This must now be revised in view of the ammendments brought about by RA11648 : Rape can now be made by a woman or transgender to a man : refer to sec. 1 changing the wordings to read: "1) By a PERSON who shall have carnal knowledge of another PERSON under any of the following circumstances:" the exclusion of the man or transgender as victim of rape no longer holds as the text of the law does not specify the offender to be solely be a man, but may be other persons meaning man, woman or trans, who belongs to the classification of "person". man can now be rape by a woman !

If the mental defect or illness is such as will deprive the offender of the consciousness of his acts, he will be exempted from criminal liability. If his mental defect did not deprive him of the consciousness of his acts, ordinarily it will be considered mitigating. However, since the imposable penalty for rape is reclusion perpetua which is an indivisible penalty, mitigating circumstances cannot be considered in the imposition of the penalty.
