I was having an argument once with a vegan who was a jerk, and they said something like “you have a cat? What if someone decided to eat your cat?” (This was on Instagram so they could see pictures of the cat) and I did get mad at them for that idea, but i just mentioned that yeah, some people probably eat cats, but mine is a pet and I wouldn’t force someone who keeps a cow or something as a pet, to eat their pet

To claim the "art" they'd have to take each creator, individually, to court.

A quick search shows me that they are trying to do just that. That wording is from the "legal" page on the pokemon website, not the ToS of some game or site, so it's 100% unenforceable.
In a fair use context this would be unenforceable, but the majority of fan art would not qualify as fair use. For the most part this is just reiterating the way that copyright law typically works, so it’s not really something you have to agree to. It looks like it’s mainly a statement that they intend to litigiously protect their IP, which I think is normally a requirement to maintain copyright status.
@@lawrencebates8172 Almost all fan art is fair use. Some fan art might be _trademark_ infringement, but very little is _copyright_ infringement. One of the criteria for copyright infringement is market usurpation and another is the amount of the work being copied. A still image is not usurping the market, and would be a tiny fraction of a work copied of a movie, show, or game.
There can be and have been cases of people successfully suing for having their fan art copied. They couldn't do that if the copyright to their art was owned by someone else.

My understanding is that interpretation of fair use usually ends up coming down to the whims of a judge, at least if there's any sort of profit involved and it's not clearly transformative (parody, for example), so I think there are a number of cases with outcomes in either direction. And regarding quantity, I always thought it was about how much of the derivative work comes from the original, not how much of the original is used, otherwise short of repackaging an entire film or book it would be almost impossible to infringe on copyright!

The profit thing is a common misconception. That's a very minor factor and not technically a factor at all in case law. A judge might take it into account when determining damages, but not whether or not something is infringement at all.
The Four Factors are: Transformation: Is the derivative work transformative, as in does it make significant changes to the original? Market usurpation: Does the derivative work make it less likely people will buy the original? Amount used: Is a significant amount of the original work being copied? And nature: is the derivative work copying the _execution_ of the original, or is it just repeating ideas or facts from it?
What that means is that, yes, you basically have to _copy_ some of the work to infringe on copyright. Fan art does not do that.
Trademark is different. Trademark infringement means you made and are distributing something that people might reasonably believe was made by the owner of the trademark. The key factors for that are the degree of similarity with the trademarked item and whether the two parties' products are sufficiently related that consumers are likely to mistakenly assume that they come from a common source. Fan art rarely infringes on this because it's almost always clearly labeled as fan art.

To be fair, AI is being used to help solve a LOT of problems... I get where it's sketchy with artists, actors, and music -- but they have such advanced AI now, that it can scan eyeballs and figure out who has Parkinson's disease seven years before the disease starts to affect someone.
While we do need regulation to protect humans from AI stealing art and likeness, the good stuff it is used for far outweighs the bad (for now). I guess just give humanity like... five more years with it, and we'll manage to fk it up somehow...

2:30 Basically, the part that we can see in the screenshot just says that any fanart is, technically, PCII's property, as it is their characters used in it, which is some basic legal stuff. Not really enforceable unless someone were to claim they created the character, which would be copyright infringement anyway, so not many content creators, even just for video games, would add that to their legal page, or the contract someone signs by playing the game. So, as such, Pokemon p*** is technically owned by PCII, but any of the p*** creators won't try to claim they created the character, just the name the character has, so it doesn't need to be enforceable.
