  • Fair Use on TH-cam - BEST Tips for Avoiding Copyright on TH-cam!!! // Have you ever wanted to use someone else's video or music in your own TH-cam video? Welcome to today's video where I discuss fair use on TH-cam -- this is called Fair Dealing TH-cam in Canada, England, and Australia. Avoiding copyright on TH-cam can be hard for creators. The bottom line is that you want to avoid at all costs a TH-cam copyright strike. In this video, we define "fair use" and delve into some of the more issues relating to fair use copyright. TH-cam Fair Use cannot be discussed fully without acknowledging that Fair Use on TH-cam videos put out by other people do not really give the answer to the question most creators have "How Does Fair Use Work on TH-cam." This tutorial is a sort of "Fair Use Explained" video. I provide Fair Use examples. I give you some links to some Fair Use videos TH-cam. I also briefly discuss Fair Use music for TH-cam. By the end of the video, you will understand that avoiding copyright on TH-cam is extremely important -- and my FREE checklist will show you exactly how to do it!

    I find a really good way to make use of short clips from pop culture/movies is to make your own audio to go over the video clip. If the quote from the clip is what you need, you could read it yourself. Extra transformation like this just makes it easier to prevent corporate bullies from coming at you or algorithms false flagging.

    When I made my first youtube short, I didn't just get a copyright strike, I got my channel taken down and privileges for being able to make future channels taken away. I think the reason why is because I used the audio of a Bo Burnham song at the beginning-- but I both put my own captions on to simulate dialogue the way many creators do on Tik Tok and Instagram shorts, and the very next sentence was commenting on the lyrics- "This song captures a feeling I think a lot of us have..."
    Even if I was in violation of fair use, I'm happy to take the video down, but it feels unfair for my whole channel to be banned and for me to be unable to make future TH-cam channels.

    I had a music video of mine taken down once by YT for copyright but I was able to prove that my music video had predated the claimant's published music by a couple of years and was made using the same music creation program. So it was possible that we had both independently come up with pieces that sounded similar in places. The main difference was I just posted mine to YT as an unknown indie artist while the other person's piece was released by a music publishing label. However, YT did reinstate my video.

    hi, can you help me.. I was inspired by a youtube short and added my own version of that short. I used the same song that he doesn't own. and maid my own short. there are maybe 5-6 seconds of the video that are similar. it's the only thing. and I got a strike on it.. it was a vs battle video and I used a completely different character than the one he used.. is it my fault or can I complain

    I still don't get the copyright system cause some say you need to just give credit to the original Song writer and some say you need to pay so it's really hard to know the right way..Also i'm from abroad and it's not eazy for me to find out all the MLA information but thank's for the video

    Do you have any tips for using book quotes in videos? I try to keep book quotes short when I add them (sometimes I read a small passage from a book, sometimes I just show the passage onscreen) that can be a bit harder change or take out of context.

    Hi Ian! Loving your videos - thanks for sharing all this info. I have a question though: if I do movie scene reenactments and substitute the other characters’ lines with the original movie clips (but keeping it short and only the necessary bits) would that get a copyright strike? I’m just worried because by the nature of a reenactment it wouldn’t take the copyrighted material out of context, but then again I am building on the original art.

    Thanks for explaining! but I have a question, what happens if we follow what you said, but the original content owner sees a video clip in another video (it's short, less than 8 seconds) and the video is muted as there is a voiceover over it and relates to a different story line, the original own content requests to take it down. What happens here?

    So if theres an image thats perfect for what I want to do but the original owner has it littered with text and logos, does photoshopping the unwanted text out leaving just the raw image count enough as a modification as long as I credit the source? The example shown in your vid had someone add to the image. But does subtracting from it work just as well? I know it sounds like a dumb question but youtube likes to play dumb games and Im taking no chances

    A question: Is it possible to appeal a copyright claim after the disputed videos were taken down by myself? I removed them after I received a copyright claim for a number of my videos, but I feel I should appeal as the vast majority of these videos were parodies and I feel fall under the Fair Dealings legislation of the UK. It seems as if I may have been too hasty in removing the offending videos as there seems to be no process for appealing AFTER the videos have been taken down.

    Now with "transformation" being a requirement on copyrighted art, what if someone were to take a copyrighted song, slow it down and add some reverb and effects to it? ("Slowed + Reverb" music channels are everywhere on YT now). Would that count as transforming art to make it your own and qualify under fair use?

      Cool! I have found myself binge watching your videos, over the last 7 days or so, lol - Really trying to educate myself, and soak up this important information... I do have one question, a really good friend of mine, called me a few hours ago, and said that when he woke up this morning to log into his account, that TH-cam said that it was terminated! He's EXTREMELY puzzled, and confused as to why this happened, as he is someone that STRICTLY follows (the rules of society, as well as) TH-cam rules and guidelines. He said that he sent them an immediate message to appeal it, and explain his case, and explain to them the last thing he did on TH-cam, before going to bed. And I told him, that I would look through TH-cam to see if I could find anything that could help him out. Is there any advise that I can give him? (Oh, and side note, when I asked him if he had ever received any strikes by TH-cam, and he said he's never received any).

      Hi LordThanos!! Thanks for watching. 👊😁 I get asked this question a lot and it's not an easy question to answer. The 2 main reasons the clips may not have been taken down is because 1) they have permission to use the clips or 2) they are a monetized channel and are being allowed to use the clips, but are not getting any money from the views. I hope this answers your question.

    Hi Ian. My friend has been getting lots of strikes as he's broken so many laws, based on copyrighting. He posted videos of us when we were little without consent, and now he's posting videos of films. I'm really concerned about him ending up in court. I'm going to share this video with him right now.     Serious question. I regularly run a karaoke night but due covid lockdown it’s been put on hold. I decided (last week) to live stream “in the style of” karaoke tracks for my regular patrons. Of the 30 songs I played, around 10 were flagged saying I couldn’t monetise the video (which I can’t anyway due to having single digit subscribers) but one song was flagged, baring the video from being watched after the stream finished. Next time I do this, if I attribute every song I play (song, artist, publisher) in the video description (on the fly before the live stream ends) will this get around the YT bots????

    Hello when you say "Transform the original meaning of the others work into your own meaning" does that apply to thumbnails as well? I was wondering about becoming a vlogger or something on tiktok or youtuber and i want my first video to talk about giving a story about how this guy in my highschool got a weed tatoo and i wanna use a thumbnail but slightly adjusted or maybe not even changed of that of a different famous youtuber who was doing a prank on his mother by getting a weed tattoo. I also want to know can we use the exact same thumbnail as them but different meaning like you said and if not, should we adjust the thumbnail by adding some features? please help me

    Thanks for the great info, Ian! I'm a film scholar and want to review the performances of specific film actors and show clips to explain my analysis.I've noticed some content creators pull up a video they're reviewing on their laptop and make it a PIP (Picture in Picture). Is this OK? Does this fall under the "creating a new piece of art" category if I add the clip as a PIP? Or, is there another way to avoid legal problems? I've been holding off for a long time because I was unsure of the legal ramifications. Please help!

      Ian Corzine haha hopefully they won’t mess with an attorney. I actually just disputed 3 claims after watching this. Hopefully they see my stuff as transformative. I just don’t see how they get away with claiming a whole 10 minute vid for a 6 second segment of a meme that I made that doesn’t even use the context of the songs. It’s always very transformative though so hopefully they release the claims

    Hello Ian, good night.
    I've tried to do a channel recaping mangás, but unfortunatly got 2x strikes in it. Watching your videos noticed that they lacked the points for fair use, because I was mainly narrating the full story, without any opinion or commentary in it.
    Now I'm trying to find out how could I do it, and create a new channel with more knowledge of legal terms and copyright...
    Now I'll be using fewer imagens (2 to 5 seconds), but don't know how I could adapt it with the scrypt, because I used the stories text to help create the scrypt it was like a narration. Do you an idea of what I could do?
    Maybe I could narrate and add some commentary on what's happening at the story at the point, or maybe critique some decision of the character, but it'll still have the narration..

      Yeah because they think that you're just uploading a clip for others to watch, so to avoid this you can move the screen you're watching the clip on so you can see a bit of a background (shrink the screen basically) 😁

    So I am doing a gaming channel, and very few times do I ever get hit with a copyright claim, and those few times I did I did have the music off yet somehow something playing in the background (ambient music uncontrolled by the music option) is what got me hit with a copy right strike.
    So

    Don't suppose you have one of those that fit for games do you? Like I said the few times I got hit with a copyright claim was because something was playing in the background that one would not think would be a issue. (The last one was as I said ambient music played during a mission.)

    Some quick questions: first, suppose I have a channel for an educational purpose (but then for some reason it gets a lot of subscribers and hits), and in some clips I use some figures from studies in scientific journals, will it be ok?
    Also, the same scenario, but suppose I use images I find from Google, will that be ok?

    If I have 2 channels, does a copywrite strike stay with the channel or will it apply to both of my channels? Also, the strike said permission granted. It was the song There Goes My Hero, by The Foo Fighters, in my son''s Memorial. He was a Marine. If I got permission, does that mean I have a strike or not? Did permission come from The Foo Fighters?

    I have a few cases i need to know if they could be concidered "fair use" or not :
    1) playing copyrighted music/song but with slower/faster tempo and/or different instruments..
    2) using instrumental from a song or videogame music and singing over it as karaoke or with original lyrics..
    Im asking cause i need to be 100% sure, so i need a precise answer bout those specific cases.

    I'm an amateur musician. In the past, I've tried using my own crude form of attribution. Yet although I never got a strike, I got a few warnings. It's never been my intention to violate anyone's copyright. I would use the material just to benchmark my own performance. Thanks for your explanation

      It's sort of tricky if for example the policies change if everything was alright before. That's how I got striked. It seemed like all was well then from nowhere the copyright policies were changed bummer.

    Care to update this a bit? In 2022 it seems YT prefers to just block a video with copyright material until the TH-camr disputes it based on fair use grounds? Or is that just me? They seem to claim every little bit of it and I have to dispute..
    Also, I wonder if there is a way to permanently set sth as "owned" by me. I purchased some music on licence and have to input a dispute everytime I use it!!

    So I’ve started doing montages on my channel of tv shows with music in the background. I have edited them and modified sound and some speeds and cuts and stuff. Does that mean I still have a chance of getting a copyright strike? I got one already in December of 2017, but I’m worried that if I make enough montages that I can get three at once! Am I doing anything wrong? Should I be taking more precautions?

      You need to be very careful. TH-cam has really been cracking down on anything and everything that doesn't abide by their rules and guidelines - AND it seems they are not even giving the creators notice or a chance to correct their mistakes. Yes, you can get 3 strikes from one video and lose your channel in one day. I would suggest you familiarize yourself completely with the Fair Use and copyright laws.     The Free to Use Act, didn't say anything about having to change the content. It says you have the right to use copyrighted content as long as its for educational, entertainment or general information purposes, and as long as you are not making money off of the copyrighted material. Now seeing as they are protecting themselves from lawsuits by violating citizens rights, by hiding behind a corporate policy, which has no law behind it. And presuming guilt over innocence, which is a constitutional violation, they are assuming their liability is protected. But as it is the private company asking for the strike, it is up on them to prove the violation of policy, not the other way around. The police can claim/charge me with a crime but the burden of proof is their burden. And corporate policy does not trump Constitutional Law/Bill of Rights.
    I see no reason why a content creator, can use any copyrighted material for entertainment/educational purposes as long as the creator does not make money off the video. Which is what the Free to use Act states.
    If Google/TH-cam want to avoid legal action they should weight the bigger liabilities, corporations and copyright laws, or citizens and both Constitutional laws and Bill of Rights violations, plus if it's a continuous unsupported violation, then there is a liability for defamation of character, another law. So 3 legal issues versus 1 maybe a violation. These companies who are abusing TH-cam's policies, are going to get Google into legal trouble. So they need to pick the side of less resistance. Because, yes TH-cam does not charge to put videos up on their sight, but without the content creators videos there would be no use for the TH-cam website.

    I'm planning on starting a video essay channel, and wanted to use clips from movies and tv shows in my videos. Obviously, I'll be commentating over them and transforming the work by commentating on it, but I was wondering specifically about filler clips, or clips to just have muted on screen while I'm not responding to it directly.
    For example, my first video is on how DC's Stargirl Created an Awesome Main Character, and I wanted to start the video with a clip from an episode of the main character's family moving into their new house. Is this legal? Can I use this clip in this way?

    I've posted 50+ COPYRIGHT claims using TH-cams form. In most cases it isnvolved 90-100% of my videos being re-uploaded, usually by South Korean or Indian TH-camrs, with little or no modifications of my videos. (most of the times just a short intro to the video, or added subtitles to explain what kind of food or whatever the subject of my videos is.
    (at this moment, I have over 20 copyright notices from TH-cam who has registrered my videos eing re-uploaded elsewhere)

    I don’t think this works anymore with what TH-cam is doing nowadays, not to be mean, but I have seen copyright strikes for things that follow your information and are as short as 3 seconds, but anyway, thanks for doing stuff like this

      Hi Liam!! The tips still work, but you have to know what you are doing. Unfortunately Fair Use is not an exact science. There are no hard rules, but I am hoping that my videos help creators better understand how to use the laws correctly. I have several other videos that discuss Fair Use and copyright in more detail AND they are even fun and interactive. 👊😀

      I agree that many have received and will continue to receive copyright strikes for things that are obviously well within fair use. As Ian mentioned in the video, that's because these are financial decisions that have nothing to do with the law per se. TH-cam management obviously wants to cut their costs in dealing with copyright infringement/fair use claims. It is far more cost effective for TH-cam to create an algorithm that weeds out potential problems before they even start, than to have to pay skilled staff to investigate claims.

    My issue isn't music or movies but dialog content itself - I guess. I post videos with no visual and only audio that I have owned for many years and recently began posting them, however they are supposedly owned by Sirius radio and I received copyright notices but I never know exactly what it is within the content that's copyrighted so I can remove to avoid that in future postings. I always make sure there is no music and no celebrity interviews so I have no idea what in the content is being found in violation. Any clue?

      Example:(10-30secs.video clip)a small portion of a copyrighted work may be permitted as FAIR USE,nice to hear....but the whole work is not, bcoz the content or how you used it😄
      And this is not safe for commercial or for profit use,bcoz its still have a copyright and they hunt you in the future by claims
      Please don't insist,If you want worry free life on your channel..avoid using copyrighted materials😄
      Remember:FAIR USE is not an exception to COPYRIGHT LAW.
