      It is unfortunate, but due to the nature of the crime he was accused of the police likely followed standard protocol as far as where he was housed. Where they failed was likely in ensuring the safety of people under their authority and protection.
      But for what it is worth, the guy is getting his money. And moving forward, you can pretty much assure that Sunglass Hut is just going to stop trying to play police. They are going to hand the video over to the police and that is it. Odds the manager of the store was angry and embarrassed and wanted to get revenge. And his act of retaliation caused a innocent man to get hurt in the process. And yes, you can pretty much rest assure all the employees of said Sunglass Hut are listed in the suit.

    The fact that a warrant was issued based on facial recognition software used by a private company and no investigation was done by the police or prosecutors office before requesting a warrant is outrageous. What’s more disturbing is that a judge signed the warrant with such flimsy evidence. The jail should be held responsible for what happened to him while in their custody. Edit to add that eyewitness identification is notoriously inaccurate so that should not be sufficient probable cause for a warrant.

      In a lot of sectors, including communications. You now have to pay money and join a "service" to communicate with anyone behind bars, holdover or actual jail, in a lot of states. The "service" usually sucks, and acts as a hinderance to be bonded, or let go, which helps these privately funded "justice systems" bottom line.

      Unfortunately, the charges can most likely be pressed against the perpetrators. This being that the police actually did their protocols and put him in a wing of the most violent offenders based on the nature of the robbery that occurred. I do hope he is able to heal, but the courts will just give immunity for that part and new charges will be added to the offenders records and length of stay, if they haven't been already.

    Remember the guy in Colorado who was arrested for bank robbery all because the software messed up? These facial recognition systems are broken and should not allow an arrest or warrant to be issued. A human should have to investigate and verify everything way before any of that happens. I mean they will allow someone suspected of murder to be interviewed first before they arrest them, but not an old man who is suspected of robbing a store?

      What you described is called "human in the loop", and it's a standard in many industries all over the world. Yet for some reason it's not standard in the US for facial recognition.
      Also FR is not "broken" as you say. If it was, we'd be heading these stories daily, which we don't. No system is perfect and we're seeing those edge cases. But org policies (like human in the loop) are meant to smooth out those edge cases.
      Additionally, the things the lawyer says about how FR doesn't work properly is incorrect. I know which study he's referring to (the ACLU's "test" of Amazon's Rekognition software), and the test was a farce. It was conducted in a way to deliberately generate bad results.

      No system or technique should be used for legal purposes until it has passed an independent evaluation for accuracy. Courts or companies should have to justify the use of such things by showing they have a certificate from an approved agency to use it. Test for false positives, false negatives, etc.

      I'm not sure where you've been, but robbery is considered a violent offense. Also, jails are only responsible for assaults if there was reason to believe that something would have happened to the alleged victim if placed with other violent offenders.     My buddy was charged with kidnapping and burglary based on faulty eyewitness testimony before he was released from jail after all charged were dropped when they processed fingerprint evidence from the scene 5 months later. He was never the same after 5 months in a violent jail and it changed my entire worldview. The worst part was everyone telling me that if he was in jail for the crime, he must have done it- none of those people changed their way of thinking or apologized or admitted they were wrong once he was released.

His lawyer set a number he thought both stores would agree to just to keep it out of court. And he probably guest right. But that lawyer's take is probably 30% so $3 million.

      Well AI only contributed, there was an eyewitness who ID'd him (though mistakenly). So if you are the investigating detective you would have a choice of either releasing him until you could prove his alibi was false and in so doing possibly releasing a violent criminal back into society (where you might not be able to find him again or he goes out and commits more crimes) or you can detain him in jail for the amount of time it would take to, once again prove out his alibi. Which in this case they did the latter and released him the following morning as soon as the alibi was proven true.

      I'll even go out on a limb and say they probably even tried to warn that facial recognition is not 100% accurate and the program was/is still very experimental (which should be obvious to most people with enough knowledge on the subject).
      But I think despite this someone pulled rank and gave the ill-advised order to, "Use it anyway" because dammit they don't care about the potential harm it can cause, their superiors want results and they themselves want that promotion, but they'd rather rely on AI do the work for them rather than do any actual police work. Whoever that was, they should face some prison time.

Shoe companies use child labor in China, Iphone factories have nets outside the windows so employees don't jump out, depending on where you get your coffee from the farmers get paid next to nothing.       That's part of the problem. Jails don't work like on TV. No one gets released immediately. Even if someone is bailed out they might still wait days or weeks depending on the jail's processes. Even though this guy was cleared by police, he was released based on the convenience and security processes of the jail. Although at the very least they should have moved him somewhere else while waiting for release rather than being kept in a unit for violent offenders.

    The victims should consult his attorney and consider also bringing litigation against the jail in which he was wrongfully incarcerated at which later resulted in him being attacked and sexually assaulted and that is unacceptable they should be held accountable as well

      It won't happen. He probably was not raped in the first case and only made the story up because he was angry that he was arrested. Any civil suits with the private companies will probably be settled out of court for a much smaller amount than what is being asked and he will just walk away with the check.

    Sunglass Hut sucks. My manager claimed I took money on a day that I was off. I had an emergency and my appendix needed to be removed that day. Police came to see me in the hospital while I was recovering and asleep. I awoke to my mom yelling/asking them, “Could you be any more stupid? Does he look like he’s in any condition to be working let alone steal something?” After a week or so I was offered my job back by a higher up (district manager, perhaps?). It was the most satisfying, “Oh heck no!” that I’d ever uttered!

      @@ms.lalady I would feel violated and angry at the people who followed me into the bathroom, and I'd feel annoyed at the wrongful arrest too, but I certainly wouldn't think that somehow me personally receiving enough to buy 5 houses would help me feel any better about what happened. Only justice applied to the perpetrators and fixing the wrongfully identifying facial system would make me feel better, so that hopefully this happens to nobody else in the future.

Hence corporations getting sued for millions and sometimes going into bankruptcy. You sound more jealous than anything, talking about homes that potentially could be purchased. This isn’t about you.     I have an acquaintance who was taken to jail once and was forced to stand by as another man was tortured and murdered by other prisoners. The worst part is that nobody even cared that it happened. I knew him before he witnessed that and he is not the same guy anymore. I can only imagine the nightmares you'd have after seeing something like that. Our jails need to do better.

      You do go from genuine care and concern, to outright desensitization. I remember my building was in the queue to be called to go to the chow hall, and some guy in one of the pods across from the one I was in, decided that was the perfect time to threaten suicide, by taking a swan dive off the 3rd tier. That put a hold on any movement from our building to go to the chow hall. And the reaction from everyone, was one of frustrated irritation because we were prevented from going to eat dinner. “HURRY UP AND JUMP!!” “WE’RE F’ ING HUNGRY!!”. No concern or compassion for the guy whatsoever.

      That's correct on one part. The second part is the Jailhouse Warden/Guards that don't 'get paid enough' to do the job they signed up for, as well. NO EXCUSES FOR THOSE IN CHARGE/POWER - hold the jails/prisons accountable for the crimes that happen, under their noses. CHECKS and BALANCES - sometimes , people need to be seen, in person, for them to get the CHECK, in order to be balanced.

    The technology is flawed and it’s ridiculous to make an arrest solely based on obviously flawed technology that did not work properly. What if he was not out of the state to prove his innocence? An innocent man would be in jail now due to incompetence and flawed technology!!! He should not only sue HPD, Macys, Sunglass Hut but also the facial recognition technology company who’s failed technology got him arrested in the first place! He needs to get a very good attorney.

    Whoever prepped the store employee and the employee both should be sentenced to life in prison for their part. The employee should be charged with falsifying evidence and filing a false report. The store employees lawyers who filed the report with the police with the false claim should also be charged. Texas should create a law that if your actions leads a person to someone being harmed as this person was you also get charged as a co-conspirator or accessory to the crime.

      Do you know how stupid you sound? Nobody prepped him to make a eye witness identification of grandpa. The detective would have brought a lineup book with similar looking suspects and he would have pointed to the photo of grandpa. There was no falsified evidence and no filing of a false report. The report that was filed simply contained information that was obtained during the investigation which provided the probable cause for the charges. Also, you need to look up and read about the concept of Qualified Immunity. If you're able to read.

    What’s scary is nowadays the machines are in control already. I’ve even been robbed by an ATM machine owned by ING bank in the Netherlands and the machine claimed there was no error or problem! Even with video cameras pointed on me the bank refused to verify the footage proving the machine made an error. It’s terrifying times we live in, just like the film Idiocracy where the Carl’s Jr. machine takes the lady’s money and defames her. Same thing is happening nowadays. Machines can now steal our money, our likeness, our voice, our identity… and this is just the beginning. Protect yourself however possible and film things as much as possible.

      It didn't happened to him. He's lying to increase his chances of getting paid for the mistake that was made. How does he know that will work? Look at your comment and 99% of the other comments. Why wasn't the county or sheriff's office mentioned as well for the suit, because it's a 100% certainty that he didn't say ANYTHING to the sheriff's office, and rape wasn't thought up until AFTER he was released on the mistake and he's trying to maximize his pay day. He should have said sued for 100 million, they would have quickly settled for 10 million. Now they'll probable settle for 1 million or less.

    This is the problem with the way we operate jails in America. Once they take control of your person, the state is responsible for your safety, but jails are not properly equipped to allow them to do that. There doesn't appear to be any separation of people arrested but not convicted of any crime from other types of prisoners. There certainly isn't any sanitization...just being arrested begins the punishment process in America and that's before you can receive a trial!
