      This judge is an idiot, her husband grabs land of other people, murdered other people and judge is worried about human roghts of wofe whom police has enough prove to assume she is involved in disposing murder weapon. Spouses of history charge sheeter knows about their partner and here criminal was absconding law. When something more worse will happen public and this idiot judge will blame police when they will fail to arrest him since he is ordering them to wait for 2 hours outside a murderer's house till day starts to interrogate wife.

      At north east & in the summer the Sun rises before 5 AM.
      The IPS officer was doing a great job, these are hard core criminals & the police had to take a decision accordingly. Shame on the Judge.

      the definition of day and night in crpc is linked with sunrise and sunset and not with time of the day like 4 am.
      the state in question is ASSAM a north eastern state.

      But the police can't be blamed blindly either. It has become a custom among criminals to use these rules to hide behind the women in their family. It is abused the most in UP where the wife, mother etc of hardcore criminals threaten to file rape cases against cops who come to arrest the guy.

She would have been arrested at anytime of the day or night and charged with Tampering with evidence, Aiding and abetting, Endangering a minor(by insisting onbringing her child instead of leaving it with her brother!), conspiracy to commit a crime +probably 15 different other minor charges. Policemen are respected for putting themselves in danger in the line of duty...NOT SUSPENDED FOR PERFORMING THEIR BLOODY JOB!

      At ground level there are different circumstances. The judge is talking on the basis of laws and he is right but i think that he is enjoying to punish Policemen becoz officers Not get sleep at whole night to catch the witness and proofs and the judge is talking about 4 and 6 am timing. Some times it's not the law book that works on ground if police started working with exactly word by word of laws then they will have to take all law books with them to work on ground. You are judge and using law books to describe timing .... I'm not appreciating this🙏❌❌❌❌👎👎

If it is not wrong, i do not know why the SP is apologising. If it is not against law, i do not know reason why the judge is questioning their actions 😂

      Yes police got appreciated for their round the clock service.
      Judges can't even solve cases in day time.
      Some exams are pending from year due to court case. They can make injustice to lakhs of aspirants.

      the court is Guwahati high court so judge is very well aware of the sunrise timing himself, still he shamelessly says india has only 1 timezone, crpc does not define sunrise on basis of time zone. Think, in far eastern states both sunrise and sunset occur early. Can a woman be arrested at 5pm in guwahati on the basis that in india gmt it is day, but in actuality it is night at that time in guwahati. so needful cannot benefit from arguements put forth by this arrogant judge. and if both concerns are to be followed then that that would reduce police effective times by 4 hours, 2 hrs in morning and 2 hrs at night..
      judge is just incompetent, arrogant or corrupt or all of the above..

May be the claim in the petition was against the Case Diary. The reason the matter reached to the high court says something was not right.

      There is a joke 3 police of 3 country were participating at a jungle... Given task to bring the deer ... USA police brought in a animal specialist and track it a capture the deer with in 4 hours...... Japanese police set trap for the deer and capture it with in 24 hours..... When Indan police went into the jungle didn't came back for 4 months then all other countries police went to check them out .. they saw Indian police beating a pig and asking it to say I am a deer....
      International community joke about indan police.. wahat a shame.. they should be taught detective work for 3-5 year

You can not bring suspects whenever you like, you must have some hard evidence to support that action. Many policemen and policewomen misuse their power in our country and most of the police department people do not know the proper police law, hence there is a need for people who knows the law correctly and can run the department with utmost efficiency.

      At ground level there are different circumstances. The judge is talking on the basis of laws and he is right but i think that he is enjoying to punish Policemen becoz officers Not get sleep at whole night to catch the witness and proofs and the judge is talking about 4 and 6 am timing. Some times it's not the law book that works on ground if police started working with exactly word by word of laws then they will have to take all law books with them to work on ground.     Few pointers i got from this video :
    1.) The female SP is brilliant, i never seen a lawyer coming up with such defense in this kind of clear cut case of unlawful imprisonment/arrest/investigation of suspect's relative.
    2.) The female SP even came with a point of 'time zones' being different therefore we didn't broke the law.
    3.) To me, and only in my personal opinion. I see this as judicially supported crime :
    The guy is a known criminal, his second wife KNOWS his location and together with her husband in crime, she started using her female privilege to defend and support her husband's crime.
    All the police did was arrested them 2 hours before the lawful arresting time.
    And just for that this Crime supporter judge is threatening the police, which will further encourage criminals to continue their activities.
    Fully support the lady SP.

      There are several cases where women are raped by Police. So there's no trusting any police blindly. The laws and rules are there for protective measures. There are not hundreds but thousands of false cases currently charged.
      If your daughter is suddenly picked up by Police at night, for an investigation, you will then realize the importance of this rule.
      Police shouldn't become the Judge, there is judiciary for that. Often times, police beats up common people, which is against the law, is that even a debate?
      Police needs to follow the rules. There are both good and bad policeman, so giving them freehand is risky for any society.

    The judge is more concerned about the human rights violation of the wife of a murderer. But not concerned about the person who was brutally shot dead by the husband of that woman. If police didn't take quick action within the first few hours than the accd may fled away towards Bangladesh which is not very far away from the place where the incident happened. According to such judges who only understand what is written in the books and know nothing about what is happening in the fields let the accused be escape. Let not the family of the deceased get justice. But the woman should not be brought to the police station at night.
    There are almost 50 million cases pending in indian courts. Let's add one more . There are millions of people who are not getting justice from us, let's add one more .

    Judge seems pretty inclined towards serving the accused than the victim. In some rare instances police have to act cautiously else the accused use this loopholes to evade punishment. This IPS officer needs to be praised for her clarity about the case and holding the facts.

    This single timezone across india is definitely helping the accused. sunrise in gauhati is around 4:30 AM but 4:00 AM in arunachal while in mumbai it is 6:15 AM there is actually a difference of 2.5 hours across india. Definitely we need atleast 3 time zone in india.

    If we had judges like these in Bangladesh hundreds of people wouldn’t be taken by “undercover” police officers and a lot of families would not be shedding tears. Bless this judge whoever he is.       Actually true....when it is proved by three or four evidences that the accused is the one who committed crime..they still find flaws in investigation and try to bail out all accused...these Accused gets out of jail and again commit offence causing harrasment to public.. this goes in cyclic process and finally police stop catching the accused because it is useless to work so hard and end result is null.. other side, the court gets good payment for bail and makes money for the state

      It's tough to be on the ground act, fast but not skip the procedure. That's about it!
      If the police identifies an accused/accomplice, it has every right to make arrest in the middle of the night and interrogate to move fast on the case.
      However, before making an arrest of a female in the night hours there is an additional approval that must be taken which was missed/overlooked by the police in this case. The Indian Jurisdiction rightly gives this right to every women whether accused or not.
      So no ego, it's a lesson for the police who can't break one law for another or dictate priorities.
      Some solutions could be
      1. Police dept. must have frequent debriefing on human rights to act responsibly
      2. There must be additional manpower to support excessive bureaucratic machinary.
      3. Police force must be compensated better to act with motivation and compassion.

    Since there are a lot of opinions in comments, let me set it straight.
    Here, the Judge is arguing baselessly. Indian Law states that a women who is allegedly committed a crime or has information regarding a crime can not be arrested after sunset or before sunrise. But here the women was arrested on 31st. She was brought to the police station at 5 am on 25th and *interrogated* not arrested.
    Secondly, the judge is being biased as no judgement should be taken based on gender or sex.
    Thirdly, Indian Juvenile Law states that no children should be brought to the police station by police, here the mother brought them on her own (so police has no power to prevent her).
    And finally, the criminal in question was a very well known murderer who was at large and committing crimes. Even a single hour would pose a risk of someone else getting murdered by him.
    The police was at right here.

      you were right i can see the difference in the comments which was made by the judge he is not even listening to the police officer statement and the circumstances were different in the field duty and the judge has to know the difficulties before the police. A judge can sit and refere some books and canmake any judgement but the person who is in the field knows the real difficulties and they face at every minute . The ultimate goal and motive of the police is to stop the accused person to move far more from them soo they took his wife to interrogation so that they can stop the accused to move further l dont know my the judge is misleading the case he has to focus on the accused person who had committed the crime instead he is arguing on the complete unnecessary topic and which he is not even listening to the lady officers side. pathetic behaviour by the judge we can see it clearly. and i am just sharing my opnion and not demeaning anyne or person or any institution.
