    Thanks for the video sir. Quick question I’m a Canadian living with my family here in Toronto, my company want to do a intracompany transfer in L1B Blanket which my company qualifies for. However my wife is Indian citizen with Canadian PR card and all 3 kids are Canadian citizen. Can my wife and kids go through CBP or she’ll need to go to consulate here in Toronto which currently have a wait time of over 200 days. Any thoughts ? Thank you

      Dependent spouse and minor child(ren) who are Canadian citizens may also seek admission at a CBP port of entry in L2 status without obtaining an L2 visa. Because your wife is not a Canadian citizen, then she must present an L2 visa for admission, unless otherwise exempt. Please speak with the company's lawyer who is filing the L-1B and ask if there is an exemption for your wife or if s/he can assist with an interview waiver or an expedited appointment.

    Hi, Does L1B applicable for employee who is working for US employer *remotely (wfh)* from outside US (with legal contract signed)?

      No. An L-1 visa requires; (1) a foreign company have a qualifying relationship with a U.S. company, (2) that the employee have worked for the foreign employer for at least 1 year in the past 3 years, and (3) the foreign employer shall continue operating after the employee transfer to the U.S. Unfortunately, without a foreign employer, then an L-1 visa would not be applicable.

    If organization has L Blanket visa, what is the process for applying L1b visa, how much time visa process take?

      Hi Pallavi. For an L Blanket Visa, a company must meet at least one of the following: (1) successfully obtained at least ten L-1 petition approvals in the previous 12-month period, (2) have U.S. affiliates or subsidiaries with at least $25 million annual sales; or (3) have a U.S. workforce of more than 1,000 employees. The process is as follows: (a) employer applies for blanket petition and then after approval, (b) employer then completes I-129S and sends it with approved blanket petition to employee, (c) lastly the employee applies for L-1B visa at US Embassy/Consulate and attends interview. Processing times vary by Embassy/Consulate. Please do speak with your employer's attorney.

    Hi, I have a diploma(Mechanical) and have 11 years of experience in the same field. Am I eligible for an L1B visa or is it really difficult to get the visa ?

      Hi Sarath. An L-1B worker must have specialized knowledge of the petitioning company's product, service, research, equipment, techniques, management, or other interests and its application in international markets, or an advanced level of knowledge or expertise in the organization’s processes and procedures.
      If you have been working in a specialized field for 11 years and you have specialized knowledge of the company's product, management, processes, and procedures, and the company is seeking to transfer you to the U.S., then you may qualify.       Sorry to hear that Jaham. Green card holders can sponsor children that are unmarried and under 21 years of age OR unmarried sons and daughters that are over 21 years of age. It sounds like your mom can sponsor you under the F2B family category. Under F2B, it is taking approximately 6-7 years to immigrate to the USA.
      Also, there are two main ways to immigrate to the USA: (1) through family or (2) through employment. You can have your mom sponsor you and then also look for an employer. If you have enough funds, you could start or purchase a business in the USA and then apply to immigrate under the E-2 visa. See my video on the E-2. Hope this helps you.

    Hi
    Can an investor owning 50% of the Branch established in USA apply for L1 visa without any work affiliation to parent company ?
    Basically we are planning to open a branch in USA, for our well established company with good credit score in home country Uzbekistan. Second party individual investor owner of 50% for the branch in USA doesn't have work experience in parent company. But he has good professional experience abroad and would like to manage the USA branch as development manager for further expansion and additionally the parent company would like to send their own employee with history of work at parent company to manage the fleet of trucks and assist with technical part of the job.
    What are the chances of obtaining L1 visa for both candidates ?

      To apply for an L-1A, the executive or manager must have worked for the parent company for at least 1 year out of the past 3 years in a managerial or executive position to transfer to the affiliate, branch, or subsidiary office in the 🇺🇸.
