    For the uninitiated, Kinder Eggs are a chocolate treat widely available throughout Europe, Mexico and Canada, with the company that makes them, Ferrero (perhaps better known in the U.S. for being the makers of Nutella), selling a whopping 1.5 billion of the eggs per year. Where they don’t sell any is the United States, where the eggs are indeed illegal (though something of a blackmarket does exist for them). So why is a beloved candy the world over explicitly banned in the land of the free?

    Just a clarification for those who didn't watch until the end, Kinder Joys (which are packaged very similar to Kinder Surprises, but are a different product) are perfectly legal in the U.S. as noted in the video; it's Kinder Surprises that are not. We've gotten a lot of emails from people noting they have Kinder Surprises at their stores in the U.S. including sending pictures, but the pictures are all of Kinder Joys. :-) If you watch to the end, Simon shows the difference between the two. :-) Again, if you're seeing Kinder Surprises on the shelves of some store in the U.S. for sale, they were smuggled into the country. That's not to say anyone seems to care once you get them past customs, but they're still illegal. :-)

      +Dingier WeEvil44: The company is going to start selling the Kinder Joys all over the U.S. starting in 2018 in a major push. Currently there are places in the U.S. where you can get the Kinder Joys already though. Just not yet "everywhere" like M&Ms or the like.

    When I was in Austria, I bought 10 kinder eggs that I planned on bringing back with me
    Then I started reading about how they were illegal
    Got scared
    So I ate all of the eggs that night

      @@isabella-lp3nw kinder eggs are harmless, in order to eat the toy it has inside you either should somehow put the whole egg in your mouse and eat it without noticing the plastic or be a baby, eat the chocolate and then eat the toy pieces, in which case its your parent's fault for giving you it.

      No joke, the understanding we have here in Europe over the ban is that american kids are "greedy and stupid", and they would bite the egg whole without realizing there's something inside and choke on the plastic capsule, not even the smaller parts of the toy. Not a good look for America is what I'm saying.
      This was the first video I saw explaining the actual reasoning and dispelling the myth, so I can only assume it is still alive and well among my peers.

      I don't think you can "Win" when your child has lost its life, however there is a warning saying that the egg is not suitable for children 0-3 at least now not sure if it has always been the case though. Tragic that if these warnings were ignored though,

      Well, the hot coffee case was due to negligence on McDonald's part. (The coffee was hot enough to fuse the elderly woman's genitals shut, which is too hot to serve/drink safely and that was the real problem.) They added the "Hot contents" so it looked like the person suing was being ridiculous.

    As we were going through the security line at the airport, they searched our bag and found the kinder eggs. They didn’t fine us, no no, but instead crushed each individual egg and threw it in the trash right in front of my 4yo eyes... I cried...

    Fun fact: here in Germany the Kinder surprise eggs go on „summer vacation“ there’s a whole advertisement thing about it... that is because the egg shell is too thin so it would melt while transported or while sitting in the supermarket so they don’t sell them here during the summer

      In Italy we have a commercial saying exactly the same thing about Ferrero Rochers (don't know if you have them in Germany). It's funny to see that it is a common practice for Ferrero to do these commercials, very kind of them.

      In Poland they are replaced by something called kinder joy during summer. It’s a cream similar to nutella with two rocher-like balls sticked in it. It is packaged into a plastic egg split into two halves - one has the cream, other the toy, and there’s a plastic spoon in the middle for eating the cream.

    When I was a kid, the Kinder Surprise toys were far more intricate than the ones you find today, you could find stuff as complex as miniature plane or car models, with lots of tiny parts and decals. Assembling them was a real joy and mentally stimulating af for a 5-6 years old kid!
    It's unfortunate that they had to dumb them down so massively just for the sake of "safety".

    In Canada this is something we laugh about a lot. Imagine living in the "land of the free" but you're not allowed to buy Kinder Surprises. I mean you can carry a handgun to the movies, but *Kinder Surprises* are too dangerous to kids.
    And before anybody starts trying to defend the guns over the plastic toys, I'm going to let you guess how many accidental shootings happen in the US vs children choking on kinder toys in Canada.

      Vi Coni First you need to stop basing your view on guns from anecdotal situations like school shootings from the news and look at mass shootings as a statical whole to understand how rare it actual is. Yes there has has been an increase but to place that on guns is obtuse. As gun laws and restrictions tighten mass shootings increase showing that there is another variable responsible for the rise. And second you have no understanding of American culture. If our government was to go tyrannical the amount of military that would obey orders isn’t high. And that’s speaking of conventional units. 90% of SOF is hardcore conservative and would be the first to rebel against a tyrannical government. This includes Green Berets whose primary job is to train a populace to fight against a tyrannical force and become a force multiplier. But let’s speculate that in the end it’s all fruitless and the American people fail to over throw the tyrannical threat. The part of American culture you don’t understand is that we’d rather die with our useless guns in our hands fighting for freedom than to surrender on our knees and live under subjugation like you up north would so gladly do. Give me liberty or give me death!

    When I was around 3, my family went to Germany. That was the only time I've ever gotten a kinder surprise. Although having them growing up would have been cool, in a way it remains one of my really cool memories of Germany.

    When I would come back from Germany on numerous TDYs, I would bring these back with no problem...I didn't know that they were illegal...this is silly...this is also why that when back in the 70s and 80s, toys were often hidden inside of boxed cereals...but today, they are placed inside the box, but outside of the cereal bags...we are living in a nanny state...

    The re-design of the capsule for the toy is due to safety issue. When I was a kid, you could fill it up with water and some baking soda. Shake it, then duck and cover. The design back then did not let any gas out and thus, after a while the capsule would "explode". A loud BANG and the top would fly away. Now, there is some small hole and a hinge that prevent it. Sad. It was innocent fun. :)

    I had a memory pop up of a candy I used to get as a kid in the US (MN, early 2000s). I remember it was a large chocolate sphere with little toys and other candies inside. My memory may be wrong, I thought there were toys in them. I specifically remember it being Disney. My mom would let us get one at the gas station or grocery store...
    EDIT: Mentioned at 10:30 wow didn't know they had a plastic casing inside, just thought they were in the chocolate. Must've been banned right after we got them lol

    Kinder egg toys just aren't the same anymore .You used to get little racing cars etc with maybe 8 pieces to put together and that's 5 minutes of the best fun ever for a 6 year old boy. Now almost all of them are a single 1 piece figurine that's no fun at all. The toy you got in the Kinder Joy that you just looked at and said "it's a piece of metal from a tv show i don't know" and then immediately put down, that's what most of the toys are like in the Kinder Suprise eggs too.
    As for the choking hazard, I used to put the 2 halves of the plastic container in my mouth and suck on them for hours :D

      Even though I grew up in the us, I was lucky enough to try kinder eggs when my parents visited Mexico. It’s just so dumb that they’re banned in the us. Some places are now staring to sell them now secretly. The other day I saw a 12 whole pack of kinder eggs at a little Mexican pastry place. It’s just dumb, there’s nothing wrong with the eggs. I’m guessing it’s about the toy in the middle

    I used to live relatively close to the border with Canada (less then an hour) so we would go to Winnipeg quite often. I remember my grandfather and I buying these and bringing them back for my siblings. He would always remind me not to say anything as we got to the border crossing. I would usually be playing with my toy and the guards would remark that it was nice of my grandfather to get me such a treat. They would ask if he had any unopened ones, he would reply 'as you said it was a treat and since only she came only she got one. ' Never had a problem, also never tried it when my blabber mouth was along.

    At Disneyland in Hong Kong, a piece of a stroller fell off and went unnoticed by the father and young son. I retrieved it and gave chase to return it. They came back to where i was and the boy,seemingly of his own accord, gave me a kinder cookie.. it was individually pair wrapped and i believe it was a hippo and the bottom was coated in chocolate.. it was the best, i looked for them for the rest of my stay in hk, but to no avail. Thank you young man, that may have been the best cookie of my life.

    Considering the reason why it's illegal, you should be able to open them and remove the toy from the chocolate shell as then you're just bringing in chocolate and a capsule containing a toy. Probably wont work if you wish to sell them (unless you're selling the toys to collectors maybe) but should work well enough to surprise some friends and family. If you carefully seperate the two halves you might even be able to reasemble them with a little melted chcocolate or melting the edge on a warm surface or something.

    One odd thing about the American court system is that a person or company can't challenge a law in court unless they have been legitimately affected by that law. This is probably why Nestle chose to release their product in the US despite the FDA's explicit warning: so they would have standing to challenge the law in court.

    Nestle Magic were rebranded as WonderBalls, a personal childhood favorite treat of mine which was filled with tart candies and a sticker rather than a toy, and this have recently come back after a 12 year disappearance.

      @TheBoltMaster What I gathered is that it's not so much this item as it is that the law still has a valid purpose and there is no legitimate reason the toy is nessicary for the food to serve it's purpose.

    I remember that everytime I had a Kinder Egg as a kid I had to ask for help to open the little pod where the toy is and since it was a weekend treat the whole family was there to watch me build whatever was inside, my grandparents would even help me build it or play with after, they still buy me Kinder Eggs every once in a while because my grandpa likes the toys and I like the chocolate.

    Hey Simon, could you do a video explaining how it is that tracking dogs, like the police use don't suffer from olfactory fatigue? You have explained in several videos how humans are particularly adept at ignoring our own smells, and in general all unpleasant smells after only a short time. how is it that these dogs can remain on a scent for so long without going "noseblind" to it?

      Simple, the idea of going "nose-blind" occurs after smelling the same smell for a very long time, over days, but dogs only smell the thing they are meant to detect every once and a while and are rewarded when they find it so they are encouraged to look for it.

      I don't even know how to explain it, but it tastes like heaven.

    I wonder if US customs would allow you to bring in the disasembled chocolate eggs (i.e halves separated), and the "toy capsules" if they were separate. It is not that difficult to open the chocolate egg without breaking it, so you could later re-assemble them - just smear the edges of the egg halves with a warm knife and they will stick together.

    The answer to the question "Why is X Illegal in Y country?" is always either because they promoted an idiot to a decision making position, the government is attempting to generate an exaggerated sense of fear towards something that is harmless in the hands of a reasonably intelligent human being in order to divide politicians political opposition, or because Z political donor(s) asked them to. If one of these three is not the case then you wouldn't be seriously asking why it's illegal in the first place.

      Andrew They didn't choke on the capsule. They choked on the toy after it was extracted from the capsule by someone else.
      The capsule is made tight enough that an underage kid can't open it by himself. You need an adult or at least an older brother/sister to open it and get the toy.
      As stated in the video this is less harmful than a hot dog or Xmas decorations on a cake. So the only true reason for banning it in the US is protectionism and lobbying by Mars Company.
      We have the same anti-choking regulations as the US all over Europe and Kinders sell by millions here.

      Well, the law has it's purpose, and for the most part, it's a pretty good law. The section in question is to keep foreign objects out of food that could pose a choking or digestive hazard that probably wouldn't fall into other categories (like poisonous) that would have prohibited it. But, the law was crafted in 1938, and the world changed a lot since then. I am not sure if/when the last time that law was updated, but now is probably a good time to give it a thorough shakedown.
