the fact that the district court originally said that a reasonable but mistaken officer could have believed an officer believed that failure to produce ID constituted a crime is a justifiable reason to arrest the citizen is absolute insanity. That judge basically said that the officer has no obligation to know the law but just because he believes he is right he can violate the law. This is absolute insanity and it is very fortunate that the federal court overturned this absolute failure by the judge to adjudicate the event in accordance with law instead of opinion. This is very chilling to see that the district court is willing to allow officers to violate the law just because the may have thought they were justified.

That judge basically said that the officer has no obligation to know the law but just because he believes he is right he can violate the law. 90% of cops couldn't investigate their way out of a paper bag.
*Wet* paper bag...FIFY ;)
You should have said yeah, I'm here to repair a car and steal it. Haha ha
They "dont have time" to do things the legal way. It's inconvenient to respect the laws or rights of citizens. I wonder if that lady cop will stand by her principles that someone who breaks the law, even a "good person", should go to jail. By her logic she broke the law, she should go to jail. I do not think she is a good person, though.
So, did she arrest herself and her partner? She insisted that people who break the law go to jail. Didn't they falsely arrest a man?
A perfect example of why more and more people are losing respect for police.
Can't lose what you never had, brother. Respect is earned not handed out freely like acorns...
@knowEyeDeer Acorns? Cops shoot at you for the mere presence of acorns.
@@Nclght I'm not sure the joke needed explanation, but cheers mate. Take care.
@@knowEyeDeer I didn't explain the joke. I simply added just a touch of context for those not familiar with the reference. And there are many who aren't in on the joke. I added just enough to make such a person ask a question. It's always better to have more people understand something as opposed to keeping it in a small and potentially smug circle.
But I do apologize, as It was never my intention to infringe upon or steal the thunder from the creative wordplay of an amazing joke writer. So, dude, have a beer on me and relax.
@@knowEyeDeer Well, I respected Andy Griffith and Barney Fife. I grew up with those guys and wish more cops today had their demeanor. But . . .yeah. That's not the case. If I hear "Here's the deal" from a cop one more time . . .
All police had to do was run the plates, call the owner and verify the mechanic was given permission to work on the vehicle. Disgraceful behavior.
this is exactly why I don't think obstruction should ever be a charge all on it's own.
That was my thought, how the hell can obstruction be the only charge?
This is the new “go to” when they don’t have anything to charge someone with.
I can see obstruction as an individual charge but it should be narrowed as the police have just been using it as a catch-all. Resisting, on the other hand, should not be a standalone charge.
@@kinglewis6553 The gov has proven they're untrustworthy with such laws in their tool belt. It'd be one thing if the only people you saw getting arrested for obstruction on it's own were people who stopped gov officials from providing important medical care to someone, but that's not the case.
@NathanaelCrapo I'm agreeing on that point it is being misused. That's why I think it should be narrowed, after-all is possible to obstruct without committing another crime
A reasonable officer could think a man exercising his rights was breaking the law? Does the Court not read their own statements?
A Reasonable Officer would seen what they were doing and would have said something like "Hey man sorry to bother you but I got called here. Is this your car your working on? No? It's a customer of yours who called you out here? Thank's for telling me even though you didn't have to. I'm going to explain this to the caller who could have asked you this themselves. Have a nice night."
Another clear case of “you didn’t do exactly what I said when I said it so I’m gonna punish you”. Why don’t they train these fools instead of giving out money?
Because it's your money they're giving out? And only years after the fact, for a fraction of the incidents that occur.
A system does what it is designed to do. It's not a mistake that they go around criminalizing the existence of the working class; That's how they fill up prisons with slave labor. America has the highest prisoners per capita of any country in the world.
Because it’s not their money, it’s yours
Got to get that ID. It is like a fix.
What a joke! The dude cop walked right up to the poor guy and stood there just chomping at the bit to pounce on the guy and put him in cuffs. Hope the guy wins his lawsuit and those two morons get fired!
Donald Trump promises to strengthen qualified immunity.. that’s a dealbreaker for me. I HATE these arseholes.
They'll just have to go one county over and apply to a be a cop there and get another job.
That guy just wanted to waste the officers time. He was fully willing to comply after being arrested yet before it was "I don't have to show you my ID muh rights I'm big I'm strong" then he folded like a wet paper towel when his convictions about "I don't have to ID myself" was tested. Next time he's gonna comply.
@sackeshi you feel better now?
@sackeshi you may want to read the 4th Amendment. Also, when the law states one doesn't have to ID unless they have committed a crime.... they don't have to ID. The reason most people don't ID until threatened with arrest is to preserve their 4th A rights so they can have a basis for a lawsuit against the cops.
"We don't have time for this" proceeds to spend hours booking him into jail
Yes, he obstructed my investigation...cops in the US the only investigating they can do is run IDs. They can't think to themselves what's going on here, let me speak to the caller and see what's going on.
Go court of appeals! Mr. Edgers did right in suing! Those cops were ignorant and impatient and obviously decided they’d arrest him without doing any real investigation! Poor policing.
Sick of seeing this corruption in the police force. It needs to stop.
This is sooo pitiful. He absolutely tried his best to explain. The male cop is even more despised than the female and that’s saying something. This poor guy was just trying to work. He was very polite and trying his best to cooperate. Officers like this shouldn’t be serving the community!
This woman broke the supreme law of this country - the 4th amendment - why isn't she being charged with kidnapping?
Because we are slaves
The 4th Amendment is dead.
You don’t know what the legal requirements are for kidnapping if you suggest this. It’s always laughable
@@robv5834 The act of abducting someone and holding them captive. Legal definitions are the same thing as real word definitions of words.
@@thagenet lol no they aren’t. Legal definitions include the elements needed to prove a crime was committed, such as intent. Your definition didn’t include any of that, so it’s clearly nonsense from Websters or google.
No offense, but next time look things up a bit before you comment out of turn.
What kinda thief works on someone’s car during broad daylight in an openly active area? Why isn’t the simple explanation of “I’m a mechanic working on a customers car” not good enough? What would their ID prove? Asking for their business card would even make more sense.
People stealing catalytic converters do it all the time, unfortunately.
Meth heads, still absolutely no excuse even they got rights.
Exactly. And the security guard should be fired too, because he didn't just bother asking them what was going on. Then he could have called the owner himself instead of risking their lives by calling the police.
I wasn't trying to explain away the cops' actions, btw. The wheel was off. I've never seen a catalytic converter thief remove a wheel.
These 2 cops deserve prison for abusing their power.
@@wvrjlnot a security guards job to do investigations…that’s the police jobs
What astonishes me is the district court time and time again granting Qualified Immunity just for it to be reversed in appeals. It's the same law. How can district judges not know the law. That's just highly corrupt
They always have to be appealed. The district courts don’t want to deal with it & don’t want to go against their business partners.
Judges and cops are in cahoots.
The Blue Line Cartel protects their own.
Qualified immunity made sense for certain things but blanket immunity breeds this kind of "excellence". Not having that immunity would make officers more reticent to just throw people in jail.
@@kylethomas3224 if it made sense why did it take over 180 years of being s country until the supreme court decided to poof it into existence? Officers SHOULD be reticent to throw people in jail.
