      The Alternative Minimum Tax (AMT) is a flat tax that has been in place since 1969. The AMT requires certain taxpayers to calculate their taxes twice - once under the regular income tax rules and again under the AMT rules. Taxpayers must pay the higher of the two amounts. The AMT was originally intended to ensure that high-income individuals paid at least a minimum amount of tax, but it has since expanded to affect more middle-income taxpayers as well.

    I think it’s very much the same in Canada with the CRA. Any government agency actually. If you have ever worked in a casino up here you have been scrutinized to obtain your licence. They know everything, I mean everything about you. They ask questions that they already have the answers to testing your honesty. We used to say after the interview, “I met god today.”

    If I do a 1031 exchange but end up not renting it out and live there, is there a penalty?

    • @besttaxpro-tax-advisor
      @besttaxpro-tax-advisor  2 หลายเดือนก่อน +2

      Ah, that's a great question about 1031 exchanges. The general rule is that if you do a 1031 exchange, you need to hold the new property as an investment or for use in a trade or business for at least 24 months after the exchange. If you move into the property and use it as your personal residence before that 24-month period is up, there can be penalties.
      The main penalty is that you would have to "recapture" the deferred capital gains taxes from the original sale. So you'd have to pay those taxes that were deferred through the 1031 exchange. The IRS views moving into the property as a disqualifying event that triggers that recapture.
      There are some potential exceptions or ways to avoid the penalties, such as if an unforeseen circumstance arises that forces you to move in. But in general, the 24-month investment/business use requirement needs to be met to avoid the capital gains tax recapture.
      I'd recommend speaking to a tax professional who specializes in real estate transactions if you have any other specific questions about your situation. They can help ensure you structure things properly to maximize the benefits of the 1031 exchange rules.

      @@TripReviews They will know everything once they implement the mark of the beast.
      Until then they only know what I allow them to know. Cash is anonymous. I do not use plastic or any of those digital pay apps. Heck I haven't had any phone in 10 years.
      I use someone else's vehicle, someone else's internet, someone else's cable (when I can), etc.
      Literally no way to efficiently track anything I do. It is possible with recognition software but they have to know where I will be and what day/time to see anything. Even then they have no way of knowing if what I buy is for me or for someone else.
      I am one person and expending resources on one person for nothing to gain is wasting their time and resources.
      There are much easier and bigger fish to fry as it were.
      Don't get me wrong - I do pay some federal taxes and never claim a refund. In fact they owe ME over $10K in refunds.
