      Did you bother to listen to the whole thing? She isn't suing, she just retained a lawyer to respond to the asshole owners threat of legal action for just telling her story. However, she does have a legal compelling case for wrongful termination.

      Actually from what I understand the owner took "taxes" out of the original $10,000 which they shouldnt have done , that is straight up theft and then said the rest was to be split with ALL the wait staff , including those that didnt work that day ( so their daughter could be included I think ) some of the kitchen staff got mad and rude because they werent included and this server went to her boss about it but didnt want to name anyone so she was punished and sent home supposedly for 1 "mental health day " , when she texted in the next day to find out her shift she was ignored , then ignored again when she texted the next day , she then said she didnt like playing games and asked if she was fired and was told yes . She got $1600 out of the $10,000 , got ignorance at work , got punished and sent home , got ignored , treated like shit , fired , then threatened and intimidated .

    What really bugs me is that while $10,000 could certainly make life easier for her for a while, it's not anywhere near life-altering money. And since she had to share it with several other staff, and then pay taxes on the rest of it, it doesn't sound like she walked away with much of anything. And because of this, her jerk coworkers complained and raised a big stink? And then, on top of that, her crappy bosses fired her? Amazing how such a lovely story took such a terrible nose-dive due to other people's pettiness and greed. I feel so sorry for this woman. She seems so soft-spoken and humble.

      @@dianep6791I’m not sure how they could have paid taxes for her, as tips aren’t usually taxed up front. And, when they are, it’s deducted from the pay and then paid to the tax entities. So, it would have been her money paying it.

My at will business was sued by an alcoholic employee who was showing up drunk. Not only did they get rehired but they also got rehab paid for AND damages !!     Lindsey's employer violated several laws. The owner, managers, or supervisors have no right to tips or to be in a tip pool. Waitresses are only obligated to split tips with other wait staff on the same shift. Where is Gordon Ramsey, the owner needs shamed?

      Why should a waittress split her tips with the rest of the wait staff? If my waitress does a good job, I leave the tip for her, not for the bozo serving other people on the other side of the restaurant who I never even met. I can understand cutting the busboy in, even the cook. They all contributed in some way to my dining experience. The one group who had nothing to do with it are the other servers!

      Of course. Thats why tip sharing was invented....so owners and managers could get a cut of the server's tip...which is in reality their commission. They also claim it makes it easier to do the accounting (lie) and increases teamwork (lie).
      Most of the staff works for at least min wage, EXCEPT the servers who get $2/hr and commission (tips). The $2 is enough to cover 8% of gross for SS and 20% for Fes and State income tax witholding.
      No business that night servers take home $10 but it is likely deducted for taxes ...however they did hours of setup and restaurant chores for literally no pay.
      My wife worked as a server in her 20s....she refused to be in a tip sharing pool.

    As a humble delivery driver, I received a $50 tip for delivering some pizzas to a veterinarian office on Christmas eve. It's the biggest tip I ever got, and I was so thankful.

      Years ago, got a 4 cent tip on a hundred dollar order. These folks had a party every weekend and this is mid nineties. The owner was a great dude, drove right out to that house and dressed them down. After that, they tipped well and he also added a tip, to boot. RIP Kevin.

    Mason Jar Cafe has removed their Facebook page, suprise, suprise. This poor woman. No good deed goes unpunished...the old saying. That restaurant is despicable. She should immediately stop payment on every check she gave to co-workers, if she wrote checks, and keep the money since she now has no job and is being harassed for being honest and generous. I am sure the tip-giver must be horrified at the treatment she is suffering and would agree. I hope NO ONE goes to this restaurant. Boycotting them is the only thing they will understand!

    A good friend of mine passed away a few years ago. He just so happened to be a multi-millionaire. We had a conversations about money and the power it can have over people. He told me that if he wanted to destroy someone's life, all he had to do was GIVE them a large sum of cash money. In some cases it would take a million, and in some cases only 10K would be all that is needed. The lesson in my story is money does not change people, it reveals them.

      yeah unfortunately the biggest problem is often ppl themselves; lack of sense, decency, compassion etc & for many, too much focus (or obsession) on power & desire for dominance & superiority, with the greed taking priority over all else, so tragic! if only such folks could have their hearts fixed asap.. so they can stop spreading their misery regardless of their own financial status! money doesn't make ppl crazy, it's ppl who let their own mind & feelings drive everything that "go crazy" when they get it.. thus, you could ruin an ~unstable person's life OR a person that happens to be surrounded by unstable ppl like this innocent server, by giving them money, but you could also bless those who are truehearted & full of kindness & consideration for fellow ppl ♡

      In New Hampshire it’s $3.26 an hour. And immediately after Biden was elected the Republicans in New Hampshire passed the law that said even if federal minimum wage went up servers would be staying at $3.26 an hour. And then they wonder why nobody wants to work in the restaurants. 🤷🏻‍♀️

      that happened to me on my first job. I finally figured out why I was fired, but it was painful when it happened. I knew I was a great worker, on time etc. It made no sense that I was fired. So sad that jealousy and greed exist, but they do.

      Businesses have every right to send demand letters and threaten legal action because in their minds, she did something either illegal or unethical. I'm a defense attorney and we are trained to try and gain perspective understanding of both sides. It's a shame they didn't air the recordings..

Not all lawsuits are for money, and when you make a countersuit you can in fact ask for something quite different as a form of damages. From personal experience don't ever allow them to get away with it.

Michigan is an all-party consent state for recording private conversations, which could make the recordings unlawful under their state law, though doubtful the AG would go after her in this situation. That may be why they chose not to air the recordings.

      wonder if the county has a health dept ??? in my county, we have a Dept of Health managed by the state. Every so often, they conduct inspections of the premises.......and those that FAIL, are publicly disclosed to the media and a RED Placard is issued on the window!!!! until the problem is resolved.....

      While I agree that you should keep your finances close to the vest, I'll drive, purchase, travel, etc however I want to because I work hard for it and make choices in my life that allow me to live well. If my boss and/or coworkers can't handle it (and many haven't been able to), that is on them. My life will be as glorious as I want it to be and they can focus on making their lives what they want them to be. Me dimming my shine won't level them up.

      Yup…but depends on how it was distributed. At my place , if it was visa tipped, I would have paid the taxes then distributed the required percentage in cash to back of the house and my Busser but that was always my complaint with this system: my wages went down with the tax while theirs went up(and they usually made more per house as servers usually only get minimum wage). Tipping is a bonus…people don’t share their bonus’…just saying. Restaurant work is filled with entitled drama queens who are usually the slackers but somehow they seem to have a bigger team and those like Lyndsey get the shaft! Also only those she worked with she only should have had to share with. Team Lyndsey!!

      Legally she has to pay taxes on all her tips. The IRS makes you do this, not the owners. The owners also legally have to pay payroll taxes on this money.

    I just tried calling that location to ask for more information about what’s going on and two of the employees lied to me and told me that I reached the Tennessee location which is closed, and the owner or manager of the location. I was speaking with finally talk to me after four different phone calls and she told me it’s none of my business what happened and I shouldn’t even care because I’m from California, I asked her why she could hear their side of the story and she said labor law prevents her from speaking about any of it and it’s none of our business anyways

      Michigan is a state with at-will employment. Unless employees are union members or have an employment contract stating otherwise, they can be terminated at any time, without notice, and without reason. Likewise, employees can quit without notice at any time.

    I don't think the cafe taking legal action over a social media post would goo anywhere. She needs to sue them for wrongful termination. And if you live in the area, in sure there are restaurants who don't screw their employees.
