    🚨Option 1: B-1 Visa🚨
    The first option for entrepreneurs is the B-1 Business Visitor Visa.
    On a B-1 visa, you can enter the U.S. for up to 6 months at a time. This visa is a good opportunity for you to setup a new business or explore your idea more, negotiate contracts, discuss raising capital, find office space, engage in networking, attend a conference or accelerator program, etc.
    🚨Option 2: H-1B Visa🚨
    The second option for entrepreneurs is the H-1B Temporary Specialty Occupation Worker Visa.
    The H-1B visa requires that you have at least a bachelor’s degree in a specialized field.
    Also, this visa is employer specific, meaning that you can only work for the sponsoring employer.
    The way this works is that you would form a business entity in the US, typically, an LLC.
    The LLC would then sponsor you to work for it in a specialty occupation position.
    And, you must show an employer-employee relationship between the LLC and you, the employee.
    This means that you as an owner and employee must show that the company has the ability to hire, fire, pay, supervise or otherwise control your employment.
    Also, H-1B visas have a certain season in which they can be filed and the availability window is only open for a very short time.
    The H-1B visa can be granted for up to 3 years and can be renewed for an additional 3 years.
    🚨Option 3: L-1 Visa🚨
    The third option for entrepreneurs is the L-1 Intracompany Transferee Visa.
    The L-1 visa permits a U.S. employer to transfer an executive, manager, or a specialized knowledge employee from a foreign branch, affiliate, subsidiary, or parent company to its office in the U.S.
    The L-1 visa is divided into two categories.
    The L-1A visa is for executives or managers and the L-1B visa is for specialized knowledge workers.
    As an entrepreneur, generally, the L-1A is the most applicable category.
    You must have a business abroad that has been doing business for at least one year and you must have worked for that business in an executive or managerial capacity continuously for at least one year out of the past 3 years.
    The visa works best for entrepreneurs who already have an existing business abroad and you want to run a wholly owned subsidiary or affiliate new business in the United States.
    The maximum permitted under an L-1A is 7 years. An L-1A also has a pathway to a green card.
    🚨Option 4: E2 Investor Visa🚨
    The fourth option for entrepreneurs to immigrate to the USA is the E-2 Investor Visa also known as the E2 visa.
    The E-2 visa permits you to start or purchase an existing business in the US and then work for that business.
    To apply for an E-2 visa, you must meet at least 4 criteria:
    (1) you must be from a country that has a treaty of commerce with the U.S.,
    (2) you must invest a substantial amount of capital,
    (3) you must have at least 50% ownership in the business, and
    (4) you must generate more than a marginal income.
    An E-2 visa is approved for up to five years at a time and can be renewed indefinitely.
    🚨Option 5: O-1 Visa🚨
    The fifth option for entrepreneurs is the O-1 visa.
    The O-1 visa permits you to immigrate to the US if you possess extraordinary ability in the sciences, arts, education, business/entrepreneurship, or athletics, or if you have a demonstrated record of extraordinary achievement in the motion picture or television industry and you have been recognized nationally or internationally for those achievements.
    You must meet at least 3 out of 10 criteria to qualify for an O-1 visa. Watch the video for the details.
    Similar to the H-1B visa, an employer-employee relationship must be shown.
    An O-1 visa can be granted for up to 3 years and can be renewed indefinitely.

    Very useful summary which is perfectly explained. Still it's a pity to see that the US still doesn't have a true startup visa like many other countries have. High potential startups have a lot of choice when it comes down to their location and the US is really missing the boat here.

    I’ve watched a few of your videos and love how they’re full of information. I have a question though, I’m from Australia and my friend (lives in the US) and I (lives in Aus) want to start a business there. Would I still need a visa to work for the business if I plan on remaining in Australia?

    Hey Subhan, Amazing Video! really appreciate the clarity. I have a quick question: so I'm an F1 Visa holder at the moment and almost completing my Bachelor's. I'm thinking of starting up something of my own, as I read in one of the comments, I may be able to work on my startup for a year on OPT. Is that easy? Considering that my role in the company is essential and directly related to my major, and I own >50% of the company, will I be indeed allowed to do so, or is there an application process or rejection criteria? Also how about the 2-year stem extension that is allowed on top of OPT?

The official SEVP Policy Guidance states that “A student on OPT may start a business and be self-employed. It depends on many factors such as your business model, your educational, professional, and technical background, your home country, amount of investment, and other factors.     Question - On B1 visa once, what if I visit the USA for 5 months go back to home country for a month and come back and stay 5 months, will there be any issue with that?

      Generally, not if you do that one-time, if you have a valid business purpose to return for another 5 months. For example, negotiating a commercial contract or need to observe business operations, attend a conference, etc.. If you try to do it more than once though, then you will likely run into an issue with CBP because they will likely interpret that your intent is not merely to be a visitor, but a permanent resident, which requires a green card. Hope this provides clarification!

In most cases, asylees may apply for naturalization aka citizenship 5 years after the date of their admission to lawful permanent residence status aka green card holder. In some cases, asylees can apply for citizenship after 1 year of military service and must be a green card holder at the time of the citizenship interview. There used to be a program called MANVI that allowed asylees who were in the military to apply directly for citizenship without becoming a green card holder, but that program is no longer available.     Greetings for the day sir, is LLC better than c and which has federal/state tax relaxation and which is most prefered by investors, I hear that c-corp is most prefered for foreign founders in the perspective of local investors and has state tax relaxation, is it so? and if the founder/CEO want's to be an active investor or employer of the company then member-managed or manager-managed would be best for this situation.

      Under U.S. law, the E-2 does not require a minimum amount of capital to be invested. The amount invested depends on the industry, geographic location, market value, and other factors.       You have to be careful to not engage in "unauthorized work" on a B1/B2 if owning a U.S. LLC.       For an O-1 visa, it depends on numerous factors. There are no set number of publications under the law, but it's rather how much weight and credibility does the publication carry.     Dear Ali. Great video, very informative. I am a uk national and my wife is a Mexican national. She has family in TX that are all US Citizens. I travel frequently to the US via ESTA as my current employer has dealings in the US. I would like to open a business in NC (a cafe/shop/yoga salon…multiple facets) with my wife, but have a us national manage it. I understand that this would not allow me or my wife to have a visa to live/work in the US, however i would like to know if it would be possible to apply at a later date (change the visa status) so we could eventually live/work and manage (oversee) the business as the owners?       Hi Rahul. Thanks for your question. Generally, to hire an H-1B worker who is subject to the cap, the sponsoring employer must submit an "electronic registration" between March 1st - March 18th. Each submission is given a random number and after the registration period closes, then USCIS conducts a random lottery and selects employers to move forward with filing an H-1B Petition. The petition must be submitted no earlier than April 1st and no later than 90 days thereafter. If the H-1B Petition is approved, the worker would begin employment on October 1st. However, if the prospective employee is not subject to the cap because s/he already has or had H-1B status under certain conditions, then the employer can submit an H-1B Transfer Petition and the employee may begin working once the H-1B Petition is received by USCIS, which is usually a few days after filing.       Generally, your South African company would be the parent company and the U.S. LLC would be a subsidiary. An "affiliate" for immigration purposes is (1) one of two subsidiaries that are both owned and controlled by the same parent or individual; or (2) one of two legal business entities that are owned and controlled by the same group of individuals where each own and control nearly the same percentage of each entity. The L-1 requires that you have worked for the foreign company as an executive or manager for at least 1 year and that you will be transferring to the U.S. as an executive or manager. The business in the foreign country and the USA do not have to be the same and can be completely different types of businesses.       Hi Ahmad. It depends. There are currently no restrictions on individuals from Iran to obtain an L-1A or EB-1C visa. However, there may be restrictions on companies from Iran due to U.S. sanctions. You stated your business is in Indonesia, then you may be eligible for an L-1A.       You can own a U.S. business such as a restaurant without a visa under certain circumstances. However, if you plan to live in the U.S. and operate the business, then you'd need "work authorizarion" and that does require you to apply for a visa.     I have registered a single owner LLC. Can I do marketing activity, such as product promotion, product demonstration to customers in USA on a B1/B2 visa? I will be getting paid by my company in India (which is family owned). My main job function in USA will be product promotion. For tax filing I plan to hire a CPA.       As a foreign national, you can own a US LLC. However, you cannot work for your US LLC from within the USA, unless you have "work authorization." A B1/B2 visa does not permit working in the USA. If you conducted "product promotion or marketing activities" or any other work/job for the US LLC or Indian company, then you would be in violation of your B1 or B2 status depending on how you entered.       A US company will generally need a US bank account to operate if selling goods or services in the U.S. If selling goods or services outside the U.S., then you may not need a U.S. bank account. If you are going to run the business from outside the US and sell your products and services outside the US, then we can setup a US based company that would be tax-free in one jurisdiction. However, if you will be selling in the US, then the company will be subject to US tax. Depending on the ownership structure US tax treaties or foreign tax credits may apply.       To enter into contracts legally, you must be 18 years or older. The L-1 requires you to enter into contracts. Also, L-2 visas are for spouses and children.
