If a cop pulls you over and smells booze and you seem a little drunk, they'll test you. If you're under ..08 but fail the tests, you'll catch the charge. If you sepnd $2,500.00 on a DWI lawyer it will get pled down or deferred. Hungover from being plastered the night before doesn't mean her BAC somehow stays elevated and her body suddenly stops metabolizing liquids - that's not how hangovers work. If she still drunk she's still drunk, and the fact that it's the next day doesn't magically mean a .07 BAC (.066 rounded up) doesn't come with judgment issues. I wonder if the time will come when every employee is required to take a breathalyzer to see if they are sober or not.
Too intoxicated to drive is a whole different ballgame than public intoxication. I understand the school wanting to dismiss her, but she did not seem too impaired to be in public. Those tests are designed for motor skills required to drive, not for your mental abilities. Unlike the one who was drinking at work, showing up at work after having a drink is completely different.
