    EPISODE 92
After the snowstorm last week, we start this video with Tally Ho full of snow! But it quickly melts and we get back to the business of cutting and hanging planks. I make some blocks to go between the sheer strake and the beam shelf in the bow, and then pattern and make the sheer strake (the very top plank) from Angelique.
I also receive a large and worrying envelope from the Clallam County (our local county council) ORDERING me to stop making videos and receiving donations online! Can they do this?! Will I keep making videos? Will the boat get finished? I tell the WHOLE story.

Wow, I’ve been blown away by the amazing outpouring of support and offers of help - thank you so much!
Almost everyone has given sensible advice and good wishes, but I just want to make a couple of important points.
I know some people are angry on my behalf, but I want to make it clear that I am not angry towards either the county or the neighbour that complained. They have their side of the story and I do not believe there is a “bad guy” here - just an unfortunate situation. I can empathise with all parties involved.
If you want to show your support this project in any way, PLEASE do so with calmness, positivity and politeness. Anger or aggression will only make this more difficult for everyone. I’m confident that I can find a solution which will be good for the project and good for everyone involved in this dispute.
I’ve been getting some good legal advice and I think I might have a few options becoming available. Like I said in the video, there will be a way forward!

Leo, just a thought... If people donate via Patreon on a per video basis then the other side could argue that you are selling something (videos) and therefore are conducting a business, however if you restrict Patreon to one-off donations (if possible) then it would be easier to argue that that is simply charitable giving and that consequently there is no obligation on you to provide anything in return, and that therefore you cannot be construed as operating a business?? But then again, maybe that line would hurt your income. I dunno? Either way, best of luck from Nottingham from an ex-Jolie Brise sailor.

Do what you find hardest, politics. People who are friends with the planning board will likely contact you. Take up their offers so that you can meet the officials involved in a setting other than the board meeting. You can be very charming. It's not cheating. Let people friendly towards your project put friendly pressure on the planning board. An insider who asks people inside how to give us all a happy ending can change the currents.

Get a lawyer, the main job of any lawyer, is to gum the works up and create delay. The delay is your friend, allowing you to finish the boat to a point where it's moveable. I'm amazed you've gotten away all this time, it's staggering, but time to get professional help. Separately, you should start a 501c non-profit here in the US and label it educational to revive and encourage the arcane arts of wooden boat building, all your patreon should go there... hard to argue you are a commercial venture if you are a registered non-profit. I commend you for your neighborly endeavors, but as in most things, there's always someone who isn't happy.

So apply for the permit (yeah it costs, but it costs less than a week's fines), if they deny it appeal and reapply.
With a decent lawyer, you can drag this process out months while the team makes progress on the boat.

I went through the same battle you are going through when I restored my 7 ton vessel Oneida II in Kearney Ontario Canada. A small town of only 800 people. This is a battle that ended up going to the Supreme Court of Ontario. It was an unwanted battle that cut into my work, my mental health and my savings. I did not have outside support in the mid 80's. It was all just my wallet. The end battle was me facing a Municipal Lawyer in Supreme Court where I had never been. Amazingly I won my battle. The town was rather chagrined that they had lost to the Mohawk Indian from the part of town that was known as Slab Town. My advice to you is Never Back Down.

Structural engineer here. Firstly I think you should try to go through the building permit process and negotiate the date of the removal of the boat. You've gotten the hard part done and that's getting engineers to sign off on the structure (it's something I've admitidly thought would come up). The building has been signed off by an architect and structural engineer, then their sign and seal should take design responsibility of the structure. Code violations on the old (existing part) of the building are under no obligation to be upgraded per IEBC unless there was a fundamental change in use for the structure. The code officials looking for code violations need to explicitly denote those code violations. The design officials should have an opportunity to contest those code violations. Feel free to reach out if you have further questions. I'm not licensed in WA, but I have colleagues who are.
    Best of luck!

The issue is not a permitting one. It is a zoning issue and they are requiring a variance to do commercial business on residentially zoned property. They are already indicating they are not inclined to grant one as there is at least one neighbor who does not approve.

    • @svechappe6075
      @svechappe6075 3 ปีที่แล้ว +116

Agree, having dealt with a lot of zoning issues over my professional life, I think your best course will be to negotiate essentially a "consent agreement" with the County whereby you agree to a timeline for getting the boat moved off the property. Hopefully you can show them that you need to accomplish a reasonable amount of further construction to get the boat to the point where it can be safely moved, even if that's 3-6 months from now. Otherwise you could subject yourself to accumulating fines that could become liens against the property. Line up your friendly neighbors to express support your continued operation until you can move the boat, which should outweigh the one neighbor that is against the project. Best of luck.

After seeing how 'professionally' they handle one neighbor complaining, when all the other surrounding neighbors are singing from a different hymnal, maybe some location down the coast would better suit my needs. If one crackpot can so commandeer the organs of local government and cause county officials in a coastal area to give a one-boat historical preservation project this kind of grief, then I can't imagine any sort of enterprise or development that they would be competent to support.

As an architectural historian, I'd like to offer a suggestion from a different angle. I would contact the State Historic Preservation Office (SHPO) and see if they can't offer help or suggestions on how to navigate this issue. Even though the Tally Ho isn't native to the state, it's still an historic restoration project occurring in the state and I cannot imagine they wouldn't have an interest in this project. I don't know how the WA SHPO is structured, but at the least they have someone who oversees tax credit projects and that person may be able to offer insight into how to work with this particular county. If anything, it can't hurt to inform the state agency that exists to protect and preserve the cultural and historic resources of the state who you are and what you're doing. I'm sorry you're having to deal with all this. My husband and I have thoroughly enjoyed your videos over the years, and I particularly appreciate what you are doing to restore a piece of history.

I know someone who had bought an lot next to his property to have it as a field in NJ. Someone got annoyed and the township started to harass him. After receiving a citation for the grass being 3/8" over max (5 or 6:) he dug in and found out there was some rare insect on the property. He registered the lot as a federal wildlife land for the protection and preservation of said insect and let it go to field.
The next time the township came he sent them to the federal office...

I'd be curious to know if whoever is driving these legal threats from the county is somehow related to the neighbor who is complaining. From the look of the stuff in that packet, it looks like someone grasping at straws when they say it's an industrial operation. The boat isn't a commercial product and is not for sale, you are selling video content and that is what the people are paying you for. And for that, your equipment is only your camera and your computer, which is hardly industrial.
I mean, if you were a guy who was building a fancy deck on his house, recording the videos and monetizing them on youtube and patreon, do you think the county would come after you the same way? What about if you were working on your car in your driveway and doing the same thing? Or building a birdhouse? It's an insane precedent to set.

I have follow this project from the beginning and never commented before but on this subject I feel your pain and have a lot of first hand experience. I spent 20 years working on the SS Toroa including 5 years as the project manager and 10 years fighting the local Councils that were trying to have her scrapped. We learned a lot about just how these bureaucracies work and there are a few simple rules.
All communications in writing only and demand it of them.
Demand receipts for any documents lodged with them.
Never go to a meeting alone and demand that minutes are recorded with a copy forwarded to you.
Talk to your local community and tell them what is happening. Ask for their support and ask them to attend the hearing if they can.
There is nothing like filling the chamber with supporters at a public hearing to blow the opposition out of the water.
Invite the local elected councilors to a private viewing of your project and roll out the red carpet. Their support will go a long way to help you and right now it is a safe bet that they know nothing about this you are dealing with the paid council officials who dont have to worry about the voters.
Make sure that the local press also get invited to that viewing and the councilors know that they are going to be there.
Make sure that all the councilors have copies of all the demands made by the council and your work done to comply in advance of the viewing, remember they likely know nothing about what is going on. Send this to the press as well but dont ambush the councilors.
You have a lot of work to get through before the hearing so start by requesting a deferment of the hearing on the basis that you dont have enough time to prepare for the hearing. Ask for 3 months delay, you may get a month.
Take the request in by hand and demand a receipt for it.
It is very unusual for them not to grant the postponement but if they do take the refusal to the press, they love an underdog story.
Other things that will help are to invite the community to an exclusive open day and make sure that the complainant is invited as well in writing. His non attendance will help you at any hearing and there is a very good chance that he will not come. If he does come treat him like royalty and try to sit him down for a discussion, it can be amazing what that can achieve.
Finally ask your on line followers for their help. An avalanche of supporting emails from all over the world to the elected officials will make them sit up and take note.
    What do we need?
The emails and names of said elected officials.
An outline of the problems you need addressed and maybe a proforma letter.
A plea for no stupid stuff, the last thing you need is some clown sending a death threat.
If I can help from down under please ask

Maybe everything is not too bad, you have a lot of publicity. Otherwise, you must move the boat as quickly as possible. If that causes problems in the vicinity, you can also search for a remote solution. Tally Ho will be relocatable soon. @@farmingfromscratch that is a possibility. But my point is more generally that a court can deal with an unfriendly county zoning office by telling it it’s wrong. An appellate court can too if necessary. I’m not familiar with zoning laws in Leo’s area, but it’s curious that the county seems to be putting so much significance on the fact that there’s a Patreon account to prove his actions amount to an industry. Imagine a person posting videos of their baking projects. Perfectly legal. If they later start a Patreon account for the same activity does that transform their work into a possibly prohibited home business? Maybe, but probably not based only on the existence of the Patreon account. Wouldn’t the county want to know whether the baker was selling cakes to customers, advertising, etc? If I understand the county’s correspondence (no guarantee) it seems his activities are permissible EXCEPT FOR his Patreon account. My take away is whether a Patreon account is the determinative factor is likely a matter of legal interpretation, and that’s where appellate courts reign. If you can afford to get your case to an appellate court. And if the law allows for a colorable argument.

I haven’t been a Patreon supporter to date, but my financial situation has improved recently, so I plan to support going forward. It sounds like Leo can still accept financial support through Patreon for a period of time. My idea is to have all the Patreon supporters (myself included) pay Leo all (or as much as they can afford) of the Patreon support they expect to pay over the next year (or whatever period of time Leo believes is required to get the boat ready to move) before he is required to stop accepting Patreon support. We can even contribute more in a lump sum than we’d have paid in installments, if we can afford it. That will give him the funding he will need for the period required without having to continue to accept Patreon support for a period of time, thus allowing him to both comply with county requirements and have the funding and support he needs until he can restart his Patreon account. What do all you Patron supporters think of this idea?

I've just sent this to Councillor Dennis Smith on Sequim Council
    Dear Dennis,
I’m writing to you, as a Sequim councillor, from London, England, and as an ordinary member of the public with a passing interest in sailing. I could equally easily have been writing to you from Los Angeles, Glasgow, Cape Cod, Paris, Munich, Beijing, Dakkar, Buenos Aires, New York, Tokyo and just about anywhere else in the world, because, I am, like hundreds of thousands of others, worldwide, an online follower and supporter of the Tally Ho! project currently unfolding in Sequim.
This project could not be more deserving of Sequim Council support. This project has created apprenticeships for traditional craft boat builders, and bought trade, employment and commerce to the town, even in these difficult times. It has revitalised a wooden boat building industry that is on the verge of being lost forever. It has put Sequim on the map internationally, in Europe, Asia, Australia, the Far East and the Americas, as a destination of choice, and I absolutely guarantee that ten thousand people will appear in Sequim on the day that Tally Ho! is launched into the Pacific, and hundreds of thousands of us are now fully appraised of the wonderful landscape in the region and the generosity and hospitality of the residents, as a result of Leo’s boat building and project management skills, enterprise, initiative and hard work.
However it now seems that Sequim is about to become a worldwide laughing stock for all the wrong reasons. I was utterly mortified to discover that Sequim Council is doing its utmost to bring the Tally Ho! project to a halt when it should be doing everything in its power to assist. I won’t even begin to describe the bureaucratic mummification which the Council has wrapped around the project, including multiple layers of alleged zoning and coding violations, with threats of attendant fines that will break the project, if not withdrawn, other than to say that it seems to have been going on for months, although Leo Goulden, the project creator, never said a word, until now, when, its seems, the council, acting on the whim of a single complainant, about something or other - who knows? - is about to deliver the coup de grace to the project.
I understand there is a council meeting coming up shortly when the final decision will be taken, on whether to halt the project, or allow it to proceed. There is nothing that I, along with hundreds of thousands of others, worldwide, can say or do to compel you to support this project, but the one thing I can invite you to do is have regard for your own mission statement, particularly the regard to the references to integrity, positive attitude and leadership, which, in what I understand is the Sequim Year of Kindness, I am attaching below.
    Very best wishes,
    Danny Israel.
