    The real danger to this video is you left out easily the most important thing to keep in mind: in many situations, if you sell anything related to your channel, you’re a commercial entity by many standards. Fair use does not apply. Bc everyone has a contingent right the second you start profiting from the fairly used clip. People missing this can ruin their lives

      ACTUALLY.... Here on TH-cam at least, fair use CAN apply even if you are profiting - under some conditions. I'm no lawyer so this isn't legal advice - but all of my videos on this channel are monetized and I'm selling products in the description of every video. I very much understand getting demonetized - I had an entire voiceover channel that was demonetized - but there were flagrant violations. If you're using movie clips in a TV commercial - even if really short - ya, fat chance those would ever skate by. I'm sure you'd be hearing from lawyers that day. But on TH-cam, I think they cut us a little slack. I think it's more a matter of what prodution studios will allow. They want the good will of the 2 billion active users on TH-cam and go easy on us. BUT, in once sense you are right - there is NO guarantee once you start using copyrighted material unless you have written consent from the copyright holder. It is ALWAYS a risk. One I'm willing to take. So I tread lightly.

      @DankMcStank Use clips that are under 5 seconds, upload unlisted, and see if they get copyright claimed. If not, you're probably ok, but no guarantees.

    Thanks for the video Trevor! I used this along with another video of yours to upload my first video with movie clips. I have a long ways to go, but this is a good start. Making the clips flow and not be awkward and distracting is harder than it looks!

    So we know we should keep it short when using a piece of a movie, but what if we use a 1000 pieces of different movies? Is it fine because they're all short individually?

      Maybe? I’d test. Upload unlisted first. Wait to see what YT says before you make public. But there is never a guarantee. Anyone could come back years later and issue a takedown order.

      Well.... kind of. You can probably use clips up to 5 seconds, but will almost never get away with using long scenes. I'm not sure how the channels using long scenes get away with it. The may have consent from the studios. You MIGHT be able to get away with a longer scene, but most likely will get a copyright claim and not be able to monetize.

    Back with a few more unsolved answers lol. One of your steps to cover ourselves was to get permission to use the clips. How would one get that ball rolling? And once we get permission or give credit in description does that mean we can monetize the video or using clips automatically disqualifies the video for monetization. Really appreciate yr feedback in advance 😊

      It's super grey. I'm not a lawyer, so I can't give legal advice. Best rule of thumb: if it's not yours or you don't have permisssion, don't use it. But... If they are short clips and you're following the other stops you'll PROBABLY be fine - even to monetize - but there are no guarantees! It's always a risk! Permission? Just have to research it! For movie/tv clips, I've never done it! Way too time consuming. It's just the super safe way to to do it! Good luck!

    I made a review of Renfield (2023) and used clips transformatively throughout my video to address key points. But it was still hit by a copywrite claim.

      Ya... if they're over about 5 seonds (maybe a bit more) that's gonna happen... Keeping them super short has given me the most success in not getting nailed. Long clips and full scenes? Ya, you'll get hosed.

    what if you shot the footage yourself so you technically own it but it's from say a rock concert and even if you don't use the audio from the artist's copyrighted songs, but only the images, it still contains images of publicly recognizable figures as well as their branding and logos, band names, stage set up and so on?

      Same kind of rules apply. They MAY be able to call you out. If it's short, odds are you'd be fine. If you upload a full song, even with no audio, the artist might care. It will be hit and miss on something like that I believe.

    I have ALWAYS ALWAYS wanted to put movie trailers into my TH-cam film review videos without fear of being liable to copyright infringement. So is Fair Use my saviour?

      Basically but keep in mind every film and rightful owner is different.
      On my other TH-cam channel I review Sci-fi movies and usually keep it short and theirs no copyright claim.
      However their have been cases where I'll get a copyright claim but the owner of the film allow the footage as long as the video is demonetized and has ads. With them getting the profit.
      Secondly I have seen copyright claims that downright block the video worldwide. But do not impact the channel.

      What Papa said is accurate. Every copyright holder is different. Some are pretty lenient, others less so. There are no guarantees - it's trial and error with every piece of content. That said, I've used TONS of clips in my videos and if I keep them under 5 seconds, I've never had an issue on the 3 channels I've used clips in.

    Am I correct to assume you have access to a sort of hollywood search engine where you can pull out clips from a search box? Or did you single handedly locate each movie clip in this video? If so, where do you find one? Great video by the way!

      There is no hard and fast rule I'm afraid. Every situation is different. It for sure can't be a "substantial" portion of the movie/tv show. It's very grey and there are other factors to consider. I'm no attorney, so I can't give any legal advice. The reality is, in theory, you could use 5 seconds of a 2 hour movie and a claim could potentially still be made. I keep all of my clips very short and try to follow the other Fair Use guidelines. We all wish there were more specific "rules" so we could follow them, there just aren't. ANY time you're using someone else's material without consent, you risk a copyright violation. How close to the edge to you want to play? : ) I wish I had a better answer for you - just follow the suggestions in my video and watch videos from Ian Corzine. He IS a lawyer and can give you further guidance, but he'll likely tell you about the same things I'm saying here and in my video. Good luck!

    thanks for making this. Could you address then how you respond to a copyright claim. I made a trivia quiz for 1960s hits using 5-10 seconds sounbite from each song--got copyright claims for 10 of the 20 clips I used. What can I do? I see a bunch of other channels doing it? I reached out to them to ask, but they are my competition...thanks!

      I'm not sure, but I would guess either not monetized or have agreements with the studios. Probably not monetized. There may be ads, with ad revenue going to the studios.

    Hey Trevor - thanks for another great video. Do you have any tips for using music in the same manner? I've added popular songs to my fun, non-commercial videos and TH-cam bans them (Facebook does too) since the songs have a copyright. Any suggestions for getting around this?

    I make virtual recreations of movie sets, and use a couple of photos and mini clips from the real movie set I’m recreating and compare them both, will I get in trouble if I use a couple of seconds of a scene to compare my creation to the real one?

    I used a clip from a music video during a commentary/opinion video about what it was promoting to kids. It came up with a copyright claim even though it was fair use according to the guidelines. What can I do about that?

      The guidelines are insanely grey. No hard and fast rules other than this: The only CERTAIN way not to get a copyright claim is to get written consent. Anything over 5 seconds will very often result in a copyright claim, has been my experience. On the flip side, a claim is no big deal. Usually means you can't monetize it or that the ad sense goes all or paritally to copyright holder.

      @@MommyAnswerLady How much of the music video did you use? Also, TH-cam lets the copyright holder pretty much call the shots. "Clearly fair use" - applies to virutally nothing I'm afraid! My understanding is the only way to determine 100% if something is fair use is... in court. And hopefully none of us here will ever end up there! Sorry I don't have a better answer!     Im really sorry Trevor because my question to you was confusing and not clear, so please allow me to quickly clarify :- Music is not a copyright issue in my question since we are a family of musicians, and all our music rightly belongs to us and fully copyright. So I just wanted to know if using old film dance clips in the context of " fair use" can be to used "together" with our copyright music without confusing the two. As the music is copy right and the video clips would be "fair use" Can you tell me please if both can be used together in the same video ?

      Hey Grace - It's exactly the same as I say in the video. Using a small clip MAY be considered fair use, and following the suggestions I make you can increase your chances of it being considered fair use, but there is no way to be certain unless you post. Only a judge can decide if your use is fair use. Even if TH-cam's Content ID flags it, if you're only using 1 second clips I wouldn't think anything serious would happen. But there is always a risk - you always take a chance and there are no guarantees. Personally, I'd take the risk - which in my opinion is minimal - but I like to live on the edge. 😎

    Okay But even for a shorter clip, TH-cam is showing messages like "Your video won't be shown to anyone or can not be monetize". How to bypass this, Please suggest. These message are appearing in the Check option while the video is being processed for publishing.

    What about 5 minute scenes that are cut and have music played over them to amplify the original message? In other words, can I take 5 minutes from a movie and play a 5 minute song (That I'm allowed to put in my video) and create and amplify a very emotional moment that was already in the movie? for example Like those star wars edits with Anakin's transformation with some sad music.

      @@paperplay9744 When I say monetize I mean Google Ad Sense - which is where TH-cam pays you per 1000 views, known as RPM in your analytics. You MAY monetize/"get paid per view" with movie clips if they follow the fair use guidelines. Be remember, NO GUARANTESS, cause copyright holder can always call you out, even if YOU think it was fair use. Best advice: use clips under 5 seconds and wait for TH-cam to run it's checks BEFORE you make it public. Good luck!

      Movie clips: you'll have the best luck keeping them under 5 seconds. Music - possibly even shorter. I stay away from copyrighted music almost completely. YT seems more uptight about music than movie clips. I just use Epidemic Sound, like $15/month - link in description - but I know that doesn't help if you're wanting to review a popular song.

    I want to open my own youtube channel of suggesting movies. So can i use the movie clips of their particular movies? Because if i suggest their movies then in a way, their movies are getting promoted also. Suppose if i suggest The Wolf Of Wall Street and " everyone can find it on netflix " then they will also be promoted. Do i still need licensed copy?

    I screen record some clips that I use for memes and Everytime I upload them, I always credit the videos so I can mention that I’m not pirating, or plagiarizing. And to claim that the content is not mine at all. What I do is pretty correct? Right?

      The best practice is for sure to credit the copyright holder but between you and me... I never do it.. Takes too long. And I think the bigger factor by far is the length of the clip. Shorter is better. Like under 5 seconds in my experiecne. Unfortunately, there are no hard and fast rules. But yes, you should give credit to the studio for sure.

      Heck, not sure. TH-cam can SEE and HEAR your videos and compare it to pretty much every major tv show and movie on earth... so they for sure will know. But... you can just TRY it. post it unlisted on your channel, and they will very quicly tell you if you "passed".

      Maybe! I've found that if I keep clips under 5 seconds, I'm good. All the videos on this channel are monetized. You may be able to get away with longer clips with trailers - you have to test that out. TH-cam coming out with a new feature to tell you if you're clear or not. For now, just upload unlisted and see if you get a claim.

    How does Hollywood keep track of the video clips they use and when they are making a movie? Do they have a databace? How do they know what they used or didn't use?

      As far as TH-cam, TH-cam has something called Content ID. When you upload YT compares your video to it monster database - audio and video.

    Hey Trevor! I wanted to do a supercut of the film Evil Dead 2 in which I take each scene the main character is injured and use it in a sort of montage. This would use a pretty substantial amount of scenes, and I was wondering if this would fall under fair use. I wouldn't be monetizing it or anything.

      Probably not. Keep the clip short and odds are good you'll be fine. For a LONG clip, the most likely thing is you won't be able to monetize it. My experience is the usually don't pull down a video. On all my channels I think it's happned to me only once: I did the voice over for a disney special look - and posted it on my VO channel. Disney was not amused and as I recall, TH-cam yanked it. I didn't get a strike or anything.

    I was wondering if the audio of the clip you’re using (and talking on the top of) is silent and is only visual, does this make it less likely that people will sue or claim copy right?? Just curious to know as I’d love to do some video essays with shots of particular movies/shows as I speak over it - and is it even less likely if you slightly edit it?       Great question! Don't think that will help much. TH-cam SEES and HEARS it ALL. However, if you tweak the visual a LOT - like I explain in a video I'll link you to - as in tilt and blur - and it's silent, ya, pretty sure you can get away with more.       You would probably be fine. This isn't legal advice, but from personal experience, short clips like that are almost never an issue. I always suggest uploading as unlisted first and see what TH-cams's AI says. Then make it public once your cleared. But ya, I'd do that all day and not worry.

      Trevor here from my newer channel. The most important metric on TH-cam is watch time. If you can keep viewers on a video, YT will show it more and you'll grow. If they watch the whole thing? Gold. One of the best ways to keep viewers watching is with pattern interrupts. If you're just a talking head, people will get bored. If you change what they are seeing or hearing every few seconds, you're interrupting the pattern and the WILL watch longer. A funny quip is a great way to keep them engaged and watching longer. As long as it makes sense in the context of your video. Other ways are changing the angle, zooming in on the shot, adding b roll, adding graphics, and effects, changing the music and adding sound effects.

      A STRIKE? I highly doubt it. A copyright CLAIM? Maybe. There is literally only one way to find out. A CLAIM is no big deal. You can usually leave the video up but you just can't monetize it.

      I stick to about 5 seconds. But you can experiment with longer! I’ve NEVER had an issue with a 5 second clip.

    Thanks Trevor. Does uploading your complication video with the "Creative Commons" license recommended? In other words, would a video with the Standard TH-cam license have a higher chance of getting copyright claim or takedown request from copyright owners?

      If you don't own the rights to the footage, using Creative Commons would not be the right thing to do. Using Creative Commons tells the world they have the right to use the video - but you can't give away the rights to something you don't own. It's only for footage YOU have the rights to. Make sense?

    GREAT video...BUT...always a but...how do you tell us we can get away with :03 of 90 minute video...then tell us NOT to use the entire Star Wars movie? Duh. Where's the middle ground? Where's the legal ground? I know when you change a patent it's a 30% (if I remember right) change from the original. Does Copyright have something similar? If it's a five minute personal video can you use :50 on your different 5 minute video?

      From my experience, anything over 10-15 seconds MAX will have issues. No one you're gonna get a full scene up without at lease a copyright claim, and possibly even a strike. Good luck! - Trevor from my other channel.
