- The International Criminal Court (ICC) is tasked with prosecuting individuals for the most serious offenses, such as genocide and war crimes. The ICC recently requested arrest warrants for Hamas’s leaders, Israeli Prime Minister Benjamin Netanyahu, and Minister of Defense Yoav Gallant for various crimes in the ongoing Israel-Hamas War. In Netanyahu’s case, he is accused of multiple war crimes and crimes against humanity, including the starvation of civilians as a weapon of war and “intentionally directing attacks against a civilian population.” Although Israel is not a signatory to the ICC, as Palestine is, the international legal implications still affect Netanyahu by limiting where he can travel and risking arrest if he visits a country or Western ally that is an ICC signatory. But some officials and many others question the fairness of equating his actions, which are intended to protect his country, with those of Hamas. Those who believe the warrant isn’t justified argue that the ICC doesn’t have legal jurisdiction over Israeli citizens and claim the warrant is politically motivated. Those who agree with the ICC argue that it’s a necessary step in enforcing international law, ensuring accountability, and helping provide justice to victims.
With this context, we debate the question: Is the ICC’s Warrant Against Netanyahu Justified?

I think that the legal advice of ICJ says Gaza was occupied before Oct 7th. A war against occupied people is a little bit strange.

At the time, all countries, including the US, with the notable exception of Israel, had fought the apartheid government of De Klerk who was forced to leave power in 1991, leaving the former Bantustans the right to self-determination vis-à-vis South Africa.
The fact that Israel is creating Bantustans on territories that do not belong to them does not diminish but on the contrary increases the illegality of its action.

I think Roth lost the debate when the point he chose to respond was one over jurisdiction, rather than the political ramifications of allowing the warrant to proceed.
Okay so the first guy talks in facts and legal proposition and the other guy resorts Fundamentally to accusations and some variety of ad hominem.
It hurts me to say this but the one valid point was made at the end there. Bush, Cheney, Blair et all should all have been prosecuted for war crimes for the illegal invasions of Iraq, Libya Syria etc but in fact never have been because the US is too powerful and does not have the integrity to sanction it's own leaders when they act illegaly on the world stage. Holding Netenyahu to a higher standard is only feasable because Israel is much weaker and is not even that while the US defends him from all angles. We are dealing with an international legal system that is currently toothless to act against criminality because the most powerful players themselves to not uphold the standards that they proclaim to adhere to.
From a moral point of view if 99.9999% of the world population falls under the protection of international law. Why decide that a particular group does not enjoy the same protection just because there statehood is under discussion. Does that make them second class citizens and free for hunting? After WW2 we did not want that to happen to anyone remember?
