If a cop pulls you over and smells booze and you seem a little drunk, they'll test you. If you're under ..08 but fail the tests, you'll catch the charge. If you sepnd $2,500.00 on a DWI lawyer it will get pled down or deferred. Hungover from being plastered the night before doesn't mean her BAC somehow stays elevated and her body suddenly stops metabolizing liquids - that's not how hangovers work. If she still drunk she's still drunk, and the fact that it's the next day doesn't magically mean a .07 BAC (.066 rounded up) doesn't come with judgment issues.
