Cop Assaults Air Force Capt. for Not Knowing Neighbor, Says He Could Have Tased or Shot Him Instead

  • Capt. Nicolás Aquino attends the Naval Post Graduate School in Monterey, California, and plans to devote his life to military service. His family fled Paraguay to escape a brutal dictatorship before he was born, and they came to America because of the rights the U.S. Constitution offered.
    "That's one of the many factors in terms of why I wanted to serve this country, so I could uphold those ideals, that I could fight, that I could give back to the community and make sure that [my family] can keep those freedoms," says Aquino.
    Aquino says he works everyday towards protecting these rights. That, he says, makes his entanglement with law enforcement these past few months even more infuriating.
    In December 2013, Aquino was at home when he noticed Sheriff's Deputy Ivan Rodriguez outside his property. Apparently, one of Aquino's neighbors didn't recognize him and called the Sheriff's Department to report a suspicious person. According to Aquino, Rodriguez didn't identify himself and didn't clarify why he was at Aquino's address. After some conversation, Aquino asked if he was being detained, and the officer said yes. The police report claims that Aquino asked this in a "confrontational tone."
    "The officer, he appears to have been offended at the idea that a citizen would question his authority or would even ask any questions," says Aquino's lawyer, Steven Liner. "Everything that Nicolás was doing, to me is sort of like textbook 'OK, I'm going to be respectful, I'm going to answer questions, but I'm also going to insist that you answer questions for me, because I am within my rights on my property to ask these questions.'"
    Even after Aquino provided his military ID and offered to get his utlity bills to show proof of address, Rodriguez remained unconvinced that Aquino was not a burglar and moved to physically detain him.
    "He just grabbed my wrist without any warning, without provocation, put me in a choke hold," says Aquino. "I still have fluid buildup in the back of my right ear, a right head contusion, abrasions and contusions on the elbows, knees, and hip."
    The officer then proceeded to put Aquino in handcuffs and search his wallet. He finally concluded that he did, in fact, live there.
    "The officer did not apologize. He pulls me over to the side of the driveway and he does basic victim blaming, and he says it was my fault for not knowing my neighbors. He then states that he had wanted to tase me if he had a taser, and he would have shot and killed me if he had drawn his weapon, and he would have been fully justified in killing me," says Aquino.
    After the incident, Aquino thought he could put the nightmare behind him. Two months later, however, he was notified that there was a warrant out for him for resisting arrest during the incident. Aquino was dumbfounded but decided to fight back.
    "I was not aggressive or confrontational in any way," says Aquino. "Are we supposed to bend over and, excuse my French, just take it? Just because a person is on a power trip and feels that he can bully you into submission?"
    Liner says no, citizens need to stand up for their rights. "This is an opportunity for all of us to talk about how it is that citizens have an absolute right to ask questions and that police officers should be respectful and civil and act lawfully, which means not using force unless it is really called for," he says.
    Once word got out about the arrest, the public flocked to support Aquino. The DA seemed unconvinced at that point that a jury would side with Rodriguez, and he dropped the charges. This is a victory for Aquino, but the DA still appears to defend the officer's actions. The DA's office declined Reason's request for an interview.
    Aquino plans to continue fighting and is filing a civil claim against Monterey County for damages.

      Aren't they all these days?? I have never had a positive interaction with police. That includes the 30 years as a nurse dealing with them 2 or 3 times a week.

      This cop was more than likely bullied at school, so now he wears a uniform, he can get payback. Before being recruited, they should all be subjected to psychiatric evaluations. This type of cop is why people no longer respect the police.
      If a citizen asks them to answer a question, they are being confrontational and are harming the cop's fragile ego. And then they explode - costing the taxpayer a fortune, but still remain cops who get a slap on the wrist.

      Most people in the military will have an out of state driver's license because they are not required to renew every time they move, which is often for many of them. What should have happened is this cop should have been shot in the face.

      The entire 8 years i was on active duty with the army drivers license, car registration, and insurance were based in my home state with my parents adress. If this had happened to me the only way i could have proven i was residing at said adress would to show the cop my lease.

    Nicholas Aquino, I am so very proud of you for standing up and defending your rights. I also thank you for your service, as I, too, served for 20 yrs in the United States Air Force. Its a sad shame that military folks who defend this country as well as other innocent people, are put in a position to have to defend themselves against these out of control rouge cops and those that are protecting the cops and their wrong doings.

      That PD should know better where not to dig their nightsticks, and if you have a loose cannon in your unit, you snip it before it may cause damage to the larger image and honor of their Force. If they cared that's it.

Fun fact: the psychologist who actually formulated the psych tests the PD use intended for them to weed out these malignant personality types only for the PDs to basically turn the scoring on its head to make sure they got these "assertive" pychos on the job.

      I disagree. It is impossible to know every law...even for lawyers. Yes, nitwits do don the uniform and the badge...but, I am willing to bet there are nitwits at your place of employment, too. It's a human thing, not a police officer thing.
      And, sorry....but, the regulations are strict on the officers. If you ever get the chance, talk with an officer. The police officers I've encountered were nice as can be. Of course, if I was robbing a bank or assaulting an elderly man, I'm sure those same officers would put me in my place.
      Our society is sick, morally. That sickness permeates everything.

    I went to highschool with a a very large overweight bully. Imagine my shock years later to encounter this guy in police uniform when i passed him seated on a barstool at a bar at the front of a restaurant. He was still large and overweight and his manner did not seem much changed from years ago. He certainly did not mention trying to bully me back in highschool. I really am concerned to see a guy like that in uniform.

All of us learn to use weapons to kill people. Don't get confused that we were just protecting people like the commenter. We were mostly protecting US business interests abroad. Don't sugar coat it. If your mos was not infantry or MP, you most likely did not become a cop when you got out.

    I'm a former cop and I am shamed of how many officers act these days. If you question there reason for stopping you, that is considered "Combative". Revenue Driven Traffic Enforcement is the number one reason for these bad encounters and this system needs reform.

    Since the sheriff treated a military member like this maybe they need to lose all federal support and cooperation until that deputy is held accountable and the sheriff needs to reimburse the Air Force for his medical. It would be a shame if service members went on their own quest for justice.

Damn near every time, regardless of circumstances or even guilt - the state or local government, everywhere in the USA, consistently LETS KILLER COPS WALK FREE! I know there must be cases where such cops get prosecuted for actual murder, when they do commit actual murder (which they terrifyingly, seem to do fairly regularly) but I haven't read about a case like that for a long time! The case of Kelly Thomas (Fullerton CA) is a prime example of this when two jack-booted thugs in uniform, beat a homeless man, to death, in front of witnesses, while he screamed for his dad! The example of what happened to the cops, is what DIDN'T happen to the cops, because NOTHING HAPPENED TO THE COPS. The cops walked free when the police force is a gestapo, that does nothing to discourage cop's thuggery and murder and no "penalty for killer cops except maybe a paid vacation ("suspension") on the taxpayers dime while the local government waits a month for the public to forget the whole thing)... there's something very wrong in this country and it's been happening for a long time.

    I have a question if anyone knows the legal answer please say it; Being that he was on his own property, under the Stand your Ground ruling, what would have happened to him if after being put in a choke hold and slammed to the pavement, he fought back and overpowered the cop and in the process, was able to get the cuffs on him and then called 911? He was totally in his right to defend himself...cop or no cop. Anyone who is at their own home and has properly i.d'd themselves to a cop has the right to defend themself against a rogue cop if the cop decided to attack them for no reason.
    As for the D.A who said that the cop was justified and the charges of resisting are justified .. well that is a huge shit pie in the face of that whole city. That statement is so outrageous , that both the cop and the D.A are unfit for the job.

    The fact that the cop blamed the victim and stated that he could have been justified in shooting the victim proves that the cop has a short fuse and was unjustified in chocking the victim. It shouldn't be illegal to tense up when being unjustifiably chocked. Shame on the prosecutor for taking so long to drop the charge of "resisting".

    I was a teacher in the public school system. Some students would swear at us, push us, tell us “NO” , and completely ignore our instructions. We had to take it and we had nothing to protect us. So, we had to learn to use our words in order to deescalate the situation.

      My mother was a nurse and was in a similar situation, but she was so protective of her patients she didn't care. They would overwhelm a patient who was combative by surrounding them with as many personnel as possible. They weren't allowed to even bruise a patient whom they were subduing, and police regularly bruise people just with the hand cuffs they use. Nurses were not allowed to sedate patients like in the movies because it is dangerous to knock someone out. An anesthesiologist is needed to sedate someone to the point of losing consciousness and then he needs to stay and make sure the person keeps breathing. Plus they often didn't know what else the patient might have taken and it would cause drug seekers to attack regularly. She has been threatened with a knife and she didn't shoot anyone, or kill anyone.
      Cops have turned into cowards. One two cops who broke that elderly woman's arm (stole flowers from Walmart) got his panties in a knot because he saw the female cop rub her arm. He was frantic, "Did you get scratched?" The SOB had just laughed at the sound of the elderly woman's arm breaking and he acts like a potential scratch is the end of the world. If teachers and nurses can deescalate a situation without killing anyone so can cops.

      Not knowing much about the neighbor, it’s hard to say. Says he hasn’t really seen the neighbor, and if they genuinely thought he may be an intruder, calling the police to check does not mean accosting an innocent person. The property manager in my community did not give me a heads up on the empty place next to me, and when someone was there I had no clue why. It was during office hours, so a call to them cleared it up, but they are supposed to give us a heads up, and I would have called the sheriff if the office wasn’t open. Im sorry, but you never know who you are confronting. In my instance, it was a a guy they hired to paint.

I robbed a string of banks earlier this morning, but was caught and arrested while fleeing the 7th bank I'd hit. I was accused of multiple counts of armed robbery, based on clear and obvious video evidence that it was I who did it..... They found ALL the cash in my trunk, in nylon bags with each bank's name on them. 🤞🤔🤞
      But..... when it came time to adjudicate, I acquitted myself of ALL charges, based on my own testimony that it wasn't me who did it! Case closed!!👌😀👍

    There is no law so trivial, or offense so minor, that the police will not kill you over it.
    "Qualified immunity" is anathama to a free society. When "public servants" cannot be held directly accountable for their actions, they lose their only incentive to restrain themselves.

    All police in all 50 states NEED to be required to wear body cameras and to have them on in each and every contact they have with a person while in their official duties. Without this protection we Americans are living in a police state. Police often get delusions of grandeur due to the gun they wear and the official status they hold. Suing the police is the best way to keep them in line, as well as using your cell phone to record any interaction with the police. I am pro-police but there is a serious limit to my tolerance as I'm a Nam vet and a legitimate war hero and I don't want my rights taken away from me by anyone. StocktonRob

    When I was a kid, my parents told me that if I was lost or needed help to find a police officer. After several unwarranted and unconstitutional searches, verbal and minor physical abuse, I will not call a cop even if my own house is being broken into. There have been several good cops who have helped me, but there have been others who treat the people they are here to protect as insurgents and they act like an occupying army. Giving them military weapons and training does not help.

    If he is active duty. Cop can be charged with damaging government property. This is a legal president. That a military person is injured by someone they can be federally charged. For those damages. As active military are on duty. And anyone who impedes that function can be federally charged. The reason this came about was a military person self injured. But by saying this it applies to anyone causing injury to any active duty military personnel. Being he is a captain with more demands on his time just make it worst for this cop. Like the captain said obey and know the law. Which has no place for corrupt petty tyrants. I am sure the US Air Force JUDGE Advocate GENERAL will explain to this cop after jag papers him. He will learn what real honest to God power is.

      To a point I agree. The only problem I have with that is you would be hurting the children of the officer, who are truly innocent and do not deserve to be hurt. Now I think that officers should be required to carry malpractice/liability insurance like a doctor or lawyer. Officers with no claims get a reduction in premiums and officers with claims get premiums raised. When the premium gets so high that the officer cannot afford it or the officer has so many claims that they become uninsurable then they loose their job. That is one way to slow get rid of the bad officers. Reward good behavior with decrease in premium cost and punish bad behavior with higher premium cost. Also that way the officer can't just go to another department or state and work again. If they cannot get insurance they cannot work.
      So several things would happen by doing that.
      1) Tax payers wouldn't be flipping the bill for bad officer actions.
      2) Save the local government money that can be used to better train officers or help low income areas.
      3) Promote and reward good behavior and actions with officers.
      4) Punish bad behavior and or actions of officers and hold them personally responsible for their actions.
      5) Slowly weed out the bad officers by cutting out the protections of other corrupt officers and leaders.

    Ya know the only reason they try not to charge cops? Because ANY prison sentence for a power tripping (or worse) cop is potentially a death sentence because nobody likes a dirty cop ESPECIALLY the criminally convited (well except for those who've been convicted on the testimony of said dirty cop making an appeal on their sentence a HELL of a lot easier to get).

    Citizens do have fundamental and well-established rights -- and any reasonable cop (or journalist) should certainly know this. “The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.” - U.S. Supreme Court, (City of Houston v Hill, 482 U.S. 451, 1987)
    Public outcry shouldn't have to force the DA to do what's right and lawfully correct - in recognizing our protected rights. Far too many public officials get this wrong and it's un-American. Here we are 10 years later after OP posted this video and it's still going on. 'When people who enforce the law are not subject to it, then law has no meaning.'

    DA is a major culprit, it is that office job to review accusations of a policeman before agreeing to charges, and to be alert to lawless behavior of police. Not to mention that DA should be educated in relevant federal court rulings on civil rights and limiting "qualified immunity".
