcut abduction (no warrant, no court order, no documents shown at that stage), which obviously traumatised her as she was happy at home or with family prior to separation...it is okay it seems for govt to commit terrorism...? Nothing...no transparency...instead they hit below the belt and throw sand in the eyes when the innocent has fallen, they even tried to brainwash her as if home, parents etc not good for her, which prompted her to plead to her father to promise to her to come rescue her (which was recorded and witnessed) ...the need to always be right even when they are wrong has become cancerous in govts... they even willing to sacrifice a child's happiness and an innocent father as scapegoat, there were no incidents, no violence, nothing untowards between family members, between father and daughter (proven in court) yet the narcissistic "public servants" still dont want to relinquish control because they fear that the child will let out the secrets as to what happened to her during the imposed separation behind our backs. When we let unenlightened non-spiritual beings to be leaders what we get is to the detriment of the vulnerable, the meek and the innocent...but Karma will come round to haunt incessantly just as they unnecessarily give nightmares to families they choose to bully with govt unlimited resources, power and even using the child as leverage and bargaining tool, that is sick! No amount of propaganda can hide the pain of sufferers, the glaring truths, as you can only lie some of the time...but you can't lie all of the time to all people....

      I am not a lawyer but my two cents are that
      Section 165 speaks to obtaining valuables as a public servant. Meaning, once the guy take any valuables above $50 from a partner he is working with, OBS and others, without declaring and returning or paying for it, that is guilty of Section 165 already.
      PCA is essentially a "you scratch my back, I scratch yours" kind of situation. Where the public servant explicitly provided benefits to the other person as a result of receiving the gift under section 165.

      @@ghcheong I thought Chapter 241 of the Prevention of Corruption Act Stated it very clearly that As long as you are a government officer and that gratification [Gift as defined in clause 2] has been received then gratification shall be deemed to have been paid or given and received corruptly as an inducement or reward as hereinbefore mentioned unless the contrary is proved. [The burden of proof]
      The Whole of Clause 8 is copied below for clarity;
      8. Where in any proceedings against a person for an offence under section 5 or 6, it is proved that any gratification has been paid or given to or received by a person in the employment of the Government or any department thereof or of a public body by or from a person or agent of a person who has or seeks to have any dealing with the Government or any department thereof or any public body, that gratification shall be deemed to have been paid or given and received corruptly as an inducement or reward as hereinbefore mentioned unless the contrary is proved.

    I kinda know what he meant lah. He could be saying that S165 still contains the elements and nature of corruption therefore broadly speaking it is still a 'corruption charge', in that sense, but not formally a Corruption Charge according to the term under the PCA.
    Ah Sing is not a lawyer lah, let just forgive him for not being precise in his expression.

    In the end, it’s all about plea deal. Under PCA,the prosecutors need to prove quid pro quo n depending on the sections being charged under the jail sentence could be 5-7 years, under 165,it doesn’t n lesser jail term. both r corruption charges. It’s over, futile attempts by Sylvia Lim in parliament.

    Iswaran's case was uncovered by PAP. Pritam's case was also uncovered by PAP. It's so obvious that PAP is the only responsible and self-accountable party in s'pore. WP has a lot to learn from PAP.

      Wrong. Iswaran was uncovered by evidence tendered by an English trial against Bernie ecclestone for corruption. It was from there that there was an anonymous tip off to CPIB. Otherwise it would have been hushed for ever😂😂😂😂😂
