      Isn't the filibuster there to prevent a minority from ramming anything it wants through? I'm not sure, but I think folks have been saying ditching the filibuster is far too dangerous a move, that too much is lost for too little gain.

      @@dontpanic1812 That's been my argument since the beginning of this discussion. Right now, ending the filibuster for Dems is a really good idea. They can legislatively pass everything they want. They can make gun control laws, they can strengthen voting rights, etc etc etc. But, if the Republicans win in the next few years, they could then decide they're going to just ban abortion period, remove any sort of gun control law, completely dismantle mail-in voting. I try to listen to news and commentary from both sides of the equation. I understand right now, ending the filibuster would do two things. First of all it would give Democrats the power to do anything they wanted to, and everyone can admit to wanting to give a middle finger to the right. However, when the pendulum swings back, they could just decide to run wild.

      @@alexs4392 then they get to take away what the Democrats did and we'll see how the public responds to their minimal healthcare options being taken away, more tax cuts, and other things they pass. The filibuster is an excuse for both voters and politicians. For politicians no filibuster means we finally get to see whether or not they mean what they say and whether or not they are really willing to go down the paths they tell us and for voters they finally have to be engaged in every election and not just presidential elections and the occasional midterms because a lot will be at stake every two years. It puts the onus on both groups as it should not to mention the filibuster was hardly used for the first 150 years of our union as we averaged one filibuster a year for decades.

    To see how successful that deregulation agenda is, look at us in Texas. Deregulation is one of the reasons I have had heat for only 4-5 of the past 24 hours - in sub-freezing temperatures.

My first order of self imposed therapy is I am going to write to Biden, and share my story, and tie it to a failure of our government.     5/6: McConnell’s argument stressed that Trump should instead be criminally prosecuted, because that’s what his corporate donors wanted to hear him say, but I suspect that if someone actually tries to prosecute Trump, Mitch will oppose it and do everything in his power to block it.

    The thing that grossed me out was after all this, looking at /r/conservitive and also seeing the twitter trends, they don't care that McConnell blames trump, they care that Trump won. "Don't care, got mine." and it's just... so disappointing that these people are this way. Worst part I've seen is many I have talked to casually actually believe in many liberal values but just fight against the tags or they tag things with things they don't understand.

    The constitutional issue Mitch brought up was already decided before arguments began. By bringing that up again he blatantly disregarded the precedent created by the very deliberative body he was a part of at the time. I'm surprised there's absolutely no consequence for him breaking with precedent created literally at the beginning of the very same trial. What he effectively said was 'I don't recognize the vote & precedent created before the trial began.' That was a slap in the face of senate procedure.

      What was necessary to do for the evolution of American democracy has been done. A vote to impeach was supported by two parties and it was shown that this could be done. Calling witnesses wouldn't have changed a thing because McConnell was always going to unilaterally call Decision that the Impeachment was constitutional fake.

For this nation to survive, with our declaration of independence and Article One of the Constitution, we have to get rid once and for all of the myth of American Exceptionalism, Once we have decided we are regular people, we can cure ourselves of racism, capitalism, and militarism. These are all just tasks -albeit mighty concerted efforts - to grow up to real adults and put ourselves in position to create a truly fair government. We have plenty of examples to show us - Germany, Fiinland, Swedon, Denmark, Norway, North Faroes Islands, Icelands, and some aspects of some others. People will say "We can't do all that!" but that's just our immaturity, because other peoples have. Some may not realize how far behind we have slipped.

    Here in Arizona it was Republicans who championed vote by mail, they loved it until 2020 and now suddenly they want to get rid of it. Sinema has been frustrating, she's a very serious legislator, always has been, has to be moderate to win the state but her position is still frustrating because she cares more about bipartisanship than legislating and caring so much about bipartisanship means you care more about patting yourself on the back than taking risks that you might do the right thing.

    It should never be possible to vote in a tyrant of any economic persuasion in a democracy. It is necessary to identify and discuss political science in public school.

      This makes sense - paper trails do help (if,/when... read) also, like Favreau's idea of one witness for each side, to at least offer something additional to the trial. Let's equate the two: Valentine's Day or Impeachment, gee, what's more important? And President's Day, ... half the Senate deserves to be stuck at work in contrived time-out, NO HOLIDAY. Everything was so complicated and toasted, the House Managers needed outside (of the White House) help! ... Third, I would like propose that the Pod Save America Team become DEM advisors, ASAP!

    About the filibuster question: Wouldn't it help already if filibuster reform requires a filibuster to be actually held as a speech on the floor or otherwise bills will automatically be voted on?

But, I am not sure about getting rid of the filibuster. I understand that it could backfire in 2022, if Republicans re-take the Senate or the House. But let's see how long they can go before the first Republican Filibuster.

      I have mixed feelings as well! Removing the filibuster for judges sure backfired on us! It’s all good when we’re in the majority, but could be extremely troubling if we’re in the minority!

    The Trump lawyers “defense” had all the elements you’d expect: lies, ineptitude, whataboutism, both-sides-ism, false equivalence, phony outrage, intellectual dishonesty, hypocrisy, straw man arguments, bad faith arguments, slippery slopes, the parade of horribles, references to imagined “cancel culture,” video mashups taken out of context, and laughably weak or irrelevant legal arguments. They knew none of it mattered because the GOP would vote to acquit Trump no matter what, and it showed.

      Mr. Van der Veen claimed that the 144 law professors (from all across the political spectrum) who signed a joint letter were “partisans” trying to silence and intimidate him, and exclaimed (in transparently fake indignation), “How dare you?!” Did he not even see the irony and blatant hypocrisy of attacking their right to publish such a letter in the midst of making a pro-First Amendment “free speech” argument? He then promptly proceeded to demonstrate that he is, in fact, a personal injury attorney, not a constitutional law scholar, by making the precise frivolous First Amendment argument that their letter debunked. He thus illustrated Asimov’s famous quote that American democracy has always had a strain of anti-intellectualism, which believes in the fallacy that “my ignorance is just as good as your knowledge.”

    I am a registered republican, probably a RINO but still a republican for the past 20 years and I just don't understand the numbers they are reporting of republicans wanting all things Trump. He cares for no one but himself and if you couldn't see that from the past 4 years I again just don't understand how you can still be under his spell. I am so tired of this party and will be changing my party affiliation.

    I like the idea of a filibuster reform where republicans hold up voting for a couple of days and in that time have to make their case on the floor of the Senate. Then, voting continues. They have gotten by with far too much without ever having to explain their evil intentions.

    2/6: McConnell’s argument in support of acquittal was the equivalent of “how many angels can dance on the head of a pin?” Not only was his purported rationale a blatant case of jury nullification, he did’t believe a word of it himself. It was all just an elaborate, tortured excuse to let Trump off the hook.

    Target the messaging when it comes to pro-democracy initiatives. I suspect that in many parts of the country, framing the case solely around civil/voting rights will get less traction than framing it around the need to get money out of politics.

    Please factor in the fact that GOP is shrinking when considering these polls. So Donald's base is shrinking not just by GOP leaving the party but also by the percentage of his support within the remaining people in the GOP. What we need to focus on is supporting & informing those people who have left the GOP or are still in the GOP but don't support Donald's position in the party.

    Does the DNC have a role in promoting HR1? This needs to be a party-wide push, doesn't it? If there was leadership there, state committees and even town committees could rally around and help educate voters. Agree with Lovett that Sinema and Manchin need to be met where they are to get persuaded about the filibuster. Whose job is that though?

    Manchin and Sinema can talk about principles and the institution of the Senate all they want, but there is, I think, a very simple reason they’re trying to keep the filibuster: dragging along 10 Republican senators as your political cover is much easier than your vote being the reason a bill passed or failed. They don’t want the pressure, they don’t want the heat, they don’t want to be jammed between a bill that is widely popular nationwide but maybe a little less so in their states. They are, in essence, trying to protect their own political fortunes at the expense of the country and democracy. We need to start calling this out and dealing with this reality. If they didn’t want the national attention, they shouldn’t have run for Senate. They need to start putting the country ahead of their discomfort.

    Beyond 2024, don't forget that Tom Cotton, Josh Hawley, and Marco Rubio are in their 40s. Even Ted Cruz is only 50 years old. They have plenty of time and opportunities if a 78-year old Trump is the nominee in 2024.

    I think the real issue with the witnesses issue is that people think that a witness is going to be just bringing someone into chambers, both sides question them and theres crying and fireworks, etc.
    But its not going to be law and order with a stunning confession from Trump that he only realizes after the prosecutor walks slowly back to his desk and sits down, smiling, and saying no more questions.
    Calling witnesses was going to take time because the witness is deposed privately and the depositions read at the trial later. The issue is that any real witness would be a Republican and it was known ahead of time, which, if the "very friendly guys" of the GOP who met with defense lawyers during the trial was any indication, that person would be bumrushed, threatened/explained in very specific detail why they need to be part of the "right" side. So any witness would be political and therefor any testimony would be political in nature.
    Now, the other problem with the trial is the number of jurors who were complacient/colluded with Trump on the lies, promoted them, never stood up for truth....and so in finding Trump guilty, they would then be facing the possibility that they would be easily indited as well, as they found what Trump did to be a high crime & misdemeanor, so they would have a hard time defending themselves. So you take all of this into account and there was no chance of them finding Trump guilty. What surprises me more is that after Trump lost them any power they had, they still claim that Trump is only able to get them that power back....except that he is now deciding to target GOP who have offended him.

    If the Democrats made a mistake it was failing add a second charge of dereliction of duty. Trump still would've been acquitted, but it would have added strength to the House mangers' case.

      They would just argue what it meant, saying "not a legal charge". Non jurisdiction constitutionally of former presidents.
      As it was, Repubs were reduced to technicalities on the serious charge, which fitted what Trump did

      The court of public opinion was cast in concrete on the day the Capitol was attacked. Anyone still supporting Trump after that is not reachable or teachable. They'll have to figure it out for themselves. I had a similar experience after my divorce. We were amicable until my ex hooked up with a really toxic narcissist. Instead of fighting my ex I backed off and let her see him for what he was. As long as I was defending myself against her sudden change of personality it brought her more under his influence. As a result she quickly saw what he was and were divorced within three years.

    McConnell knows that, for there to be an amicable split between Republican voters and trump, Republican voters need to see that trump isn't electable. And because of that, I think McConnell will take winning in 2022, but losing in 2024 if trump is on the ticket.

      I think you're letting your emotions speak rather than thinking about the big picture. The end of the civil war at the time must have felt like a hollow victory, especially after Lincoln's assassination, but time has layered it with meaning.

      ​@@pakde8002 You're probably right. I just keep thinking that two impeachments are just going to be a badge of honor in motivating conservatives for the foreseeable future. The way spin is murdering us, don't really see it playing out any other way, and by the time people come to their senses with the power of hindsight in a decade or so, most of us still won't be able to correct any errors for younger generations, since most can't really articulate what's been going on. Me mum's a prime example: 72, MSNBC/CBS viewer, can't understand how things got to where they are, doesn't understand how her language and wearing a mask outs her to her conservative co-workers at the resale co-op (garage sale stuff) and her friends from teaching, can't understand how they've changed, why they're acting so weird, why they've been ostracizing her and treating her rudely in person and online.
      Yeah, you're probably right; I'm probably too close to the effects of all this, am probably seeing it too emotionally. Guess in a hundred years, we'll know how people then look back on what's happening now. (I'm not being sarcastic; thanks for the reality check.)

    Solution to the filibuster "problem": Dont end it, change it. Make it, so instead of the filibustering minority just having 1 person holding it all up, while the rest take the day(s) off, and the majority MUST have 60 votes to break the filibuster - reverse it. So the minority filibustering MUST have 41 votes present at all times to keep the filibuster up. Put it on the obstructionists to have to be there and publicly stand up for their obstruction every single minute.
