The inquest can be had on the next working day if no prosecutor is available to conduct the inquest.
Sir ask po pano po ang public officer ay hindi niya nadeliver ung latter sa judicial authorities within the time prescribed by law liable po ba siya
Pag wala pong na-ifile na kaso within the prescribed period kailangan po i-release ang arrested person. Pag hindi po na-release (meaning, he continues to be detained), pwede pong kasuhan ng arbitrary detention ang pulis.

@@FiscalEJ opo, yun po bang 12hrs,18hrs at 36 hrs dpat nsampahan na ng kaso ng fiscal o nadala na ng pulis sa fiscal? Pano nmn po kung sasabihin nila na ang reason ay walang fiscal or hindi pa pumapasok ang fiscal? Pero lagpas npo sa prescribe time?
@@rommelnening5993 sa loob ng 12, 18, o 36 hrs dapat may maisampa nang kaso sa korte. Pag hindi pa ho nadadala ng pulis ang arrested person sa fiscal o pag wala pang naisampang kaso ang fiscal sa loob ng 12, 18, or 36 hrs, kelangan i-release na ang arrested person. Pag nasa kulungan pa rin at lagpas na sa oras, magiging liable na for arbitrary detention ang pulis.
Pero pag dinakip yung tao nang sabado, linggo, o holiday, pwede pa ring iinquest sa lunes o sa next working day.

Sir may laban po ba if halimbawa kinuha ng police nov 1 ang accuse hindi na nakauwi ng bahay then malalamn po namin na nasa presinto na at naka lagay sa police statement ay Nov 2 nahuli nila sa buybust operation . May mga evidence po na nov 1 palang ng gabi ay missing na ang accuse at nala man namin na nka detain na sa police station. Sana po maka reply po kayo salamat po

Pumunta po kayo sa pinakamalapit na PAO office. May mga lawyers po dun na makakapag bigay ng tamang advice sa akusado. Mas maganda po kasi na yung akusado mismo ang makakausap ng abogado para kumpleto po ang detalye ng pangyayari. Mahirap po kasi mag bigay ng advice pag kulang ang facts. Karapatan po ng akusado na makapag usap sila ng abogado nya.
