      He didnt quite clarify what his deal with the manufacture is. They have his recipes, however they cannot sell his recipes as his brand if they were to breakaway from him. Which just means even if he does get dropped which he never did, he can use the 12 million he took home this year to find a new manufacture.

      @@adoe2305 it doesnr need a source, someone can simply lie about numbers on the show its illogical to blindly make an offer and finalize it on a show, u have to remember the goal of this show is for entertainment. the investors meet with the business owners and go over everything to finalize the offer and most of the time a lot of things that were hidden pop up so sometimes the deals get dropped

Until being questioned further he never had the intention to say that. So he didn't "lie" per say, but he withheld very crucial information in relation to "his" business, which is actually not his own. He's just a representative

He will never make more than 70K because the manufacturer will squeeze the margins pegging him in. This guy needs to drop this product and make his own.       Yep, just WOW...
      He should have taken the offer, cause he's likely going to have to make what he can from the business and then get out of it, learning from his HUGE mistake, cause he doesn't actually own the business, it's not in fact his. The only way he'll have real success is if he can convince the owners to sell the Recipe to him, but that clearly won't happen, they will likely want to do the reverse, buy the business from him, and he won't have any leverage, so he'll be forced to sell.

      He’s barely even a middle man. He’s more of a salesman. The manufacturer owns the recipe. The manufacturer packages and ships the product. The stores sell the product. All this guy has is the rights to the branding of the product for 6 months at a time and exclusive sales of the product for 6 months at a time. At any 6 month interval, someone else could potentially take over “his” product and sell it under a different brand. At any 6 month interval, he can potentially be priced out of any profit. He could loose his exclusivity, or the entire product for that matter, all while being under contract to supply xyz units per store that sells his brand. I don’t care how good the product is, I wouldn’t get involved with him, unless the investment was so that he could purchase the rights to the recipe.

      That’s not exactly true. Based on what he said it’s not like if he pulls out that the company can just go use the recipes with some other company, the IP is theirs but it’s can’t be sold outside of his trademark. The problem is the manufacturer needs him a lot less than he needs them. They have probably dozens of clients that can soften the loss of one brand if negotiations get tough. He only has one manufacturer. His strategy would work a lot better if he was working with multiple manufacturers so negotiations with any one of them wouldn’t be as dangerous to his brand. Separately he should be establishing his own in-house food science lab to develop new IP that’s owned by his brand even if he never invests in a factory.

Essentially tho if he did come up with it and his doing the marketing for them , and selling for them, he stuffed up big time , if it's his recipe and he cut a deal with the manufacturer, he should be getting the 3.5% and he should be sitting on his chair eating a tub of icecream and getting checks in the mail .... But if he didn't come up with it, his simply a distributor , nothing exciting about that for the sharks ... As a first time business man tho , you can make these mistakes

      I thought the same thing. I figured they could have tried to create their own recipe and just use his brand and connections to keep building. Its just ice cream and not a damn microprocessor or something that requires tons of R&D and specialized equipment to make.

His plan frees him up to expand the brand while someone else deals with the day to day headaches of manufacturing and distributing the product. It sounds like he had a great idea but had zero idea how to actually make the product. There’s not a company in the world that is going to do all the work and then let the recipe walk out the door once it succeeds.

      He does not have control over the price of supply. He cannot shop elsewhere or bargain for lower price as volume increases. In fact, as thy pointed out, the price of supply will likely increase as he becomes more successful. He works for the owner of the recipe.

    Kinda sad to see all these comments attacking him, I think the whole situation is pretty sad. He comes up with an idea for ice cream and then only thinks he can make it and sell it by partnering with a huge manufacturer, not knowing that it would screw him over and make him lose the rights for it. No wonder he was crying.
    Also good news, in an article I found googling it seems the business is now successful and it says this:
    The pitch also gave him a “kick up the bum” to “remove all the ambiguity” in the relationship with his manufacturer and take full control of his IP. “If I could do it all again, absolutely I would have sat down beforehand and sorted all this out,” Mr Houseman said.
    So shame on the people commenting here saying he had nothing to do with it's creation. It's obvious he was a naive person who didn't know what he was getting himself into, so good on him for sorting it out

      That’s not true. He approached a manufacturer with a broad idea of “good tasting coconut ice cream” which is likely to be something they already had cooked up waiting for someone to request it. They paid their employees to develop it, refine it, test it, and register it. He simply took a contract to sell their product which of course they will set all terms on.

    The most realistic he could've gone, is to get a shark to meddle in the next contract agreement and prolong the contract life to at least annual, or ideally, biennial.
    So even if a price hike is inevitable, at the very least it wouldn't happen every 2 quarters and you have a lot of time to look into securing a possible different manufacturer OR scatter to find an expert who can possibly reverse engineer the recipe.

    I have observed this phenomenon in Shark Tank Australia : People put projected valuation in seeking initial investment and even sharks entertain it. This would never fly in American Shark tank. The investment is always made with respect to current valuation of company.

    I feel like what he means is, he had the idea to use coconut milk for ice cream, came up with flavors and names and such, and then found a manufacturer that was willing to make it for him under the circumstances that he sells a certain amount of units. It’s like when celebrities come out with make up lines, but all they technically do is come up with the idea of the product (like Kylie lip kit) and colors, design, advertise it but it’s actually the manufacturer that’s making the product itself.
