    Hello, I am a subject to the home residency rule and I am an F-1 student married to a US citizen and currently studying a bachelors degree. I am planning to pursue an OPT and after that a MS degree in a STEMM field. My question is can I apply for a waiver and be enrolled as a student and stay here in the USA while my paperwork is being processed by USCIS or do I have to leave the country and wait for the approval from my home country?

    I have a A10 card based a asylum, I took a J1 visa to enter USA. My spouse is a us citizen and have severe depression issue, we will have our child in November 2023. Is it possible that I can apply for j1 waiver through hardship ? My home country doesn’t accept my no obligation waiver because of my current A10. Thanks

    Applied for Hardship waiver in March 2021 and it’s still in process, I am just wondering how long it will take to hear from USCIS.

      Hi Jagdesh. I would allow for 16.5 months or longer for processing of your application if it is a j1 waiver if it is a I601a allow for 2 years or longer depending upon service center.
