Can I Petition for Undisclosed Child?

Erica wants to know whether her husband can sponsor a child that he did not list on his prior immigration forms for an immigrant visa. This is a frequent occurrence at USCIS and causes big problems. Jim discusses in today’s video.

Jim. I had a I-601a case where this man's daughter was not on the birth cerificate. He got officials in Jamaica to amend her birth certificate to list her on the record. DNA test was requested by USCIS and provided. The I601 a waiver was approved. The daughter went back to Jamaica and was approved after a consular interview. The daughter lived in US since she was 12 and was 36 at the time. She was tired of living a outside the law. She had completed two years of community college but stopped because she couldn't work legally. She has since returned to school and has become an RN.

Suppose the child was born after he left the country. He had been gone a few years and his mom is approached by someone saying she has her granddaughter. He has not met the child in person ever. It’s very suspicious that the woman would wait years to even tell him he had a child so naturally there were doubts. And why would he claim this child at this point? Anyway, I believe we have a good reason for this. And I have an appt with your intake dept tomorrow. I will remain hopefully. Thanks for doing this video.

My friend has exact same situation. He never included his children in all of his applications, got his citizenship and applied for petition for his undisclosed children (4 of them). UCSIS approved all of his cases as well as the NVC, now is he going to have a problem at the embassy during the visa interview?
