      attny. noel, paano po kpg hnd kumpleto ang pirma ng deed of absolute sale ng isa sa mga vendor at hnd notaryado, pero nasamin po ang orig deed of sale at orig title at updated ang amilyar sa pagbbyad pero hnd pa ntransfer sa name ng nakabili

    Thank u po atty kasi po nangyari po si amin ay nagpagawa si special power atty yong nag morgage sa Title ng lupa mg lolo nagpagawa ng SPA dated Aug22 1983,natay lolo ko Oct.2,1967 kaya Niloko lang lolo ko ang masaklap sa Administrator ng lolo Tatay ko kaya i prepare ko lahat ng Doc.para presentation sa Court.

    New subscribers po ako atty.. May nabili po akong lupa 250 sqm at mother title lng ang meron.. Na fully paid ko na po nung 2019 at acknowledgement reciept lng ang pinagawa nila.. Ngayun 2020 bigla pumunta ang may ari na 350 sqm daw dapat ang kukunin namin dahil yun ang nakalagay sa subdivision plan kaya pinapabayaran yung dagdag na 100sqm kase d daw pwede mapatituluhan yung 250sqm..tama po ba yun atty at ano po kaya ang dapat na ikaso ko sa knya kase ayaw daw nya kami bigyan ng titulo kung hindi makompleto ung 350 sqm. Salamat po sa pag tugon atty ang God bless you po.

    Good day po Atty. Hope you are doing well. May itatanong po sana ako. May bibilin po ako na property na may kashare ako sa bilihan. Bali magiging business partner po kami. Pero since nasa abroad sya kelangan nya po mgprovide ng SPA para po sa pirmahan ng deed of sale. Pwede po ba ako na din ang gawin nya na authorized sa SpA kahit po ako ang ka business partner nya?     good day po atty.naipacancel po ng isang tao na nakabili po ng dalawang bahagi sa lupa minana ng tatay lolo namin,lima po silang magkapatid,hiniram po ung titulo,nagulat nalang kami naipacancel ang titulo,hindi na po ibinalik ung titulo na hiniiram,kumuha po kami ng kopya sa registry of deeds subalit iba na po ang tutulo dahil cancel na po dating original na titulo,ano po dapat naming gawin para makakuha kami original na nito upang mae pa relocate namin ang kabuuan ng lupa,sana po mabigyan nyo kami payo ukol dito mabuhay po kayo

      i might as well add ...original deed of sale was surrendered to me personally...by two persons ...who were the buyers...of certain lots..all completed...and they were told ...while i was away...years ago...that i was DEAD...through a "sole and surviving heir" in the deed of sale...these people said :"we honestly did not know there was YOU...the missing eldest in USA" ...BY the younger sibling and his wife that made the document...they are also the ones who kept the MALETA from me....i don t know what ELSE many other things they have done in my long absence after our eldest died a decade ago...and long after my mother died....laywers HERE seem to be reluctant to help me....because they are "connected"...it seems i can not even ask the proper people for answers..what ELSE were they doing ...all these years? even after i had given them hundreds of thousands of pesos from my efforts for just a few years now...? even had the old house fixed when i was abroad...tried to send something to revive the farm..had to help upgrade the house of another sibling with family IN canada also fixed by sending one million pesos from HERE...? yet they were tight lipped when i was just trying to ask about things i don t understand? ano ba ang situation na ito? it is clear...from what people told me as soon as i arrived..."MARAMING NANGYARI..BUTI NA LANG UMUWI KA....TAKOT SILA nang may news na UUWI KA NA" (2017) and ever since ni FAMILY council man lang...AYAW mag paimibita sa old house...very disrespectful pa...sisgaw pa ang WIFE "layas ka!!! hindi ka tagarito...balik ka sa pinanggalingan mo...amin lupa amin?!!" IN FRONT of neighbors pa ?

    I have a question Atty. My grandfather died december 2003, however there is a deed of sale created november 2004 (almost a year after my grandfather died) that our property was sold to my aunt... our property is owned conjugal by my grandfather and grandmother but there is a deed of sale that was signed by me grandfather almost a year after he died... my question is that is this deed of sale null and void? since my grandmother also signed it while she was alive does that mean that her part of the sale is legal and only my grandfather portion is questionable?

      The whole deed is void. It should be cancelled voluntarily or in Court.

    Atty. Meron pong hawak na deed of absolute sale ang kabilang partido na umangkin sa lupa ng Lolo namin, pero di po ito nagtutugma or may katulad na Tax Declaration no na nakasaad sa mga tax Declarations na hawak namin, wala din pong Kung anong lot no. Na nakalagay sa deed of sale. Maituturing ba itong falsified? Untitled po ang lupa. Sana po may kasagutan. :)

    Good morning Atty. Murillo, new subscriber here po. Ask ko lang nuong 2014 po nakapag fully paid po kami ng lupa na binili namin. May deed of absolute sale po kami ang problema po may hindi napagkasunduan si developer(siya yung nag asikaso ng mga papers ng lupa) binawi po ng husband ko yung papel namin ang nangyari ay hindi po napa notarize ang Deed of sale namin at di naman namin pinansin yun not until now na nag decide po kami na ibenta ang aming property. Pwede pa po ba kaming magpanotary sa nasabing document atty? Ano po ang gagawin namin, si developer po na pinagkatiwalaan ng may ari ng lupa ay patay na although buhay pa po yung asawa niya at yung anak na po niya ang nag aasikaso ng mga papers. Please po Atty, need your help thank you so much po.

    Hello po Atty. Isa po ako sa mga masungid na tagasubaybay ng inyong YT channel mula po dito sa Canada at lahat po ng topic ninyo ay tumutugma sa kasalukuyang problema namin na magpipinsan sa mga natitirang lupa ng aming yumaong lolo. Wala na pong buhay na anak ang aming lolo maliban po sa isa na tumb mark lang ang ginamit para makapagpagawa sila ng Extra Juditial Settlement of Estate at Deed of Absolute Sale at nailipat ang title sa nakabili ng aming lupa.

      Itatanong ko din po Atty, kung may karapatan bang hawakan nung bumili ng lupa namin yung Mother Title samantalang portion lang naman po ng lupa ng aming lolo ang kanyang nabili? Meron ba kaming karapatan na mga Heirs para kunin sa kanya yung Mother Title?

      Maaring ililipat lng ng buyer ang title sa ksnya nung portion n nbili nya. Pero ibblik din yon.
      Pero, dhl hindi nkpirma lhat ng heirs sa EJS with sale, pwdng ipabalewala yan sa korte.
      Need lhat ng heirs to sign.
      Punta n lng sa isang lawyer dyan sa inyo thru your representative for further advice.

    Atty. Noel, exactly ganyan po ang kinakaharap ng plaintiff sa aming kaso sa Manila Regional Trial Court Branch 51 dhl nauna kming bumili ng 24.5 sq m out of the 172.50 sq m na pagaari ng namatay ng vendor kya instead na 148 sq m lamang ang dapat bilhin nung 2nd buyer, pinatituluhan ang buong 172.50 sq m dhl falsified ubg signature ng vendo r dhl namatay sya noong Seotember 8, 2018 at ang notarization ay ginanap nman noong Seotember 22 2018.

    good day po atty. pano po kaya namin mababawi yung lupa ng lolo namin na nasanla...nawala po kasi lahat ng documents namin ... pinuntahan din na po namin sa assessor wala na po record dun..wala na daw po lupa ung lolo namin ..eh hindi naman po nila naibenta un...sana mapansin nio po...salamat..

    we are preparing EJS ( mother &kapatid & me) pero i demanded waiver of rights since nobody is interested sa property. mother wants to give her shares. same with the kapatid BUT the kapatid abandoned the mother & cant be reached. how to go about this? Can I exclude him & proceed with deed of sale instead?
    kapatid is disinterested . wants to sell the property even @ 200k for faster disposal.

    Atty Murillo, 3:52 po ganyan po ang case ko. Nag issue daw po ng Deed of donation notarized in Makati sa kapatid ko at naibenta po at di ko po alam. Void po ang title na yun po di po ba? Dahil di po ako papayag na makuha ng new owner yung share ko. :(

      @@atty.emmanuele.murillo3563 Mama ko daw po, notarized in Makati impossible po yun dahil magmula nang nagdialysis si Mama hindi na po siya nakabyahe at pinalayas din po sa bahay kuya ko dahil binantaan nyang papatayin niya silang lahat. Wala po ako sa bahay nung time na yun. AT kung totoong naissue deed of donation sa kanya 2013 pa po namatay si mama dapat nuon pa nya inasikaso. humihingi si kuya ng copy ng loss title pero yung nakabili nagissue din ng photocopy na nakapangalan na sa kanya yung property namin. Nagissue sa pinsan ko na nakatira sa property dahil pinapalayas na sila. Pumunta po ako dun para sabihin na wag silang umalis. Hinahanap ko po yung original title kaso di ko makita. nawawala po. I want to have a copy of the loss title para matransfer sa pangalan naming dalawa yung property kasi mana po naming dalawa yun. At may 3 pa kaming vacant lot na dapat matransfer sa pangalan namin. I am the youngest po, niloloko ako ng kuya ko. Sya na ang nakinabang sa rental income nun for more than five years dapat hati kami dun. Over 900k na yung rental income share na dapat kong makuha dahil pinapaupa nya yung property.

      Kung falsified ang deed of sale ay pwd p nmn. Pero kc 10 yrs ang palugit ng batas para kung criminal case for falsification ang isasampa.
      Sa civil case nmn ay need na patunayan na peke tlga sng pirma. Wag lng npkatagal na ay pwd p nmng maghabol

    Atty Noel ano po ang pwedeng hakbang na gawin kapag ang titulo ay kinuha tapos humihingi ng kondisyon para ibigay iyon. bayaran muna ang naibenta na lupa pero hindi naman nakinabang sa pera. Kaya ang nangyayari po nakapagbenta ng lupa pero letter lang at hindi naman authorized ang nakapirma.
