- I live in one of the only developments I have EVER seen that does NOT have an HOA. The developer never set one up, the community was developed in three phases over the span of about 15 years, and somehow it made it through to the end without ever getting an HOA. That makes it one of the most desirable neighborhoods in my city to live in if you want city amenities (well/sewer/garbage/debris pickup).

We specifically told our realtor not to even show us houses if they were in an HOA.

I hear all the time about people buying into an HOA and not knowing it's part of an HOA until they've already paid for the house and moved in. At that point it's too late.
I've even heard some people not realize they were in an HOA until after multiple fines or liens against their house. I even remember one news story where they didn't know until after their house was foreclosed upon by the HOA for unpaid fines which they were not sending to the homeowner.
Guess it depends on who runs the HOA. Ours has a voting system that we vote on rules and who is the president, vice president and treasury secretary.
The one in my neighborhood is pretty relaxed and we pool money together for things like security cameras, a front gate , yard maintenance and every 5 years or so we get the streets repaved.
If you feel like yours is being too strict I'd suggest speaking to other neighbors and seeing if yall can vote on some rule changes or maybe relaxing some of them to fit your needs.
Worst case you can lobby to have your president impeached or vote someone else in and usurp control.
@KrolKaz I lived in one where the first three rules were, 1, You are elected for 2 years and can not run again for 6 years. 2, Any rules you make can be canceled by the next person. 3, If no one is elected, there is no governing board. After the first 4 years, we went self governing.
In all 50 states, if the HOA is put in after you already live there, then you dont have to abide by it.
You are incorrect. They give you the option to join, and you decline. Then you don't have to follow their rules.

I have told this many times. I had an HOA advise me that they had voted my property into their HOA and that I had 30 days to come into compliance. I sent a response that I was not part of their HOA. 30 days later I started receiving violation notices in my mailbox. I sent a cease and desist letter. A month later, I received a notice of intent to seize my property if I was not in compliance in 10 days. Two weeks later I received notice of a scheduled hearing. At the courthouse, the attorney for the HOA recognized me and asked if I represented the homeowner, and I told him that I was the homeowner. I told him that I was not part of the HOA and they had been advised of that in writing several times. In court, the HOA president told how I had ignored all notices and refused to pay fines. When it was my turn, I asked her how long the property had been a part of the HOA, she gave the date they had voted my property in. I asked her if she had membership documents signed by me. She said "No, you refused so we voted you in" The judge, and their attorney both said HUH ? ? ? I then asked her about putting violation notices in my mailbox and she said that was the only way since I refused to install a notice box at my garage door. I asked her if she realized that putting main in a US mailbox was a federal crime. She said "not in a HOA" I saw their attorney shake his head. The judge asked her how she thought that the HOA could vote someone in without their consent, she said the annexed the property according to their by-laws. I asked the judge for a judgment as a matter of law, and consideration of my counter-claim. The judge said "granted to both, state your counter-claim" I outlined my compensatory damages, and then asked for putative damages in the amount of $5000 per violation notice, and an additional $10,000 for the frivolous case. The judge granted $350,000 in putative damages, and just over $50,000 in actual damages for time, and earnings lost responding and researching their claims. HOA woman said that the HOA could not pay the judgement. I told the judge that I would accept the vacant 20 Acres of association property adjoining my property with the release of HOA claims. The HOA voted the next week to release the property and remove Caren (Yes her name is Caren) as HOA president. I found out that she wanted my property as access to the additional acres the HOA had purchased to build additional homes to sell. Subsequently, the members of the HOA voted to dissolve the HOA as without the additional anticipated acreage income, they could not continue to fulfill the HOA obligations. The entire neighborhood (save a few) is much happier with the HOA gone.

Your property is your property. No one has the right to tell you how to mow grow or manage it. I agree. I live on land that is Grandfather clause in. They can try but it will be a struggle.

HOAs are voluntary. You choose to buy in one of those communities. Many single family home communities with associations maintain the parks or pools in the communities. For condos and townhomes they are very necessary. They carry insurance on the exterior of the buildings, maintain the amenities, parking lots, and roof of the buildings. If there wasn’t an HOA, then all of the homeowners of these units would have to pay out-of-pocket for building repair. That would be extremely expensive.

Our HOA is actually really good and full of nice people. Just basic rules to keep yards looking nice. Neighbors with bad property also effect your property value. Nothing crazy strict. We can do pretty much any modification or use our property however we want. Just keep it looking decent.

Given their popularity, that's easier said than done. New constructions are already about 75% HOA, and that has been growing by multiple percent per year.

I just purchased my first home recently and I’m so glad there’s no HOA. After renting in a HOA neighborhood for several years, the freedom to do whatever I want with my house and land is incredibly freeing. I’m thinking about staining my bricks navy blue, which would be UNTHINKABLE in my previous neighborhood. The cows out back are a plus. I love cows.
I chose a color halfway between blue and purple for my front door and shutters. It matches the violets and hyacinths in my yard. The siding is gray. I love it and there is no way an HOA would approve. I had a basic deck built in the back to replace the crumbling concrete patio-one neighbor objected because there are no fancy railings or built in seats. Too bad. I had a party with a dozen guests when it was built and none of them complained.
It's beyond me why HOAs even have this much power.

@@zwicker5585They do it because of money. HOA homes tend to appreciate more over the time, also, the neighborhood is arguably "safer". HOA were made to keep poors and blacks out of their sight.
@@zaxmaxlax you are absolutely correct. HOAs were and still are designed to segregate. It was and still is to some degree a money maker. Although, I do think thats changing. Larger cities, within core areas have some of the fastest growing home prices and less HOAs. And arguably alot more diverse than the often outer-city limits neighbourhoods. The further out of a major city you go, the less and less racially diverse it gets, generally.

Unfortunately they're effectively unavoidable where I live... and it's not even like they try to fix the problems, they just fine people for not conforming. My neighbor had to contact them several times over a week regarding a broken sprinkler outside of their property that was leaking and the most they did for a week was set plywood over the hole it was creating...

As a contractor I can say that HOAs are the biggest pain in the ass. Even worse than inspectors. Don't buy a house in a neighborhood with an HOA or you'll live to regret it.

Got fined once for having the bins on the side of the house. I called and said the bins where there when I came to look at the house before signing. Why would I assume they don't belong there? Was told they have a new president that is now enforcing the rules. Again, how was I (a renter) suppose to know this, and all my neighbors have bins on the side. Long story short, I still got fined $45 and I left three months after that. @#$% HOA!

The problem a lot of people run into is having neighbors who either roll over and give in under the slightest amount of resistance, or even worse, the ones who LIKE having someone govern over them and play teachers pet.
When I was talking with my realtor, the FIRST thing I wanted in a house, was NO HOA. I’m to stubborn and petty to deal with that shit.

I think every HOA should have a sundown clause - that they are only allowed to operate for a 5 or maybe 10 year term, and that the members must vote it back in (including redoing the paperwork necessary). Any builder hoa, that term kicks immediately after the last house is built. No more permanent deed restriction hoa.
Something else would have to be worked out for multi family housing.
I bought a house in an HOA and got the HOA dissolved. Apparently a lot of people weren't happy about the HOA but just chose to do nothing. It took a while to be able to bring it up for a vote but eventually we did and the majority of people no longer wanted to live under the tyranny of a bored housewife who was way too involved in other people's lives. If you live in an HOA neighborhood, talk to your neighbors and test the waters. See how they feel about it. If you have enough angry neighbors tired of living in an HOA, you can bring the dissolution to a vote in a meeting. There will be some people that won't be happy about the dissolution but, oh well.
As an HOA VP, I can tell you this is absolutely correct. People can do this. I am not a dick though so people don't mind me haha

I have a couple of entrances that I keep up and the developer turned them over to HOAs after he was done. Needless to say, a couple of the neighbors let me know very quickly that if they would have known that the neighborhood was going to be turned over to an HOA they would have never stepped foot in the neighborhood. So basically they got stuck after they bought the house.

@@Blaster-Master-LukeThat's not possible. An HOA can't just "take over". You need to sign a contract to be part of the HOA to begin with. If the old one gets dissolved, a new one with a new agreement is needed.

Nah bruh’ ur in the majority. I personally never owned in an HAO and will never do. But I have friends and relatives on both the west coast and east coast that absolutely dread their ownerships.
It’s a double edged sword. We don’t have one which is great because I didn’t have to get approval for my fence and what not. But also there are people now that put trampolines and huge gardens on their front lawn and makes the neighborhood look trashy=slower property value increase
When I bought my first house last year with my wife we didn't know how bad HOAs could be. Thankfully we just happened to get a house in a neighborhood without one and I'm forever grateful!

This is rare . I’m from Canada and have 2 condos that have condo / hoa boards . It is really hard to kick some one out of their place and you have to do something pretty bad to get there

It can be something as small as refusing to paint your door Red after 3 requests to follow policy. HOA's became popular in America because of racist POS.

In some cities it's hard to find subdivisions without an HOA, and those that don't have one are sometimes not very nice places to live. 🤷♀️

Remember guys, if you want to eff with the HOA just install a 40 foot ham radio tower, the FCC take precedence over state and local laws when it comes to building infrastructure that aids in private and public radio communications. They also will subsidize your funding for it and fine the HOA hundreds of thousands of dollars if they try to stop you😂😂😂

@AMD1 as someone who lived in a condo, avoid it unless you like apartment living. HOAs in general suck and they are very inefficient with your money
@@AMD1 condo boards are pretty much just HOA's under another name. Condo's are a little different because they are collective physical structures, but free standing homes; all you should have to do is pay a portion of upkeep for common spaces like community green spaces, pools, etc. If they don't have those things, then HOA's need to piss off.
@morgan1027 yes actually I have owned two and currently own a 3500 sq ft home in a NON hoa area (of course) and my value on property has only ever gone up over the 25 years I've owned homes. My first home was even in a less desirable neighborhood and it steadily rose still. You don't need an HOA measuring your grass with a ruler to maintain home values.
Also the types of neighborhoods which have the kinds of people who cinderblock vehicles would never be in HOA areas lol.

In other instances, they write passive aggressive letters to me that my nieces and nephews can’t have a tent pitched behind my cabin on the lake (which is entirely out of sight of the road). Nothing like spending my money to have others think they should be able to control the ability for kids to have fun 🥰

My parents back in 2014 got into a really nice house. The neighborhood only has a playground and a bit of landscaping. $50 monthly in 2014 which was already pretty high. Fast foward to 2024 and the HOA fee have more than doubled with very small neighborhood improvement.
HOA’s are just an excuse for old people to have something to do. Mine actually sent my family a cease and desist letter for my high school graduation sign we put in the yard. They are literally insane.

One of my exes parents live in an HOA and they’ve got grandkids. Thought hey let’s put a play ground set in the backyard. HOA had to pick it out because they are only allowed certain colors. The same HOA also kept sending them fines and letters for months because there was a cargo van that would always park next to their house with a license plate. It was owned by someone like four houses down from them. You would think that the license plate would’ve been run to see who it belong to right but no. Just start fining them because it’s closest to their house.
I've seen HOAs that were run by normal, sane, working adults in their 30s, and it was fine. They had set it up so basically they could stop anyone from being an absolute tool. They didn't have a whole bunch of meetings, no restrictions on what to display, etc.
I think the largest problem with HOAs is that it ends up being Karens who don't have to work and have an overabundance of bitterness who end up running them

How so? It's a voluntary contract you as a private citizen signs with other private citizens.
A wealthy friend had their house painted, and the HOA sent them a letter saying it wasn't an approved color & they'd have to repaint. She asked for the list of approved colors. The HOA said there isn't a list, you just have to show your color to a member of the board and get it approved before you paint, and you didn't, so you'll have to start over. One tiny problem with that plan ... that rule was in direct violation of state law. She told them to pound sand. They said they'd sue. She told them "Do you have any idea who you're messing with? I have lawyers on retainer in four states. Go ahead!" They sued her, and they got eaten alive in court.

What a great idea. You could make a serious movie on a small budget since we don't need CGI or anything fancy, just a good story. Maybe have the HOA board consist of criminals and use it show some of the worst HOA behaviors. Wait until you choose the color they say is allowed... then the LRV is too high and you have to repaint the house, throw a lawsuit get that money back, and then again have to have your house repainted back to the color they "allowed", them throw a temper tantrum you take them to court again, and also they lose again. Because IT WAS ON THEIR LIST OF COLORS ALLOWED. Plus the human eye can't tell the difference between a tiny bit of a LRV to the next, they were trying to make a point and lost. But if you have certain shrubbery that the LRV damages I can see why. This house had none that would be hurt by it.

HoA agreements are part of your contract when you purchase the home. By failing to uphold the HOA rules, you’re technically in breach of contract. They were originally setup to help maintain property values (bc your value will go down if my house is shit even though that’s not how it works at all). Not good advice if you currently have an HOA. Your Association will be taken over by a state appointed lawyer. The rules don't go away. State laws determine what happens when you disband the HOA. it doesn't mean it goes away. Its a 1000% more costly and worse.

1. the trespassers being used to run owners they are prejudice against

3. Trespassers that HOA leaders and members are afraid of
4. The nuance tresspassers who ARE the board leaders/members doing the bullying.

I had a catastrophic medical event that put me in the ICU for six weeks with a single digit % chance to survive. My husband was deployed and under a communication blackout due to an incident and didn't know. I was kept in a coma the majority of the time. The HOA handed me a bill and fine for my unkept yard that was over $3k. No excuses or explanations justified me not having the grass mown. When my husband got home, he took the HOA to court. I don't know what happened as i was seriously out of it for months. I will never live with a HOA again.

I live in one currently and it’s fine but we get a fine of our grass is more than 6 inches tall or we have our organics, recycling, or trash can on the street on the non designated day. We also couldn’t have any basketball hoops on the street or sidewalks. This is the only thing that annoyed me when I was younger because about half the driveways are on a significant incline ( 45+degree) and we’d get a fine. But they were pretty chill. They only sent a fine for these offenses once or twice a month and they were only 30-50$ usually. Other than that the neighborhood was the nicest and one of the older neighborhoods in out part of town and there were nice massive oaks (built in early 80s ) ( I say in my part of town because my duty was founded in 1700s )

There's a particular shady practice that land developers here in Western Washington employ, (and in most of their major metropolitan areas I'd wager), in which they'll buy the cheapest home in a particular neighborhood, board up the windows, trash the lot and not maintain the property in any way. Effectively making it look derelict or like a squatters den. They do this deliberately to drive down the value of the surrounding homes so they can buy up the entire neighborhood for as cheap as possible and then build these god-awful apartments.
It's really predatory as the developer is basically stealing from the neighborhood they're preying on. An HOA would be able to fight against this practice and protect everyone's property value.
I'm not trying to say that you made the wrong choice or that your opinion is misplaced, or that all HOA's are worth the hassle. Whatever works for you is what works for you. But this is one instance where HOA's do have their place.

Ugh. I remember going to my grandpa’s place after he passed to help clear his place. Come to find, the HOA had left notices about some weeds. They probably didn’t know, but it was still frustrating. The weeds were few and mostly hidden to the public eye, and not really our priority at the time. Miss you, grandpa

It's not illegal because all it is, is a contract you agree to and sign when buying the home. There are certain things they can't tell you to do, but most of the annoying stuff they do is perfectly legal as long as you sign the contract.

I went to a community with a HOA to deliver some appliances some weeks ago, it was the most boring looking place I've seen, all houses the same, painted the same, no decorations except for some wreaths or simple lights. There's more life in a hospital morgue than in a HOA run community.

I lived in an HOA neighborhood in FL many years back.
We got a letter on our door stating that the palm tree in the front yard had a dead frond on it and needed to be removed. We had to go onto our roof and use a pole saw to reach it and cut it down.
Meanwhile, 2 doors down, there is an abandoned house with grass and weeds well over the "allowed" height.
Since no one was willing to pay to get it mowed or volunteer, it gets left alone.
Got the HOAs message loud and clear....fine the people who live there and have money but ignore the eyesores because they don't make you anything.

You must live in paradise because in my neighborhood people here have 10 cars per home (most broken down) and they steal my family's, on street parking spots, so we have to park blocks away and walk home.
On top of that, one of them illegally owns chickens that wake me up everyday at 6 am.
I have neighbors that have 5 feet tall grass. Neighbors who leave their front and back yards filled with construction equipment and stolen tires. Neighbors who don't know how to build fences and leave a mess on our yard.... etc etc. I wish I had an HOA here.

My neighborhood is 30 years old and has no HOA and is in almost the same condition as when it was built. Sure a house here and there has shoddy front yards or sometimes someone decides to park their camper out front. But no serious permanent issues. An HOA has zero long term benefits and real long term issues because one tyrannical management period can ruin an entire generation of living in it. Screw that. If you want to live under mini totalitarian regimes go right ahead. The rest of us who came to the US for freedom don’t do not need to be told we can’t grow roses out front because a Karen gets pricked by its thorns.

That is incredibly easy to do! Just don't buy a house that belongs to a Home Owners Association. It's that simple. The reason why so many people do is that their home is their largest investment, and one that they will be paying off for the majority of their lives, so the HOA protects their investment.
I think neighbors can overthrow the HOA if enough people in the neighborhood sign a petition

As a Real Estate Agent I tell all buyers...NEVER BUY INTO AN HOA. Besides all the things an HOA can do to the homeowner, let me tell you why there CANT be any " good" HOAs. Ambulance chasing attorneys look for the wealthy well run HOA as ripe-for-the-pickings and canvas for the one unhappy owner. A lawsuit is filed and ALL the other homeowners suffer because the lawsuit will hold any sales and devalue the properties of everyone. Don't think an attorney won't find the " well stocked" " good" HOAs. They eventually always do. Thank you for the other commentator who reminded me of this lucrative pool of money that attorneys sniff out.

The problem is that the majority (I think I read it's about 80%) of all new developments are HOA-bound. So good luck not buying into an HOA for most people. The laws have to change. State governments love it because they don't have to provide services covered by the HOA (garbage removal, snow plowing, whatever they have set up)
Nothing governmental about a homeowners association. They have no governmental authority what they are is an organization created by contract when you purchase your home when the developer builds, a subdivision full of homes if they create that subdivision with the homeowners association and you buy a home there you’re entering into a contract with that homeowners association. There’s no other choice but that information will be revealed to you during the closing or or even write in the paperwork when you’re looking at the home so just don’t enter into them. Homeowner associations are notoriously annoying How I bought a vehicle from a guy wife living in a homeowners and I subdivision with the homeowners association I got it for a steel Irene literally four probably are a fifth of what it would’ve been valued at normally because he put a lift head on. It was no longer able to get it in his garage wasn’t able to Parkette in the driveway was getting a hassle than a daily basis by the homeowners association and so he let it go to me for MM more importantly he told me this so when I made my offer obviously I really mobile them, he said I can’t let it go for that I said OK here’s my info. Sometimes Darien lake front communities are a trailer parks event you know the higher tier trailer parks will have rules like that they will be a situation where I start renting the lot you’ll be buying the lot and subject to the page.
