    Every judge in the Supreme Court should be a strict Constitutionalist. Their job is to rule if a law, a verdict, or a sentence is Constitutional. When they apply partisan politics, we all lose.

      But isn't the argument originalism vs living constitutionalism? Is there a prescribed method for reading the constitution that is enshrined in the constitution? Did our founding fathers leave us with instructions in this regard or did they have views on this? I'm honestly asking as I don't know the answer.

      @@dennisd9875 I would imagine the constitution is read with precedent and case law in mind. I think where you get into issues is when there is nothing in history to support the constitution which means it has to be interpreted. For example... In the case of the 1st Amendment of free speech how would it be interpreted in the digital age where we now have texting, email, television, radio, TH-cam, etc. You then have to look at the intent of what they wanted in establishing the 1st amendment and apply the constitution accordingly. You definitely don't want it off of the current opinions of party politics.

      That’s been the biggest complaint about the Supreme Court. Their not even close to being Strictly constitutional! That’s exactly why cases go to them... Search and seizure, African American civil rights, abortion, police brutality, sexual assault on campuses, mass shootings. They lean in favor of popularity, minus one generation. Instead they should act as resolute constitutional oracles not passing judgements equivalent to my hip aunt & casual alcoholic.

      Ginsburg made her dissenting opinion known in 2016, the Senate rendered their decision, Ginsburg accepted the decision and graciously welcomed Gorsuch to the court, then cited the new precedent in her dying wish. Although this isn't technically a matter of case law, it more or less follows the same logic. It's not hypocritical to ask that a principle, once established, be consistently followed.

    There should be a mandatory retirement age for all Supreme Court justices. By 80 they should retire.

      What we need is a Constitutional amendment fixing the number of Supreme Court Justices and then imposing a single term limit twice the number of Justices. The terms all run out on an off election years so politicians are less likely to pull shenanigans when picking their replacement. Also set a time limit for how long the Senate can sit on it. We don't want seats being left open for years on end. If the Senate fails approve a nominee the President can put a Justice in for the interim until the Senate can make up their mind. If a Justice dies, or retires before their term is up someone is nominated to only fill the rest of their term. If it was less than a third the length of the term they can be considered for being renominated to that seat. So of we have 9 Justices there would be an 18 year term and the most an individual could conceivably serve do to retirements is 24 at most. The length of these terms and the fact they only get one means it maintains a Judges independence from politics while they serve, but also doesn't mean the hold these seats indefinitely and making their health and well being a high stakes gambit.

      No I disagree either they die or retire. Plenty of people these days are living to 90 and are still functioning fine but some people start getting Alzheimer’s at age 60 so a age can’t really determine when they should be kicked out.

      since theres 9 at any time,
      3 Republican, 3 Democrat and 3 Independent, that way it cant be partisan, as they would need the independents votes as well.
      and to add onto that, if a justice were to die or retire they can only be replaced by someone of that affiliation, in otherwords if a 1 republican were to die or retire, that seat can only be replaced by a republican, so on and so forth, so you cant then make it where it becomes 3 dems, 1 independent and 5 republicans, you can only have a 3/3/3.
      that could go a long way to fixing things, but obviously no political affiliation would be best, but that proposal of mine would be a compromise.

There were supposedly 100+ guests and no one takes a picture .... maybe they confiscated every device.     Let me just say that as an Australian the fact that America invests so much into the Supreme Court and that it is a source of so much division is beyond bizarre. The counterpart here is the High Court, literally no one on either side of the political aisle care about who is appointed. It has never been an election issue here and every time a replacement needs to be made the media barely covers it and the parties somehow manage to just do it without any fuss even if in times of divided government.
    So putting ideology aside, I think at least part of the reason is that there is a mandatory retirement age of 70 years for each justice on the court, and we have 13 seats instead of 9. Structural reform along those lines could ease up some of the division but given how things are in America and how bipartisanship is basically dead I don't see how any side could do that without it being seen as a power grab.

      That is because starting in the 60's radicals started to use the courts to get what they could not win at the ballot boxes. Perfect example of the judges who blocked Trump's travel ban even though the law let him do it. The SCOTUS allowed this.

      Luigi Vincenzo Luigi. I'm an American lawyer, and you make a very good observation. The American Constitution is a brilliant document. It is, however, not without it laws. One of those flaws that has led to the mess we are in, in this regard, is this: the document was written at a time when life-expectancy was no more than 36-38 years. In an attempt to insulate judges from immediate political pressures, under the US Constitution, federal judges are confirmed for life by the Senate.
      No one then ever expected judges to sit in the Surpreme Court, literally, for decades. This situation was not anticipated, but life tenure at the Court when expectancy is now in the 80's and nearing the 90's has created this mess. An open seat is considered now to be a Republic-defining event that lasts for generations. This flaw has resulted in a hyperpolitcal view of the Court and, also, has moved to delegitimize it.
      Every open seat is a fight over the direction of the law that may last for generations.
      There isn't any good solution to this problem, short of amending the Constitution - a process that, especially in this repect, is practically impossible.
      It's a mess.
      Yes.
      RBG should have stepped down when she got her pancreatic cancer diagnoses and allowed Obama to make the next appointment.
      She didn't.
      It's hardly the Republicans fault now that she choose not to do.
      It is, though, a mess, and the Left may, indeed, as Shapiro says, be willing to tear down other American institutions down to get what it wants.
      There is genuine outrage. Imo, however, such outrage is misdirected because it should not be directed towards any party, but towards the fact that the Constitution is flawed and should be corrected to save everyone here this turmoil.
      If RGB was required to step down at 70 as there, America would not be in this crises.
      She brought chaos on herself and in the rest of us,

      We did have a referendum in 1977 that amended the constitution to provide a retirement age for federal judges which passed overwhelmingly, but even if we didn't have that amendment I don't think Australians would be as divided over the court as in America.
      I'm not saying that we aren't polarised, issues like immigration, climate change and how to deal with China divide us as much if not more than in America, but so many other issues just... don't, for whatever reason. Gun control and universal healthcare come to mind, both parties and the Australian public at large overwhelmingly support such policies. There just seems to be a much broader array of issues in America that have been tainted by the Left/Right culture war.

      Luigi Vincenzo this mess is more complicated than can be explained here, but, in short, there is zero electoral currency in compromise anymore. Compromise as politics operates today doest not help re election chances, but rather harms them.
      The fault IS largely institutional, but the devolution of all regular media into pure commentary on all sides hasn't helped.
      That said, if say, Justices had 12-year terms or some such thing - there would be less of a sense that one judge is the property of one side or the other.
      The fact that they are there for generations just hasn't led to much good.
      These justices used to be confirmed by the senate with substantial majorities of both.
      No longer.
      The perception is their votes on cultural issues especially, run according to the party line from which they were were associated.

      “release the Karen” asks to what end? The Supreme Court had already heard the arguments for Friedrichs v. California Teachers Association and were prepared to vote on it in June. Scalia would have been the deciding vote in favor of Friedrichs. But since he died in February the vote was tied at 4 to 4 and the right to work Issue involving unions didn’t come up again until until several years later with the Janus decision. The Democrats lost hugely with that decision. Now you know, to what end.

    First and foremost, I don't believe RBG's daughter even a little bit. That's a flat-out lie.

    Second and lesser-most, I don't mourn RBG's passing, because the *only* reason I know of her existence is because of her job-position --- a position which she routinely failed at. And if her granddaughter is to be believed, she failed at her job until she had no pulse, because her "dying wish" isn't Constitutional. Constitutionally, the President nominates, and the Senate approves.

    If RBG felt that her seat being filled by a liberal President was that important, she should've retired under Obama. But on this one point I will not blame her, because her friends in the MSM lied to her and all of us about what the polls were saying. They were trying to *make* the future, not *predict* it. So in RBG's defense, she probably just assumed that she could bow-out under four years of HRC.

    It's ironic that this situation is unfolding the way it is, *not* because of a spontaneous death, but because of liberal lies. If pollsters had told the truth, we possibly -- or even probably -- wouldn't be having this discussion now, because RBG would've stepped-down under Obama.

      I don't like a lot of what the Democrats are saying these days, but they're not wrong on this one buddy. The hypocrisy is undeniable and it's embarrassing. Republicans would _lose their shit_ if the Dems completely blocked a conservative judge for a year out of "principle" and then fully abandoned said "principle" once it stopped benefiting them. Hypocrisy is hypocrisy.

I would be perfectly happy with a conservative justice, by the way, but the problem is that this behavior is hypocrisy, pure and simple. I don't believe in brushing that off as just "politics". Why bother arguing over principles at all if violating them is just "politics"? I'm sure you don't just brush it off as "politics" when the Dems blatantly violate one of their own principles. The right certainly does call it out, as they should. I call it out. If you are a person of principle, you should call it out _no matter who_ it's coming from. Having principles means sticking to them even when it isn't convenient for you. Without agreement on things as basic as this, all that's left is partisanship.
