    This is the first time I've seen someone describe the spirit of what fair use is supposed to entail eloquently. It's understandable a company wouldn't want you reposting their music and just getting paid for that... that's obviously copywright infringement. This, on the other hand, helps the describe the many cases where DMCAs are filed, wherein the music or IP in question is not being abused in this way. I don't think that companies even file the DMCA against transformative works on purpose much of the time (as far as I'm aware, automated systems are responsible for the majority of flagging), it's a growing pain that TH-cam and Companies have tried to maintain balance on... some decidedly more successfully than others.

      And you should be able to use game footage from your own game since you bought it and can do whatever with it. But for some reason, game companies don’t understand that.

    I heard some youtuber say, that he turns off the music of the game bc it gets claimed even though the music is part of the game. So playing it's best to turn off the music in the game.

    Thanks a lot for the breakdown though I have a question; Is it ok to extract a game's licensed music (not created by the developers, but normally allowed to be streamed in gameplay videos) and then place it over another portion of a video featuring that game? For example, what if I extracted the licensed menu music and placed the audio over gameplay? Seems there's a bit of a grey area nobody knows about when it comes to licensed music that is not owned by the devs and what we can do with it.

    Do you know if it is legally possible to use video and audio from multiple things of a franchise for a tribute video while putting in your own narration (not really the same way as normal streaming commentary) between the voice acting and the music? Does that fall under the same transformative category?

    Great! I am constantly learning reading studying researching this endless area. Despite being a label with copyright holdings of master recordings I still get META / Instagram blocking me or emailing me with Copyright Violation. And so I must become aware of it all, in order to ensure everything I post or make public conforms to all the appropriate laws out there and to ensure my artists music as well as my own is protected. I actually have a different channel which is where I do my let's plays, and for some reason on my most recent series I keep getting audio copyright claims. HOWEVER, the claims aren't from the team that made the game. Instead they're from totally different third parties and the BGM does sound similar. They didn't claim the entire video, but they did claim specific sections, PRIMARILY parts where I was lost in thought and not super talkative; for example one section they claimed was during a boss fight. What are your suggestions on this?

    Fun fact: an Indonesian tv program "Jejak Petualang" uses Chrono Cross musics oftenly. And the same TV channel (Trans 7) used JRPG musics from PS1 PS2 and SNES to Wii in Cita-Citaku (wasn't aired anymore around 2014 ago), mostly Nintendo in Laptop si Unyil 2007-2013/2014, and some PS1 games and some Nintendo games in Buku Harian si Unyil (2007 - around 2012 or below, weekend edition of Laptop si Unyil with the name seemingly inspired from Wimpy Kid). Search by yourself and you'll be amazed

    Hi, do you have information on how to deal with games with video clips embedded into the game, eg if I play a Lego game as a let's play, I'm talking and reacting to the chat, the music is low, everything is fine, then you get to points in the game and it jumps to clips that was in the film's? But it's also part of the game? You get hit with the copyright right ID claim multiple times in one video? How do you deal with it? You have a personal paid copy of the game on disc and digital download, you put in as much information as you can, like how made the game, the companies, the sounds and clips etc but still hit with ID claim? Do you just cut your loss and walk way or do you fight it under some legal knowledge, as reached out to the companies for advice but get told it's not their department or they can't help to the best one don't make a video on it?

    I'm just curious about rhythm based music games (Rock Band, Guitar Hero, Beat Saber and Ragnarock VR) and if they somehow fall under Fair Use or a different sort of agreement? I enjoy making Ragnarock content but unfortunately I keep getting a copyright warning (saying I cant monotize the video, which makes sense) and I fear it will turn into a strike eventually. Any suggestions or tips? I am not worried about monetizing, just want to make sure I am safe making this content.

      It's rare for in-game sound effects to be blocked in your video, but it can happen. I had one video, The Last of Us, flag a scene where a specific sound effect began to play. I had no choice to remove that small and brief segment. It wasn't really a big deal, but it can alter your video a lot or a little. I'm just sharing my personal experience. I hope this helps.

    When editing a video, it's ok to add video game music, even older ones, to your videos? I've seen a lot of Gmod videos and they used them as well, nothing happened. I guess as long as you credit the music, everything's fine, or you need a license to add it in your video editor?

    Thank you for providing this information, it is hard for a layman to really find out what to do. My channel is TINY, just started, so I get those claims en-masse. Problem is that fallout 4 has a radio in the game, with various real world songs playing, so I get claims for each song you can hear in the background.

    I'm just curious if, the fair use policy goes with music already in the game and I streamed video to twitch with no problems then export it to youtube and now, it is now a issue. This was never the case when I uploaded a game play video directly to TH-cam itself.     I played Assassin’s Creed IV Black flag, and the ship boarding music played.

      Ha! next time mute the sound. I have met so many TH-camrs like you who unintentionally have background music in their videos -- actually, it is totally legal and does not violate copyright law BUT YT's Content ID picks it up and puts a claim on it.

    Hi Ian, this doesn't really have anything to do with TH-cam, but we're making a short film for our Abitur (finals in German schools). I would love to use video game music (f.e. God of War). Do you know if it's possible to purchase rights to songs for one occasion? We'd probably be looking to sell the DVD to our classmates by the way.

      Iana, but Designer: Wenn es sich um ein Schulprojekt handelt und kein kommerzieller Vertrieb stattfindet, sollte es klar gehen. Veröffentlichung im Internet sind wiederum ein anderer Schnack. Da kann es auch durch Monetarisierung und Vervielfältigung zu Problemen kommen (Einnahmen durch Werbung, Verletzung des Copyrights).
      Tldr: bleibt es in der Schule kräht i.d.R. kein Hahn danach
      willst du persönlich Gewinn daraus schlagen - nicht ok

      Yeah, you can use it no problem as long as you're adding your own spin on it while crediting the original source. Think of it like when you're writing an essay and you need to cite a source. The same works here. You are citing the source of the music and this allows people to find it too.

    I used the music from Rogue Company not for a let's play but a review... Only reason I did that was to have the viewer know what music is in the game as it makes a part of the experience and then it got claimed. This annoys me

    Those websites you suggested are very good however they are very expensive. On epidemic right now you can purchase their service for $9 a month however it's billed at $108 per year. I'm just starting off with my TH-cam channel I don't have that kind of money.

      If you make your own jams, yes you may do that. Now if you use samples, loops, sound files, effects, etc, and they are stock and not altered in any way, you might get hit with a claim.
