    Hello, Thank you for these very informative videos they are so very helpful.
    My question is, what if the company that the injured worker worked for closed down, and all the employees were laid off. Would the injured worker be eligible to receive such voucher if He/she had no job to return to?

      Good question Sandy,
      Usually yes. The process is the same. You have to have some permanent disability. If they are out of business, then they can't offer you a job and you will qualify.
      Most defense attorneys would recommend issuance immediately of the voucher. BUT some might be jerks and make you wait the statutory 60 days.
      Either way, you should be good.

    Need advice i have restriction no more than 5 pounds nothing over my head not standing long or sitting to much
    I sent my lawyer a job listing he wasn’t happy with I guess made upset
    I was journeyman electrician for 30 years.
    Now I got to find something within my restrictions.
    How do I approach this carefully
    I am 61% disability
    Help plz

      Anthony,
      I'm not sure what you are asking. For eligibility of voucher, your employer must offer a position and must be qualified position as stated at timestamp 0:21.
      You can find another job if they don't offer you one and still be eligible for voucher.

    Thank you for your videos.
    I got fired after two years from my injuries on their letter it says that my worker compensation has been expired . Best on my QM airport at that time I was on Temperly permanent disable . It’s been more than one year since of I get fired . My injury date was September 25, 2018 . I saw the QME on December 9, 2021 Based on the report it says that I reached the permanent disability my QME Report came with a vouchers form and Job modified Restrictions . Please let me know what I have to do. Do I have to file a lawsuit against The company?
    I still have not receive any form for the vouchers I just received QME yesterday permanent disability .

      What was the reason your employer gave for your termination?

    I received my voucher but im having a really hard time finding the class i want. The edd site is really confusing. Im trying to use the SJDB to find an online class that will help me obtain a Comptia A+ certification in the IT field. Is there someone or someplace I can visit to get help with this? I'd like to be able to get help in person rather than doing it over the phone if possible.

    Question. My employer couldn't offer me work in my department whole adhering to the work restrictions. I was told that they were trying to find something else for me to do, however, I just received my SJDB voucher from WC adjuster. If they were still looking to place me, why would I get the voucher? Wouldn't I only be sent the voucher if I wasn't going to be placed somewhere at my current employer? Also, now that I have the voucher, I can apply for the RTW benefit from the state, correct? Thank you!

      Thank you for your question Nica.
      Yes you can apply for the RTWSP now. The insurance company owes you the voucher if they have not provided the offer of work form within 60 days of receipt of your permanent restrictions. That's the insurance co. It is possible your employer will find you something later, but certainly now guaranteed.

    My lawyer said I'd get this voucher as part of my settlement. Is that possible since I won't be permanent and stationary?

      It's up to your employee to offer you one. If they don't within the time frame, then you are eligible assuming you otherwise qualify as shown in the video.

      @@GonzalezLawEmpower thanks for the response unfortunately the company I worked for closed I was given a16% permanent push pull lift 25lbs personally don’t know how sure he came up with that # I’ve never had any physical test done only mri ultrasound nerve test insurance has sent me a letter talking b responsibilities for my shoulder and arm but not my elbow or wrist there is more damage that is being looked over is there something I can do thank you very much

      @@jpginhb Then you should demand your voucher. They can't offer you a position if they are out of business.
      As for the report, you can ask your attorney to object and send an interrogatory or maybe a re- evaluation if it's been some time and you have worsened.

    My employer sent me this notice but they are offering me the same job I had. However I’m not physically cleared to return to work by my treating dr am I supposed to sign it still?

      Good afternoon Robert,
      Thank you for your question. The offer is probably based on the QME final report and restrictions. Does the job offer fall within the restrictions given by the QME? If it does not, ask your attorney to request a vocational evaluation assessment to verify the position is within your restrictions. If it is within your restrictions, see if you can disqualify the position in another way e.g. too far away or temporary.
      If you decline the offer and it is not a disqualified offer, then you will not be able to get the SJDB voucher.

      @@robertjimenez8185 Treatment and work status are not related. Ie you can have lots of restrictions but no more treatment left or you can have loot of treatments on your plan but working full duty

      Yes, but be careful. It might be you didn't need a computer but some other equipment instead. Like a camera for a photography class

      LV, they are different. You get up to 6k for school AND 5k from California.
      A vocational counselor can help you with the process. If you want a referral, text "your name voc referral " to 909-266-0003.

    Hello, i have a question, Im permanent stationary disable i did get my return to work vaucher and im doing school , I have cervical spinal stenosis wich workmenscomp they did denied the surgery but due to my impairment im having hard time to focus because my headaches and neck injury im getting so stress out and depress at the same time cause cant focus whats gonna happens if i quit doing school please help. thanks

      I am not sure what your question is. You can put off using the voucher for two years after issuance if you can't focus right now.
      If you settled for Stipulation then you might want to consider petitioning to reopen your case if your symptoms are worse.
