The derelict vehicle law seems like it would be in violation of the 4th amendment. If they can enter and search for "tags" on them whether they are in date or not . How can they search for a tag on private property without a warrant. If they can't read the tag from the road or street.
Question --- How the HELL do you work on a project car in that town ? If you were say building a kit AC Cobra car... you would be cited for pushing it out to the driveway to work on it ??? What the heck ?
Question for you (or for anyone), I can see the officer making the threat accusation being terminated and criminal charges for lying about the threat considering the Detective in question (or any officer) could of come up with handguns drawn and possibly even opening fire based on the threat allegation, why exactly was the detective fired for responding to a call made by an officer for responding to said threat? I mean, the Detective was going based on what the officer said and had no clue if it was true or not, I get that, but just not understanding why he was the one terminated for responding to what was said over the radio. Shouldn't that also fall back on the lying cop who started all of this?
Is he actually a cop? No body camera, no badge, he's wearing a t-shirt anyone can buy online or have made. All I'm saying is if this role player pulled me over I'd tell him to get a real cop with a badge and body cam, a badge alone doesn't prove anything. Sure you can murder me bud but that doesn't impress me much. Did you steal the police car from a real cop?
Issue is the first cop said the guy threatened him, this all stemmed from the first cop choosing inappropriate and wrong language. He also requested another cop to pull him over which was incorrect.
It's them programming the narrative.... Once they make the accusation, that's all they do is keep repeating.... You're not allowed to do what they accused you of...... They say all these things to use as articulation and justification when it comes to court
Yeah, he just blindly followed what the first officer told him, which in many cases I suppose is what you want, don't have time to investigate and question everything in the moment. But that dude was a dick. He should have at least questioned the first officer and made sure, they have radios and phones...
You can’t do that…why?….because….okay because why?….because of the law; of because & now you’re obstructing the law. I pulled this from a police training manual, the next chapter is copsplaining, how to win circular arguments with circular reasoning.

The fact that the cop is on camera and just makes things up. And then the chief has no choice but to void the charges to not have a lawsuit, but then still tried to say the cops acted in “good faith”? Right.
ATA did mention it’s possible Beard had not yet got the clear story from Malta. That may be the Good Faith the Lt. was going by. In any case, Lt. Matthews smelled bullshit and blanked everything on Hall, making it right bringing true justice to Mr. Hall.
Also did you notice during his explanation he just could not resist demeaning the guy some more, saying things like "I know you are an argumentative person". WTF? Alot of states are like this. I inherited my grandmothers car, one of the only things I had from her. I already had my own car so I parked her car at the back of my driveway, behind my house. There were only 2 cars in my driveway so I didn't have a car filled, junky yard or anything like that. Within 2 months I got a notice in the mail that I was being charged an initial $150 fee and then $100 every month after if I didn't get the car registered AND insured (even though i had no plans of driving it). I had turned the old plates in (they were from another state) so it wasn't a fine associated with that. Some person working for the county apparently has the job of diving around and looking in people's yards for cars with no tags and then fining them. Keep in mind this car was a good distance behind my house, at the end of a driveway that curved a little so they had to of come on my property to see it didn't have a tag. I just wanted to keep 1 car to have for a backup and for memories. I couldn't afford the insurance cost every month at the time, I was barely paying the bills I already had so I had to sell it. 😢😢😢😢 It's rediculous....land of the free my @$$.

Once again, charges dropped. Left-handed apologies with a pile of cop-splaining . Problem bieing, the victim STILL was threatened with physical harm, arrested, spent 5 hrs kidnapped and restrained and suffered physical, mental and financial harm. Sad "state" of affairs.
How is it right for the chief to say "i understand you're an argumentative person" if he's never met or conversed with him before ??? Anyone has a right to argue a fact when the cop is blatently lying through his teeth and accusing you.

Warren county does a lot to protector crooked cops. The guy that used to be a jailer there. Our stories to tell. That’s very corrupt that he quit and join the military. I know they covered up for a officer called short.
There *was* a town ordinance that made it an offense, yes. ATA read it to you. What you do is turn the car nose out so the rear plate, the only one with an expiration sticker, does not face the street. Then an officer must justify going onto your property to see the expiration, since cops aren't fond of actually getting out of their cars, this is theaeasiest way around a cite. And the ordinance, as read, does not prohibit keeping unregistered cars in an enclosed garage or inside a fence, out of sight.
Most Americans believe that. That's all I can conclude after watching hundreds of videos where they dial 911 because someone is filming them or holding a sign they don't like. They want the cops to stomp them to the ground, and for the judge give them a year in jail.
Well, to police the law is their perception of it, so therefore they perceive that their knowledge of the law is higher than the constitution. And now I’ve gone cross eyed.
Now I have seen it all. A cop can violate your rights, threaten you with harm, tow your car and falsely arrest you and the cop boss claims he was acting in good faith. Un-fucking believable.
Mfs can do anything at this point. Like what in the hell. A cop pulling you over cuz a random other cop just says he was threatened. These cops fucking suck.
However, cop 2 was formally stated to be acting on *only* the act of the middle finger, as stated in their report and shared during their altercation. The issue was not cop 2 using collective intelligence, it was that the 'intelligence' provided did not constitute detainment or arrest. @Gr33NGiAnT365
I'm from a small town in Mississippi. And we have the same b******* ordinance. It's just a way for this city council to make money off of people who are trying to either make up some money on the side. Or are going through hard times

@@markbanks4738 I did say stay fired. Being on the Brady list makes them much less likely to be hired by another police force. And we know that dirty cops skip from force to force.

Qualified immunity should not be given to officers if they are found to be lying or making stuff up and they should be held personally responsible for any harm to their victims, not the taxpayers. If they did nothing wrong and have nothing to hide, what is wrong with it? Kind of like they tell people when they want to do searches.

I wanna thank Audit The Audit real quick. Because of this channel (and Andrew Flusche) I've gotten a much more deeper appreciation for learning about my rights. A few days ago, a police officer showed up at my house. I refused to open the door and didn't even acknolwedge him. He then opens the front glass door. I assumed it was to put his card on my door. To my shock, the deadbolt starts slaming against the deadbolt housing. This cop just tried to force his way into my house without a warrant or any type of exigent circumstance!!! What was he going to do next??? "Uh, excuse me your front door was open." No, it wasn't! I immediately went to the sherriff's site and filed an official complaint of violation of my 4th amendment rights. I didn't even know you could do that until I started wating AiT. People, educate yourself on your rights! Don't let a police officer abuse them and trample them. Because they will. Cops are nothing more than humans like you and I and there are plenty that just "do as they please" with complete disregard for the law and the rights we're guaranteed as citizens of the US. Thank you AiT and Andrew Flusche for helping to educate me. Edit: And got the response from the filed copmlaint. Because Deputy did not encounter anyone at your residence, he did not activate his body worn camera. I have, however, received a report from him regarding his actions, submitted without the benefit of him first reviewing your complaint. He advised that after observing the delivery driver drop a package off on your front porch, he approached your residence and noticed that the package was gone, indicating that someone was home. He advised that he opened the outer porch door and knocked on the interior door several times, perhaps somewhat forcefully to get your attention, knowing that you were home. In doing so, he noticed that the door seemed to be loose on its hinges or otherwise not securely fastened. He also indicated that while he may have touched the door handle to see if the door was in fact secure, he did not attempt to open it. Upon your refusal to come to the door he left, ensuring to secure the storm door as your note requested. ========== He just said he knew I was at the residence. Why didn't he turn his body camera on? He did all this "Starsky and Hutch" detective work, keeping track of my fucking packages and when I picked them up! So if he knew I was there, why wasn't the camera rolling? And in what scenario is it ever appropritate to "touch a door knob and make sure it's secure?!" You guys ever heard someone fabricate lies as they go along? B/c that's exactly what this guy is doing. I put my hand on the door knob to have a moment with it, but I did not turn it and push!" In other words, they deleted the footage and the burden of proof is on me. I didn't video record the son of a bitch b/c I thought it was the UPS driver. My phone was downstairs, not on me. I used to defend police officers. I told people "Don't forget, there are some good ones." And now I'm finding it hard to utter those words again. I've never had a positive cop encounter. It either negatively affects me or, at best, is a netural interaction. When I was attacked, they did nothing. When my car was broken into (several times), they did nothing. When my house was robbed and I told them exactly who robbed me and where my stuff was, they did nothing! WTF is the point of a police officer anymore?!?! It's just a big fucking game of "who can we throw in jail" for them. And they're almost untoucheable unless you can record them in the act! Even then it's not guaranteed anything will happen to them! I'm so disgusted!!!! WTF is happening to our country?! WTF happened to "Serve and protect"?!
I had a young cop bang on my door at 5am, I answered asking what's going on. By the time I got to the door he was down at the bottom of the stairs so I opened the door and stuck my head out to talk. He said he got a call, so I looked over at the number on my house making sure its still there and asked what address and he said my number but used "apartment A" which was a sign since I'm apartment 1 and never use or heard it referred to A before. Then it became odd, he just stood with a weird smile so I asked if he knows what the call was about, he said he did and just stood there. So I asked if he has a phone # he can call them back because I certainly didn't call and there's no one else home. Finally over his radio someone tells him the women who called says she can see him and he's at the wrong house. He just walked away without saying anything. It was very odd. I'm thinking it was a domestic abuse call since. They got the address wrong.
Received a response. Thought you guys might want to read the update. I think I'll have to seek legal council on the matter. But IDK how to prove what he did. I didn't record it and they scrubbed the footage already.
Without the protection of a valid traffic stop, it sounds a lot worse. To bad prosecutors don't care. Until we demand a separate special prosecutor who's job it is to charge police. We will just keep playing this game.
"This encounter demonstrates how an untruthful statement from a single officer can snowball, and cause other officers to also violate a citizen's rights." 💯 Very well said imo, spot on 🎯

The chief’s only motivation to verbalize that the officers were acting in good faith pursuant to the ordinance was to help them claim qualified immunity later. Guarantee it.
First of all, that wasn’t the chief. Secondly, qualified immunity is not something that needs to be “claimed.” It is a legal doctrine that inherently applies to all public servants unless a COURT finds they acted in bad faith. Lt. Beard was fired, but the guy that made up the whole "officer threat" thing, wasn't. There is much more to this story than what this video shows. He'll either get his job back, or end up the next town along with a healthy sum of dollars of the peoples money , whilst laughing at how the system protects him and other filth after being on video blatently lying etc !
There are 2 big reasons they do it. 1. They know the prosecutor will argue in court not to believe you lying eyes, "the camera didn't show everything". 2. The officer fully expects any damning evidence to be lost, deleted, or misplaced long before discovery. There was a case a number of years ago where to police tried to pull the "we lost the footage, and there is no backup" game. They played it with an IT Security specialist. His response was to prove to a court there was a backup system in place. The police had no idea it existed and no direct access to it. The court ordered the company to turn over the footage and it did. The rest didn't go well for the police. But none were charged for their obvious and dumb crimes.
It’s called muscle memory. They know they’re on a camera, but they can’t help themselves. Because before there was cameras lying, was go to thing. when you went to court, the officers word was gold. They were above approach for lying. which course made them incapable of telling the truth, even when it helped them. Go to court make up anything you want. That’s the way used to be before cameras..
Malta knew exactly what he was doing. He sent that animal Beard to do the dirty work while he played meter maid. What a couple of disgraces. Beard’s lawsuit is a joke. If he has a badge we have failed as a society.

He had no reason to run his yapper; then proceeds to cut off the lieutenant and argue why he’s not argumentative 😂🤡 If you’re a grown man, you should be able to control your emotions, especially when you’re winning.
It amazes me how many officers have discretion when they want it but their hands are tied at any other time. It would be better if they didn’t try to convince people that they hate doing what they’re doing. I guess honesty isn’t their strong suit
Yes it’s was very telling when he said I hope we can put this behind us now. But what was really said is he hopes that he can put it behind him. And not take legal action against his department. But that didn’t really go over now did it. To the tune of 100 grand. Should’ve said we’re very sorry and we’re begging you to not punish us so much.
I agree. His assessment of officers "acting in good faith" is legit: (Garcia) - city ordinance was being violated, (Beard) - stop was based on call from fellow officer. After recognizing the allegations of Garcia were false, he voided all charges and citations, refunded tow charges, and was a strong advocate of amending the city ordinance and investigating and ultimately terminating Officer Beard. When the lawsuit was filed, he was likely in support of settling without challenge. I don't know what more a city official could do. As far as his comment about Hall being an "argumentative person", he dropped it when Hall denied it, so we don't know where he was going with that. He may have told Hall it was people like him that get these kind of things out in the open.
Agreed. Matthews should have received an A- (or maybe B+) here, and I certainly disagree with the C+ given. He went above and beyond to take responsibility for and correct a mistake that his staff made. That's exemplary leadership.
For real. When you see this vehicle on a taxpayer funded road, then we can talk. The guy could have driven off without a word, or better yet, just sat there and stared at the police silently.
@munster355 I don't think one or two unregistered vehicles necessarily constitute a nuisance, but there has to be some kind of line. We've all seen those yards strewn with junk. Which breeds mosquitos, wasps, rats and affects the whole neighborhood.
@@davidinwashington In that case other laws and bylaws can be written to deal with trash or health hazards. But it's ridiculous to compare a yard strewn with junk to a guy with a nicely kept property who simply has an extra vehicle in his driveway.

How bored are you to mess with parked, disabled cars in someone’s driveway? Protected and served, I suppose. And they still did the kidnapping to the guy anyway
Tells you there ain't much crime there. They are bored. My dad got pulled over once for "failing to signal lane change" when he didn't. They busted him for dui without any proof. Cop said on the stand, "Only reason I pulled him over was he was the only one out at 3 am." They still nailed him to the cross.
I was a lawyer for more than a quarter century. Saying somebody threatened you is a conclusion, not a statement of fact. It's like saying somebody committed a crime. What crime; what did he do? There has to be some statement of fact that leads to the conclusion.
@miller2435 No, but good question. Say somebody threatens to kill you (for example, "I'm going to kill you!"), and you heard that person say it. If you testify to that, it is not hearsay. Hearsay would be if a third party said he heard somebody say he was going to kill you; that is, somebody else heard it - not you. The point I was making in my post is that there is an objection for "conclusions." The judge wants to hear the facts that support the conclusion - after all, the judge is the one who makes the conclusions, while the witnesses state their facts they witnessed. To say that somebody threatened you without saying exactly what he said that amounts to a threat is the problem. We need details. Hope that makes sense???
First off, what is a derelict vehicle? It would seem to me that a perfectly fine vehicle, not a ragged out busted up car, sitting in neatly sitting in your driveway is not derelict. I have a perfectly fine pick up in my drive that I pulled the plates on and turned in to suspend the insurance until my granddaughter gets her license. In my state insurance is mandatory and plates surrendered to pause your insurance. If you don't you will be fined for no insurance. Our insurance companies are required to report delinquent insurance or drop of insurance. At least the Police Chief handled everything very professionally.

Within 2 months I got a notice in the mail that I was being charged an initial $150 fee and then $100 every month after if I didn't get the car registered AND insured (even though i had no plans of driving it). I had turned the old plates in (they were from another state) so it wasn't a fine associated with that.

Slight changes in wording and capitalization have entirely changed the nature of our relationship and contract with our "country" and "government" which is no longer remotely what it originally was. Worth some research.....
State national/sovereign/natural person/secured party creditor, the real definitions of terms like person which now include corporations, the corporation made in your name via the birth certificate with which most people identify - there's a lot of BS out there but there's truth.
Learn how the birth certificate is actually a bank bond, collateral for the debt notes/fiat currency we exchange and call money and are enslaved to.

FYI, I'm guessing @billwe5772 is a boot licker.
I love how the DA just ignores the fact the officer made up the "threats" lie and the "disorderly conduct" was just CYA. Why would you sit there and listen to the DA actively cover up a crime and not call them out on it?
I love how the captain tries to make it sound like the citizen was getting something positive out of his ordeal and tries to wrap it up without any repercussions to the officers.
Lieutenant Matthews, " I understand your an argumentitive person", "Officers acted in good faith". Always starts at the top. The nice cop portion of the interview was to avoid a lawsuit and protect his boys.
Agreed, but they still got sued and it was the taxpayers that had to crack open the wallet. Such settlements should at least come from the police budget, if not from their pensions and/or salaries.
And you just know the Lt. would be up in arms well beyond this guy's behavior and be pretty damn argumentative himself if something like this happened to HIM.
This cop is such a LOSER! SOLVING ACTUAL CRIMES IS NO LONGER A PRIORITY. Just collect money from the public.

Just like Game of Thrones.
It’s a threat when it suits someone’s purpose but otherwise it’s not.
That's not what happened. The other officer lied to him. Said he flipped him off AND threatened him. The problem is he never found out what that threat was. He never suggested flipping him off was a threat. In fact, he outright said it's not a threat.
The chief’s only motivation to verbalize that the officers were acting in good faith pursuant to the ordinance was to help them claim qualified immunity later. Guarantee it.
^^^THIS Copsplaining
You would be correct sir.
First of all, that wasn’t the chief.
Secondly, qualified immunity is not something that needs to be “claimed.” It is a legal doctrine that inherently applies to all public servants unless a COURT finds they acted in bad faith. Lt. Dan verbalizing it to the complainant does nothing to strength or weaken the officers case, it’s entirely irrelevant to any subsequent court proceedings.
@@Jcreek201 you wrote in complete, coherent sentences, so I’m going to assume that you aren’t as dopey as the nature of your reply implies. You’re obviously not an attorney, so you just decided to pick apart a comment to argue semantics with a stranger on the internet? Douche behavior.
First of all, Chief, Lt, PIO…who fucking cares?
Secondly, my comment was about the mindset of police when they violate rights. He is foreshadowing their defense in court. It’s their standard talking points to try to fool the public (and the courts). We all know why they REALLY did this to the victim…
Oh man, i would really love to see your take on the guy that got shot up while handcuffed in a police car, and the officer felt attacked by an acorn falling from the tree.

Beard was fired, but the guy that made up the whole "officer threat" thing, wasn't. There is much more to this story than what this video shows. Several officers text messages have been subpoenaed that shows they conspired to pin all the blame on Detective Beard for the entire incident. That entire police department is corrupt to the core.
@@Benefitswtf. Why are they scapegoating this guy instead of the guy that lied his ass off and started the whole thing?

I'm not a liar! I just misremember everything that could help my case.
That's because 99.5 % of the time, those above them still turn a blind eye and protect them ! Even when, as in this case the cop was fired, he's suing for wrongful dismissal .
They are so use to having complete authority their egos won't allow them to see the error of their ways.

That buffoon wouldn’t shut his mouth while he was already up. He wasn’t losing in that conversation. He had no reason to run his yapper; then proceeds to cut off the lieutenant and argue why he’s not argumentative 😂🤡
If you’re a grown man, you should be able to control your emotions, especially when you’re winning.
The other cop was like is it his house ? You messed up my man !
It amazes me how many officers have discretion when they want it but their hands are tied at any other time. It would be better if they didn’t try to convince people that they hate doing what they’re doing. I guess honesty isn’t their strong suit
Basically the chief spoke with the prosecutor attorney and was advised to smooth this over.

Shoutout to lieutenant Matthews. He talked the talk and walked the walk. We need more leadership like him.

@@davidinwashington He's a "nuisance neighbor" for simply keeping a vehicle in his driveway?
@munster355 I don't think one or two unregistered vehicles necessarily constitute a nuisance, but there has to be some kind of line. We've all seen those yards strewn with junk. Which breeds mosquitos, wasps, rats and affects the whole neighborhood.
@@davidinwashington In that case other laws and bylaws can be written to deal with trash or health hazards. But it's ridiculous to compare a yard strewn with junk to a guy with a nicely kept property who simply has an extra vehicle in his driveway.

I was a lawyer for more than a quarter century. Saying somebody threatened you is a conclusion, not a statement of fact. It's like saying somebody committed a crime. What crime; what did he do? There has to be some statement of fact that leads to the conclusion.
So basically hearsay?
