    Sadly, this could have been my story. My daughter and I were watching TV when we heard a loud bang. A few minutes later my neighbor knocked on my door to ask if I had heard anything. I stated yes. He apologized saying it was fireworks. After the TV show ended, I went to tuck my daughter into bed, I was shocked! There was a huge hole in the wall and ceiling. And my daughter’s bed was covered with debris. I immediately called the Police. Long story short, the guy claimed he was cleaning his rifle and it accidentally discharged. The cops spoke with him but didn’t arrest him because he had the rifle legally. I immediately moved out. Thank goodness, I allowed my daughter to stay up later than usual that night. My heart breaks for the parents.

      I can't even imagine.... am so glad you and your family are safe. Just makes you think how we can be killed by someone any second no matter where we are..in school, mall, bank or even inside our home! This is crazy.

      Not all people think that way unfortunately. My wife's mother was killed in front of her house in Oakland, CA when a Civic was speeding and ran her over. He never cared to stop. That person killed another human being and was never caught.

This is no different. I am sure drivers dont go out intending for an accident to happen. but still they pay the price. this one was looking for an accident by shooting through into another room. this is what it equates too. he shot into a room deliberately.

      You don’t… if it were truly an accident. Absolute lack of training and zero awareness as to potential injuries or worse! His duty as the gun owner as well as being responsible for the negligent discharge, was to immediately call 911 and then account for the fired round, unless precluded from doing so, (locked door, unable to locate, etc) Also, what father doesn’t immediately advise their son to call 911, upon hearing the shot and realizing what happened?? What an irresponsible parent.

      You see the problem is most States, counties and cities have their budget on the reds which explains why many streets are bad. In order to try to balance the budget they try to avoid keeping criminals in jail feeding, housing and clothing them. The money can instead be used to pay top dollar salary for top officials, fund their pension and insurance. Free breakfast and lunch at work. Why waste so much money on criminals. They can be locked up for Short period or be released

      Laws don't have to change, they need to be enforced.
      Secondly, we need to make prison feel like prison. Stop incentivizing it. Make it a deterrent to go there. Stop giving "free this and free that".

      It’s a case by case basis you can’t make a statement like yours because it’s just not true, the war on drugs Richard Nixon started in the 1980s started the harsh sentencing guidelines on a federal level but then you have state by state example California 3x your out law get 3 felonies and you get life, not all states are like this there are people from the 80s that did 25 years plus before they released tens of thousands of drug offenders that had extremely long sentences that did not fit the crime. Every president elects people that are in the United States Sentencing Commission and they have power fo change the sentencing guidelines you people elect these people into office but have no idea their political views, what they plan to do, if they are even competent to run as president unlike some people (that are still in office today somehow) you can’t just complain and expect thing to change on their own. Do you even understand how bad drugs were in the 1980s when they made the laws? They made them for a reason I’m Miami alone there were more than 5 killings A DAY, A DAY one city in one day 5 murders x 30 days a month 150 murders MINIMUM a month over 1800 a year but all of south Florida / Los Angeles / New York was like this you think the homeless and drug problem is bad now how about in the 80s when all you heard was machine gun fire, gangs were everywhere drugs were everywhere they were super cheap and 50x better than the garbage you get now 1979-1987 was just one big party everybody did something.

    I got a phone call like last August 10 from the medical examiners office. My son was found dead in his apartment.
    My heart breaks for that Mom, I know how she feels.
    Prayers for comfort and peace for the family and friends of that precious young man.
    My son was saved when he was 5. Now I look forward to seeing him in heaven.

      Probably just dropped the mag and didn't clear the chamber. Some guns have a mag safety that prevents it from firing unless there's a mag inserted, some don't.

    This happened to me about 2 years ago. I was out of town and my boyfriend got home from work to find a bullet had gone through our wall and into our ceiling. It would have hit me if I was working from home that day like I had been for the past couple of years. I went to the front office and filed a complaint once I got back. Apparently once they reached out to the person who shot into our apartment, they claimed they were cleaning their gun and accidentally shot a bullet. When I asked why they didn't report it immediately, they said they went to my door and knocked but no one answered so they left it as is. Like what if no one answered the door because we were dead????? Makes no sense! They got evicted but I still think about it to this day.

      Even in the military, with extensive safety training that includes MORAL RESPONSIBILITY to use guns with only safety and protection in the training, there's still a small percentage of military who go through training who don't have the psychological capability to be around guns. Accident or not, the carelessness in cleaning a loaded gun is a MORAL LAPSE in reason. He wasn't responsible enough to care about the potential damage. He cared more how to convert the semi-automatic gun into fully automatic. He shouldn't have ever moved beyond squirt guns.

      @@uliperezsatx , there's not much public information yet, but it still occurred in Hays County, Texas, and it doesn't look like any court-martial was involved, which would be the judging body for something like this if it was handled by the Army.
      It seems some incompetence was involved in the sentence processing (or maybe intentional shielding, who knows?). In any case, this is something that would definitely get overturned at a higher appellate court, because 90 days for negligent homicide is ridiculous and half of the bare minimum for Texas. It's just terrible that the family has to go through the appeal process.

      My father had a glass gun rack in the den with the key in it. Drawers of bullets, cleaning stuff, vests, shells, but we never once thought about playing with a gun. Dad took us out and taught us, one lesson at a time, always supervised.

    If the roles had been reversed this would have never been the case. The charge should be what it is murder, or at least negligent homicide. If he can carelessly play with a loaded weapon while talking on the phone and discharge that weapon with a lethal shot going thru the wall into the neighboring apartment and never be responsible enough to check on his neighbor. No less than negligent homicide.

    Unpopular opinion: Justice is not about revenge. It won't bring back their son. It's better they focus on their grief and coping with it internally. Forgiveness heals more. The guy was appropriately charged with manslaughter. It was not premeditated murder.

    He was on his phone with his dad...1) when you live in a complex like apartments condos townhomes and share a wall with someone else you shouldn't be cleaning or modifying your guns in that space 2) as he said he was on his phone with his dad did they both not think to check where the bullet went after he accidently fired his weapon? Did the Dad not ask him to check where it went? This is soooo unbelievable that he should NEVER have another firearm EVER again...condolences to the victim's family.

      Modifying and cleaning a weapon in a residence is not anything special or unique as far as I am aware, it is common practice. The failures in this scenario are 1) Failure to clear the weapon 2) Failure to manually/visually check the chamber 3) Failure to follow up on a ND.
      TLDR: Negligence in following basic gun safety procedures due to improper training or a lapse in judgment.

Most individuals can understand the basic laws surrounding firearms when instructed, and operating a firearm does not require any special skillsets. The basic safety procedures with firearms such as how not to flag someone, proper unloading, etc. are more influenced by personal action/muscle memory gained through repetition which similar to a workplace, despite the proper rules/regulations on the books, have big difference between those who routinely follow the entire safety procedure and those who do not.

At the very least they should be required to complete a set amount of hours of practice driving before they're given a license....which is what we do for driving. I mean apparently (as so many gun advocates like to claim) more people die in car crashes and yet we still do more in regards to following the regulations in place for obtaining a car and a driving license, than we do for guns, objects that are made to specifically kill things.
      Sure, we can't stop ALL people from being irresponsible, but at the very least we can try a little bit harder to lower the amount of people who shouldn't own a gun from doing so.

    My best friend lost his son exactly the same way. Her son was sleeping when his roommate fire his gun while cleaning his gun. Until today I still wonder of this accident.

This is someone whose life was all before him being ripped away by someone old enough to know better that to carelessly be handling a weapon while talking on the phone. Furthermore he knew he fired through the wall and went on with his evening never checking on his neighbor. If he had checked perhaps the man could have survived. This is a case of negligent homicide.
