    Can the government take all of a family’s money based on suspicion that one family member committed a crime? That is exactly what happened to the Slatic family earlier this year, when the San Diego County District Attorney seized over $100,000 in personal bank accounts belonging to James Slatic, his wife Annette, and their two teenage daughters, Lily and Penny, without charging anyone with a crime.

    Using civil forfeiture, the District Attorney seized nearly every penny from the Slatic family following a January 2016 raid on Med-West Distribution-the legal medical marijuana business owned by James. Police accused Med-West of operating a “clandestine” drug lab, even though the business complied with state medical marijuana laws, operated publically for two years, and paid its taxes. The police took everything from Med-West, including $324,000, and shut the business down. Then, a few days later, the District Attorney went after James’ family, seizing nearly every penny in their personal bank accounts.
    The seizure of the Slatic family’s money has nothing to do with crime fighting; it has everything to do with policing for profit. In the nine months since the raid, the District Attorney has not brought criminal charges against the Slatics or anyone associated with Med-West. The District Attorney has instead left the Slatics’ money in legal limbo, refusing even to begin legal proceedings in which the Slatics could prove their innocence.
    Now the Slatics have teamed up with the Institute for Justice to demand their money back. The District Attorney’s abuse of civil forfeiture takes the American principle of innocent until proven guilty and flips it on its head, treating innocent property owners like the Slatics worse than criminals. A victory in this case will not only mean the return of the Slatics’ money, it will uphold the principle that no American should lose his or her property without being convicted of a crime.

    Glad they got their money back. However, the two judges that denied three separate motions asking the government to return the money and the DA that stole the money should all be in jail.

      @@celularphone there is a thing called the US c0nstitution which is the law that the government must obey. Innocent until proven guilty is a fundamental part of the of the system which keeps us all safe from corrupt people in the government. When the government breaks the law meant for them, the c0nstitution, then none of us are safe. Governments which steal money from innocent people, (people who never were convicted of a crime are innocent in case you didn't know), are governments which are a danger to everyone.
      Government officials who break the law should be in prison for a long time. Letting them walk free only encourages the government to break more laws. They are setting a precedent which could lead to mass civil disobedience and possibly revolution. If everyone was aware that about 3 innocent people are robbed on the highways every day by cops, then they would be burning down courthouses and lynching cops. Cops steal more from the American public each year than all the burglars combined. Their departments are now reliant on stolen money to meet their budgets.
      It's gotten so bad that the Canadian government issued a warning to its citizens visiting the US to not carry large sums of cash or the cops might steal it. Very few of the victims of these government paid criminals, are ever charged with a crime, yet they have to sue the government to get their money back, (it costs about $8000 to do that). They have to prove their innocence to get their money back.
      We can't allow the government to become a tyrannical third world banana state. The c0nstitution is the law which governs the government and if we allow them to continue to break that law, we are all in grave danger.

    Civil asset forfeiture is the single worst thing that ever happened to American law enforcement.
    There should never, NEVER, be a profit motive in law enforcement! I was in that line of work for 8 years, and during this time the asset forfeiture laws came into effect.
    Immediately officers started looking for things we could target, and it was at this point that I understood that there was incredible opportunity for abuse of this system.

    By teaming up with the Institute for Justice, the Slatics were able to fight back and win. In May 2017, a San Diego judge ordered the district attorney to return all of the family’s money with interest. Thank you for helping this family!

      Yeah, NEVER listen to anybody who calls you paranoid because of any precaution you choose to take in ANY area of your life. Better to err on the side of caution. Better yet, one should never discuss such matters with anybody, period. People just can't be trusted anymore, and it's not because everybody is malicious or anything like that, although many people are, but because the person you trust may not have the good judgement or foresight to keep what you share with them to themselves. It's not necessarily that you can't trust a friend's morality, for example, rather, you can't rust their judgement.

    Big news out of San Diego! In May, a court ordered the District Attorney’s Office to return every last penny of the more than $100,000 it seized from the Slatic family using civil forfeiture. This important victory came after a 15-month battle before two different courts and three different judges. In the face of great odds, the Slatic family and IJ persisted. That persistence paid off when a judge agreed that the DA had no grounds to hold the money. August 2017

    This happened to me as well! My bank account was set up to pay for my medical care. I had just been diagnosed with an illness and did not have insurance so I created a separate account specifically for all of my medical bills and paid cash for all medical treatments and had a papertrail. My bank account was frozen and all the money that had been set aside and saved up for my medical treatments was seized and I was told that I had to provide proof of where it came from and how it was being spent. I hired an attorney who eventually just said “it’s best to let this go cuz police will drag this out and cost you more than they seized.”
    This is why it is important to NEVER let them push us toward a cashless society and use cash and keep gold and silver as much as possible. Anything digital gives anyone total control over your finances at anytime!!!

      I'm no attorney but I would:
      Go after their individual bonds, make a claim on them. File claims on their hazard insurance. File criminal complaints with the state/federal licensing board on each and every criminal involved. Go after the their union bonds. Go after their department bonds. I would file an insurance claim on any and all insurance policies I find, on each every criminal thug.
      I would also target their personal assets and file liens accordingly for my losses and damages.
      If done correctly and properly I would get some kind of justice.
      I would study, do research and file timely. I would seek competent counsel.

      Ian Battles we lost my grand parents house that was signed over to my mother in Connecticut. It was taken in order to pay my grandfathers debt to a nursing home which makes sense but then we where told they where gonna only market it for 40,000 dollars and had to pay what ever else out of pocket. We took that to court and had to prove the house was worth more then that. In the end the judge sided with us raised the price to 150,000 more then what my grandparents had owed to the state. We did not see any of it, they even took his cars a boat and all there personnel positions inside we where only allowed to take a few things after it had been inventoried by the state.

    I know a guy who was going to buy a vehicle out of state and they took all his money. Destroyed his business, wrecked his and family's lives, no charges were ever filed.
    Most people I talk to do not believe this is even a real thing. You can tell people and even show them, people do not believe it. That is a lot of how this is able to go on.

      But wouldn't that be punishing the local taxpayers, yes it would probably come from some sort of insurance policy but that said policy would be paid for by local taxes.
      The only way this will ever stop is by making those responsible for such crimes and any other crimes against the people is by making individuals responsible and not departments.
      Where did the idea come from for the raid, first one guilty.
      Who agreed to the raid Second one guilty.
      Who authorised the raid Third one guilty.
      And so on, when these people realise they are not above the law we will start seeing changes.

    This brings back memories of my resistance to getting a bank account and being forced to obtain one because of the practice of direct deposit paychecks. I remember feeling it was a violation of my rights. I didn't make enough money to hold a bank account and was constantly charged with NSF fees. Sometimes, I didn't have enough to cover the bank fees but the bank charged me anyway and then charged me for the nsf penalty. They would hold my transactions in a holding pattern until that one transaction that put me over the limit, then they would post the transactions, not chronoligically, but by the dollar value so I would end up paying fees for 5 or 6 transaction over the limit instead of the one transaction. Luckily, I am no longer so poor that I have to juggle my expenses, but this ad brought me back to that time. The government has asserted itself in such a way that nothing belongs to you.

However this was not a simple mistake.This was an abuse of power.If you look at the way it played out that DA used poorly conceived law to try and force someone into a plea bargain after realizing he didn't have a leg to stand on( hence no prosecution). Then when he realized he violated that same law by not filing proper documents in a timely manner he tried a "two step shuffle" and cover it by a last min. ditch effort to file after the deadline and got caught at it. Justice was somewhat served ,however I think maybe he should have been personally held accountable (financially) for the unnecessary interest and credit damage done to the family.
