    Hope I understood the case correctly. Lady requesting HRA to be paid as part of Stipend/Scholarship/Salary( given for pursuing scholars). As far as I know, if any institution gives accommodation, then they are not required to pay HRA. Lady's argument is I do not want to vacate my current residence as I have so much of furniture & other things, so give me HRA component as part of my payment.
    Lady wants to stay in her current residence, declines all forms of hostel accommodation provided by the institute, asks for payment of HRA. Why hostel accommodation is not possible for her, because she already has accommodation outside the institute and does not want to change that. It is looking like she wants institute to pay the rent of her present accommodation, but asking indirectly to pay through HRA.

    This is why you need a counsel. Not following the etiquette is the easiest way to ruin your case. Even with his advanced age and experience, the counsel on the opposing side is keeping silent unless absolutely necessary or asked for his opinion. A judicial court is not a public forum where the one who speaks the loudest and gets the most "applause" wins.

    The judge isn't able to decipher that "When provision of hostel accommodation isn't possible" means that when hostel accommodation isn't there,, its doesn't mean that if the student doesn't want to stay in the hostel. This should have been thrown out the first thing

If someone does this to you in public just because you are inferior than him or superior .Will you be able to accept it ? Judge's need not be respectful towards any . But bullying is no no as they are not killer/hunters/assasins. They can be harsh and being polite at the same time . They can show anger if required as well . but using the words key when it comes on the record as the person is clearly not sentenced as guilty by judge during the trial at the time of his bullying.

    This may be an outlier incident but I have seen and personally even experienced judges having a disdain for ordinary people coming and asking for relief. They behave as if the wearers of the cloth are the custodians of the law and other citizens are lower class beings

    (1) The lady thinks she is entitled to the better accommodation she was given for lack of hostel accommodation. IMHO, she isn't entitled.
    (2) The judge had no business speculating how her PhD was progressing in the absence of any information on this (esp. from her doctoral advisor). Shame on the judge for doing this. His job is not to speculate, but to pronounce judgement based in the facts presented to him.
    (3) I'm not sure if it's judge's job to suggest that the institute where she's doing her PhD be lenient and give her 6 more months of stay at her present accommodation. Assuming the the institute heeds to the judge's advise and allows her to stay at her current address, what after 6 months if she hasn't finished her PhD by then (she's under no obligation to finish her PhD for at least 1 more year, not considering the "my 1 year got wasted" argument she's putting forth)?
    (4) IMHO, it is unbecoming of the judge to snap at her. The lady is used to being in an academic setting, and the judge assuming that she should be well-educated in how to behave in a couurt and how to conduct legal business in the court, is preposterous. She should have been educated politely about how to maintain oneself in court. Also, it appears that she was representing herself in court, instead of getting legal help from an advocate (for whatever reason) -- the judge should have been more considerate of this fact.
    (5) As someone also pointed out, the institute policy that "when hostel accommodation is not possible", is to be interpreted as "when the institute is unable to provide hostel accomodation". So, the lady doesn't have a case to make.
    (6) the lady's argument "I can't shift to the hostel because I have a lot of stuff that I can't keep in a hostel room" is meaningless. Her PhD program doesn't require her to have all that stuff with her. She has to discard them if necessary so that she can shift to the hostel.

      You should visit south India courts, if someone spoke even 20% of what she spoke, her petition would have been thrown out in first 30 seconds, if she spoke for 2-3 times more after asking to stop, contempt of court for sure.
      Courts job is not just to pass judgements based on penal codes, woh tho software be kurlega. Court is made of humans interpretating each case and passing judgements, they r also entitled to pass observations, in recent times alot of SC judges make scathing remarks against governments n politicians, this girl is just a private citizen. 😅

      the problem is the judge instead of being objective starts bringing in sympathy etc. This is what the judges do to tenants in india too. If tenant doesnt vacate the case goes on for 10 years to 20 years. imagine why an owner should go through all of that? if a peon in the court refuses to vacate giving 100 excuses will the court accept and grant 6 months to the peon.

      point number 6 is valid if the phd requires large volume of equipment's in a shared room doesn't do any justice at all .rooms are small . Not all phd's require only thesis . There are few who needs to experiment and prove to the higher up's . The only mistake i see from her is the clarity of what she wants now , Whether she need hostel facility or not ? thats it . But now its a fact that judge treated her really bad when she is representing herself. These guys are not lawyers to behave properly in court . If what she is not fine then its inappropriate judge saying "meh meh meh" to her . Its a bully that none were able to identify this fact.
