Conveniently, let the illegal detainment go unacknowledged there didn't you? Rodriguez v US: extending a traffic stop. Just asking him to step out of the car without Reasonable Suspicion of a crime is a 4th A violation and could make any further investigation "Fruit of the Poisonous Tree" OF COURSE Fraudit the Audit would overlook that part. Under recent case law, even a 90sec detainment to ask if they could search was considered a 4th A violation. It is well established that a routine traffic stop is not to be used as a pretext to any other investigation and doing so is a Civil Rights violation is every case. You cannot cease someone's movement in the hopes of finding them committing a crime.

Unfortunately, there are several cases of this. It’s ridiculous that they almost always have to pay for a lawyer just to get their money back too. But of course, they can sue the dept in return. As they should. Maybe eventually, they will catch the hint that not everyone that carries large amounts of cash around are drug dealers.

I've been involved in a seizure of funds. The cops took exactly 123k out of my home because they thought it was drug money. Cost me almost 20k in lawyers and to this day I still haven't gotten that money back. This was in 2014. This was my life savings that I literally kept in my closet. The forfeiture all stemmed from false allegations that I was cleared of. The money was deemed to be mine by law but all I got back was the money to cover my lawyers fees. This is a way that the government steals from its citizens and is just wrong. The crazy part about all of this is that it was the postal police who did the seizure and raided my home with out a warrant. They said they had probable cause. Such bs.

Disagree. I can't believe that two separate agencies (not even in the same state) could pull off the coordination to find this guy a day later. Additionally, the Texas DPS did their due diligence and let him go. Do you really think that they would voluntarily offer up to Arkansas LE the fact that "we weren't good enough to get him" and then pass on the intell to get the guy that "got away"? I'm not opposed to conspiracy theories but this gives the police way too much credit for the ability and the energy to pull this off. While many are quick to believe that the bias of the police compromises their judgment, it appears that many commenters here suffer from the malady.

I doubt it. State troopers love to stop every out of state car they see, particularly in the southern states when your car has plates from somewhere other than the south. Firstly because they know out of state drivers are almost never going to travel back to the state for a court date over a traffic ticket, so they're just going to plead guilty and mail the form in along with their payment. And secondly because they view every out of state driver as a likely mule for drug dealers. So they're always looking to escalate every traffic stop with an out of state vehicle into a search.

I don't understand AtA's grading system sometimes, either, but I think he's just grading solely on conduct while trying to appease the public too, or the people that watch his videos. If he just outright kept on giving police officers "F's" for "illegal activity" then it would imply more so as hateful bias rather than an informative / justice TH-cam channel that tries to promote an unbiased review of the conduct between the public and law enforcement. He probably feels like his videos wouldn't make a difference if he didn't grade on anything other than conduct. I think he tries his best and does obviously consider illegal activity, but I think his true aim is to make a difference. He's going about it the right way I think, sometimes you just have to do things in a certain respectful manner in order to make a difference or gain the people's trust. I get it, and it sucks, I'm sure there are a lot of times he wants to just lay into how pathetic all of this organized crime really is as well as call them out on their bullshit. In fact, the call at the end to contact your representative and share your opinion on civil forfeiture is one of the clearest statements I've heard here. The very fact that the trooper acted within his authority and can technically earn a B is what should embarrass and shame himself and the entire system that incentivizes and allows this kind of thing. The fact that the channel does deep research and exposes the loopholes within what is even technically legal is a very important service. Anyone can point out the ignorant and illegal acts happening within modern policing. I find the morally evil acts which are technically legal far more concerning and often difficult to expose.

Happened to me in Illinois. Was moving to Colorado from NY. State patrol stopped me for not having my headlights on in inclement weather ( as the cop stated to me ) it was barely snowing out in the afternoon. I had $30,000 on me from my house that I sold in NY. Cop asked if he could search my car I thought nothing of it and let him search ( big mistake on my part). He found my $30,000 and took it and arrested me for money laundering. Stayed almost the whole night being questioned by the Illinois State Police. Had to pay $300 to get my car out of lock up, and they took my $30,000 until I had my lawyer fax them all the details of the sale of my old house in NY to prove that is my money. They sat there and counted all of the $30,000 by hand right in front of me and gave it back. Before I walked out I asked so what is the legal limit of cash a person can carry at one time that is not illegal. They couldn't give me a straight answer because there is no law stating that a person cannot carry large sums of money. They're just hoping that you just forfeit the money so they can keep it.
Just saying when it comes down to money cops get crooked and greedy and they only reason they pulled me over was because I had an out of state license plate not the b.s of not having my headlights on.
Where is the freedom of this country when you can't even cross state lines without being pulled over because of an out of state plate?
All n all I give the Illinois State Police and "F" for 🖕

To answer what happened to innocent until proven guilty, is they made it to where the constitution protects you against criminal law. In this, taking your money through civil law, they say the constitution doesn't apply as much. Thus why it's up to the individual to prove their property is innocent. No one said anything in the 80s when people thought they were just going to use it against drug dealers. Seeing these from a few years ago really shows how law enforcement hasn’t been protecting and serving in very long. They treat everyone like a drug dealer or some kind of criminal. And even when they’re wrong they face zero repercussions. It’s disgusting

I read that nearly 96% of circulated cash has drug traces on it. Of course a dog will hit and a swab will be positive. You just can't even have cash anymore. If he refused consent then they get a dog and make it hit and search anyway. It's all crazy.

I've always been amazed that forfeiture like this wasn't immediately slapped down by the courts. Court cases allowed in in certain circumstances but then departments then took that to mean it was open season on any large sum of cash and that was never the original intent that allowed seizures. The sheer amount of legalized crime this could foster in our system had to be foreseeable. Sure enough forfeitures started funding police forces. It is obscene beyond words that this is allowed in a supposedly free country.
Edit: I've watched and commented on several of your vids but this is the last one. To give anything other than an F is obscene. You do not deserve the traffic and i'll be dammed if i help someone who thinks it's ok to rob people under color of authority.

    • @Proud_Knight

You and everyone else in the comments here need to chill about the rating. They don't think it's "ok" and they blatantly say so during the portion where the rating is given, but the ratings are based almost purely on the legality and the cop was within his _legal_ right to seize the cash. It's fucked up but the cops are incentivized to do this, the real F rating goes to the lawmakers.

@@poulthomas469 Listening to what he says directly following the rating sounds to me like he's calling them out. He didn't just give him a B and call it a day, he literally called the fact that this was within the bounds of the law "disturbing" and then even went on to question how they use the money. You act like some letter on a TH-cam video that cops nor congress will likely ever see is more important than trying to get the law changed, which he essentially urges us to do at the end of his assessment. If you feel so strongly about this, speak to your congressional representative like he suggested.

YES, it sucks that the money got taken, and YES, of course no-one thinks it’s cool. but what people seem to miss is that the cop was acting within his right/authority in a system that encourages this kind of forfeiture (/theft). he even seemed inclined to follow the precedent of the Texas investigation to just let the guy go, but being uncertain of what exactly to do he deferred to his superiors, who unsurprisingly encouraged him to take the cash.
sometimes, everyone can have decent intentions and do what they’re supposed/expected to do, but still have a bad net outcome. sometimes, the “system” itself just sucks - the byzantine assemblage of laws & administration can create blind spots, and what it functionally yields is, as a result, “DISGUSTING.”
