I still don't understand why console manufacturers don't sell their own emulators, and make it easy to buy digital copies of games for the consoles they no longer produce.
Sega has done this to an extent. Their Genesis collection on steam contains all the ROM files unencrypted so you can choose to play on a different emulator if you want, although the catalogue is not comprehensive. They even have Steam Workshop support enabled so you can play ROM hacks in an official capacity.
They are as of late. Konami, Capcom, Sega, SNK, Namco, and Nintendo have all released ways of playing SOME of their games on modern systems. Though Nintendo is the worst/most variable in terms of emulation quality because they do it in-house rather than through devs like M2, Digital Eclipse, HAMSTER, or Code Mystics like the others do. The problem is whether it's due to licensing, lack of interest, or hardware issues (ie lack of 2 screens for DS/3DS games), it's all still a fraction of a fraction of their actual libraries and each platform's library in general and are usually (at least in the case of VC/NSO) pretty barebones. Like, outside of dodgy online mp there's nothing noteworthy about NSO. You can't even do relatively simple stuff like remove sprite limits.

Not defending them at all or saying I don't think they had bad intentions but that wasn't very much ammo for someone who is a recreational shooter. Two boxes of .223 ammo would run out fast granted the shotgun ammo was more significant. I could realistically see someone dumb enough to make the jokes they made being dumb enough to not look into the gun laws in Massachusetts and just leave all their shooting gear in the car when going on a trip. Having said all that I don't believe that they had zero intention to do something bad after registering at the event, they were probably on the fence because they were afraid but wanted to do it.

News outline can be dumb sometimes, in this case they literally made stuff up. I followed that case with Gary Bowser closely when it was going down. A friend of mine was part of Team Xecuter and was involved in all of that mess. He didn't spend any time in prison, but he did get sued by Nintendo for a hefty sum that he'll likely never fully pay off.
Don't worry... his descendents (if he has any) will continue to pay it off, if he doesn't have any there are his other relatives cousins/nephews/nieces and their descendents

I started using emulators and ROM back in 1994 as a kid. First time I've ever seen a company take issue about it. My understand of using ROM was as long as you owned the game is wasn't a problem. I haven't bother with ROMs for well over a decade. Kind of sad to hear the company did that in fear that some titles from my childhood may never be seen again.
It's legally a grey area. Owning the cart doesn't give you the right to download a ROM. You have the right to back up your copy of your software, but you don't have the legal right to reverse-engineer a cart to copy the ROM.

Worth noting that a the vast majority of the hacking/modding scene (if not the entirety of it) despised Bowser and Team Xecuter because they were strictly for-profit. One thing you'll learn very quickly in the hacking, modding, and emulation scene is that it is a community that values open-sourcing and collaboration, and Xecuter being for profit meant they were totally unwilling to share ANYTHING with the hacking scene purely for the sake of being able to line their pockets, because the minute regular hackers in the community figured out exploits their tech became obsolete. So basically, the only people that liked them were non-tech-savvy people strictly looking for easy piracy and willing to pay for it. Everyone else hated them. So while his punishment was ABSOLUTELY overblown, not a many tears were shed in the hacking scene when they got busted. A lot of people were even happy to see them finally get axed... me leaning more towards the latter. It's a weird case where both the hacking community and Nintendo are happy to see hackers behind bars. They aren't Martyrs to us like a lot of commentary channels have made them out, they're rats that finally got what they had coming to them.
I mean who cares? They made money off things they were good at, how is that bad? Just cause they didn't wanna give away all their secrets for free? It's not like the existence of 3DS/DS hacking has killed the entire market for things like R4 cards, it's just *_diminished_* the demand. Literally monopolizing exploits for periods of YEARS helps nobody but yourself. I'm not one of those in-denial cringy dudes that acts like piracy and game preservation isn't at least a core motive for most efficient hackers and devs, but piracy was literally all Xecuter's tools were good for. Most of them couldn't even run homebrew (not that that's a particularly big loss, but still) because despite their claims opening up the console to anyone was never the goal.

I wouldnt say the second one was people who "lost everything to nintendo". They lost everything to their own decisions. And that one person who had a few conversations with the guy saying "he's a chill guy who likes to joke around" does nothing for me. It's one of those "they were good to me" situations. "This person was nice to me, so that must mean they were nice to other people too" which just isn't the case. You have horrid criminals that don't harm their family, but have no problem harming other people they don't know. And ultimately, you never truly know who someone is when you only see what they want you to see (e.g., influencers).
The punishment he received was onerous. He got 4 years and had to pay $10,000,000 even though he'd never really hacked anything and only earned $300,000. I think a year in prison and paying the money back, for a first offense, would be more reasonable. As for Kevin and James, I agree completely. If they were joking, why did they take the guns to the tournament?
I’d say fan games get it the worse many people working hard on projects that could take months or years just for Nintendo to walk in and shut them down

For me, this is also a case of media overblowing fan games when they should be quiet. AM2R was in development for years and had downloadable versions for years. 2 or 3 days before release of the full version news outlets blasted this game as much as they could. Result: Taken down after 40 Minutes. Same with SM64s HD remake for the PC Or with Pokemon ... Monochrome(?) Tge list actually goes on.

They never shared any of their exploits with the community, STOLE from the homebrew and hacking community, built ransomware into their devices, and it was all being done purely for profit. Bowser is basically ratting the rest of them out for a lighter sentence, which is to be expected given the charges are things like wire fraud and money laundering on top of piracy. This isn't just a "hacker piracy" case, this like legit criminal activity that just happens to involve hacking. Yeah... If they were just providing ROMs, they'd have more leeway and community support. Obviously it wouldn't save them from legal punishment based on the examples in this video, but it would be less likely for the punishments to be this severe. Replicating and providing hacks for company products that you don't own, and trying to profit from it is just asking to have the book thrown at you. You can't even make the claim of "the pirates likely wouldn't buy the game anyway", because the hacker group was charging for their services. Sure, it probably wasn't as much as it would've been if someone bought every individual game they had, but still. The punishment Gary Bowser got is way too much, but I can't have complete sympathy for the guy. He's also a guy in his 50s that's been doing this for years, not some young kid or young adult hard-up for cash or some junk. Tbh, Japan has been notorious pro-copyright and Nintendo clearly reflects that. People do take it way too seriously and often side with the “community”although in reality there should be nuance.
This video has understandable legal actions. There are other videos covering how Nintendo has treated the smash community. Those would be better examples. Those where no one did anything illegal except love a game and want to have a tournament. Or modify a game for free to make it more fun.
A better example would have to be the Smash Community drama by Nintendo or the JoyCon Boyz edition JoyCon controllers where the money was going towards suicide prevention
The last story is the most interesting. For many years, it seemed no one had any problem with the plethora of ROM sites in the wild. They couldn't care less about the old stuff, and certainly had no interest in providing hardware to continue to play them. Then, when publishers finally got the lightbulb FROM those same websites for how they could make money out of thin air for their own previously-forgotten and discarded IPs, THEN they became litigious. It's one of those 'mysteries' that makes you wonder if some of the publishers actually WANTED the ROM sites to exist, to keep an underground of young people hooked on games...until the time it was no longer useful to them, and they had hardware and software positioned to make money from it.
Well they could by makign a superior emulator that runs on PC... and have it on steam and sell all the old games on steam... Be making money by the truckload.

Always found it funny that the company most protective of it’s massive library of games is also the same company who most promotes piracy by keeping that same library locked away behind impossible to purchase paywalls. Want to play a niche old game? You either pirate it or pay up big money in some cases to play the not for sale anywhere game. Think about books and libraries: it is true book publisher have the right to manage their publications, but we still have public and private libraries with different reaches for people to access a lot of those books. There is an interest from the larger community to have access to general knowledge and history, so much so book publishers have deals to make books accessible to those spaces and many others. Im not defending book publishers, they are as greedy as the next bussiness owner, but these agreements exists and are understood as needed. These agreements also play to other scenarios: what happens if a publisher dissapears? are we losing books and therefore losing history? how do we avoid this? these are also libraries main focus. Now... apply that to games: aren't games worthy of public access? aren't games worthy of historical safeguarding? why book publishers and other media companies like movie producers can agree with these sort of agreements but videogames companies wont? are games then less valuable media. It is not only a black and white issue. There is a lot in which Nintendo is in the wrong here.

I still don't understand why console manufacturers don't sell their own emulators, and make it easy to buy digital copies of games for the consoles they no longer produce.
Sega has done this to an extent. Their Genesis collection on steam contains all the ROM files unencrypted so you can choose to play on a different emulator if you want, although the catalogue is not comprehensive. They even have Steam Workshop support enabled so you can play ROM hacks in an official capacity.
They are as of late. Konami, Capcom, Sega, SNK, Namco, and Nintendo have all released ways of playing SOME of their games on modern systems. Though Nintendo is the worst/most variable in terms of emulation quality because they do it in-house rather than through devs like M2, Digital Eclipse, HAMSTER, or Code Mystics like the others do.
The problem is whether it's due to licensing, lack of interest, or hardware issues (ie lack of 2 screens for DS/3DS games), it's all still a fraction of a fraction of their actual libraries and each platform's library in general and are usually (at least in the case of VC/NSO) pretty barebones.
Like, outside of dodgy online mp there's nothing noteworthy about NSO. You can't even do relatively simple stuff like remove sprite limits.

Not defending them at all or saying I don't think they had bad intentions but that wasn't very much ammo for someone who is a recreational shooter. Two boxes of .223 ammo would run out fast granted the shotgun ammo was more significant.

I followed that case with Gary Bowser closely when it was going down. A friend of mine was part of Team Xecuter and was involved in all of that mess. He didn't spend any time in prison, but he did get sued by Nintendo for a hefty sum that he'll likely never fully pay off.

I started using emulators and ROM back in 1994 as a kid. First time I've ever seen a company take issue about it. My understand of using ROM was as long as you owned the game is wasn't a problem. I haven't bother with ROMs for well over a decade. Kind of sad to hear the company did that in fear that some titles from my childhood may never be seen again.
It's legally a grey area. Owning the cart doesn't give you the right to download a ROM. You have the right to back up your copy of your software, but you don't have the legal right to reverse-engineer a cart to copy the ROM.

Worth noting that a the vast majority of the hacking/modding scene (if not the entirety of it) despised Bowser and Team Xecuter because they were strictly for-profit.
One thing you'll learn very quickly in the hacking, modding, and emulation scene is that it is a community that values open-sourcing and collaboration, and Xecuter being for profit meant they were totally unwilling to share ANYTHING with the hacking scene purely for the sake of being able to line their pockets, because the minute regular hackers in the community figured out exploits their tech became obsolete. So basically, the only people that liked them were non-tech-savvy people strictly looking for easy piracy and willing to pay for it. Everyone else hated them.
So while his punishment was ABSOLUTELY overblown, not a many tears were shed in the hacking scene when they got busted. A lot of people were even happy to see them finally get axed... me leaning more towards the latter. It's a weird case where both the hacking community and Nintendo are happy to see hackers behind bars.
They aren't Martyrs to us like a lot of commentary channels have made them out, they're rats that finally got what they had coming to them.
What a bunch of assholes expecting to be compensated for their time and capital.
Tbf the one thing for praise about them is the fact it made it more accessible to the "normie" and easier to do than many other mods/hacks

I'm not one of those in-denial cringy dudes that acts like piracy and game preservation isn't at least a core motive for most efficient hackers and devs, but piracy was literally all Xecuter's tools were good for. It's one of those "they were good to me" situations. "This person was nice to me, so that must mean they were nice to other people too" which just isn't the case. You have horrid criminals that don't harm their family, but have no problem harming other people they don't know. And ultimately, you never truly know who someone is when you only see what they want you to see (e.g., influencers).

The punishment he received was onerous. He got 4 years and had to pay $10,000,000 even though he'd never really hacked anything and only earned $300,000. I think a year in prison and paying the money back, for a first offense, would be more reasonable.

Yeah... If they were just providing ROMs, they'd have more leeway and community support. Obviously it wouldn't save them from legal punishment based on the examples in this video, but it would be less likely for the punishments to be this severe. Replicating and providing hacks for company products that you don't own, and trying to profit from it is just asking to have the book thrown at you. You can't even make the claim of "the pirates likely wouldn't buy the game anyway", because the hacker group was charging for their services. Sure, it probably wasn't as much as it would've been if someone bought every individual game they had, but still.
The punishment Gary Bowser got is way too much, but I can't have complete sympathy for the guy. He's also a guy in his 50s that's been doing this for years, not some young kid or young adult hard-up for cash or some junk. I wonder if his associates always intended to use him as a fall guy, or if they just took advantage of the situation to save themselves.

The last story is the most interesting. For many years, it seemed no one had any problem with the plethora of ROM sites in the wild. They couldn't care less about the old stuff, and certainly had no interest in providing hardware to continue to play them. Then, when publishers finally got the lightbulb FROM those same websites for how they could make money out of thin air for their own previously-forgotten and discarded IPs, THEN they became litigious.
It's one of those 'mysteries' that makes you wonder if some of the publishers actually WANTED the ROM sites to exist, to keep an underground of young people hooked on games...until the time it was no longer useful to them, and they had hardware and software positioned to make money from it.
Well they could by makign a superior emulator that runs on PC... and have it on steam and sell all the old games on steam... Be making money by the truckload.
Nintendo is that person who says "these are my OC's. DO NOT STEAL!" but with actual power.

Im not defending book publishers, they are as greedy as the next bussiness owner, but these agreements exists and are understood as needed. These agreements also play to other scenarios: what happens if a publisher dissapears? are we losing books and therefore losing history? how do we avoid this? these are also libraries main focus. Now... apply that to games: aren't games worthy of public access? aren't games worthy of historical safeguarding? why book publishers and other media companies like movie producers can agree with these sort of agreements but videogames companies wont? are games then less valuable media.
It is not only a black and white issue. There is a lot in which Nintendo is in the wrong here.
