The police gave him a chance to put the gun down and comply with their orders. Instead, he ran. And while he ran he pointed that replica gun at them. I think the police's actions in this case are justified. This is very different from the Tamir Rice case, which was illegal in my opinion.

In the video you can clearly see the gun in that 13 year old's hand so they already knew he was armed. When he is tackled to the ground, he is face up with knees bent and again you can see the gun in his hand if you look to the officer's left. The officer who shot was protecting the other officer. They had no idea this was a replica gun.

As a police officer you have micro seconds to take in your all of your surroundings and identify the suspect. Seeing a weapon, which has been reported to be a replica of a REAL weapon, in someone's hand that obviously wasn't wearing a tee that said "this is a fake gun" or holding a white flag at the same time, the officer had no choice in my opinion.
Play guns are never a real threat. Not one person in the history of man has ever been killed and shot by a toy gun. I looked up Utica, NY's Curfew law and he clearly has violated that as the Curfew law for those under the age of 18 goes into effect at 10pm and ends at 6 am. so Technically by all accounts, the parents can be arrested for child endangerment for the curfew violation. I'm sorry but the officers involved did the right decision. When anyone takes out gun even a fake one, officers can't tell if it's fake. The kid made a real bad decision which caused him his life. I feel bad for the family but you can't blame the cops for a bad decision by their child. Unfortunately good kids can go through life doing the right thing and can be loved by others for being a great human being. But even good people can make bad choices or decisions that can put their lives at risk. Prayers to the family!

Yes, Utica has a curfew law that goes into effect at 10PM. the incident happened a little after curfew started. What 13 year old has a firearm in his possession when the legal age to carry is 18?
