  • If you did not include your child or spouse (married or common law) in your own initial PR application, in most cases, you could be barred from sponsoring your child or spouse to Canada (section 117 (9) (d) of the IRPA). These are complex and difficult cases of exclusion and misrepresentation. At the same time, depending of the situation, you might also yourself get investigated. If the exclusion was done primarily to gain a benefit under the immigration law, then the exclusion is very strong. If on the other hand, if you made an honest mistake which might be defensible depending on the compelling circumstances, then you might want to consult with a legal representative to consider a sponsorship application under humanitarian and compassionate grounds (H&C).

    Watching this video takes me back to a devastating moment in my life. I had a similar problem to scenario 1 with the father not declaring child. My application was refused under this regulation when I was a child and completely separated my family 1 day before my birthday 😞. I pretty much had to live with a guardian until I was 18 while my younger sister went to live with our father in Canada. Now a decade later my father is older and unfortunately my sister health decline, they want me to come and help the family. Is there anything I could do? I have no criminal record or health conditions? Temporary visa route is close.

I told my officers to ask if they can help me the one-year window opportunity program to reunite my brothers and sisters. I filled in my permanent residence applications especially section additional family members please help me if you have any experience about my issue. Thanks

    My spouse did include my first daughter's name when applying for study permit would this affect my express entry application as i want to include both kids

    May I ask, I applied for student visa without declaring that I have a common law partner and we have a child on the application. Does it affect my application for Permanent residency in the future?

    I wasnt declared as my partners common law when he got his pr.. the consultancy agency we had said he can marry me after he landed in canada for him to sponsor me.. now that i found out about this misrepresentation all my hopes for a complete family are shattered.. i am so broken hearted and i dont know where to start... 🥺🥺🥺🥺😢

      Yes, in the Family Information Form, you need to disclose members of your family as requested.

      If the child was legally adopted yes that is misrep and also the child will be excluded from future sponsorship.

    I charge mispresentation in the US when I want to visit my husband. Is it allowed for us we can meet in Canada for couple of months.? If i applyfor canada tourist visa can I tell my reason is tourist and meet my husband in Canada or its red flag?

      You can always apply for a visitor visa - the issuance of the visa will depend on many other factors as well such as your ties to your home country, financial, purpose of visit etc.

      Thank you for your inquiry. It depends on the type of PR application. If the child is included as a dependent, IRCC will likely request biometrics and a medical examination. Can you please offer more specifics about the nature of your question?

      @@keyorkimmigrationlaw The child was included in the PR application of his mother, the mother lives in canada while the child is in Nigeria. The child has been told to do medicals and submit Police clearance forms.
      But when the mother got her COPR, the child’s name appeared under “non-accompanying “
      So what is the next step? Does the mother have to sponsor the child again?

      Hi Samer, this means that you most likely asked an update on your application and its within the processing time so your file is processing and you do not need to do anything, just wait.

      Thanks for your respond ، my case family sponsor type , had been submitted on February 2018 , and at this time my case in processing , in Brazil , i have asked for updated my residence on February , is this updated cause of delay in the decision , how much is delaying ,Knowing that I have a baby boy He is born in Canada and I have not seen him yet and all the information they have .

      SAMER ABDOU it is very normal for applications to be processed longer than 1 year, you will probably get a decision soon but it might be a few more months. This is simply due to backlogs. If you do not received a decision within 2 years, then perhaps you could look into setting a very firm email to the embassy with a request to expedite.
