Trump was not in the Legislative branch, nor the Judiciary, so Trump's opinions on the matter are totally irrelevant. he could have signed or vetoed a bill while in office, but that is it. His guilt or innocence is also irrelevant. Traditionally, guilt or innocence is determined by a court of law. So what he claims about innocence or guilt are also irrelevant. A claim is not a determination or a demonstration. So you are way off the mark on several counts. But I get the sentiment.

  • @roberthunter6927

Even a serving president should not be immune from criminal prosecution. Here is why. Suppose a POTUS ordered that all POWs, who are unarmed and not offering violence, shall be executed. This would be a clear case of the POTUS doing his official duties as commander in chief, but those orders would be contrary to both civil and military law. In other words, a war crime. So the POTUS would be issuing an illegal order, and his military is under no obligation to obey such illegal orders, and indeed, under the UCMJ, any personnel so ordered would be obliged to DISOBEY such an order.
Although the USA does not consider itself obliged to obey international law, the USA's reputation would suffer as a result.
There are literally hundreds, perhaps thousands, of scenarios where POTUS criminal immunity would be a bad and unworkable idea.
In any case, there is NO scenario where a POTUS, serving or former, would be criminally immune for actions taken outside of his her official duties. That would to be a re-definition of the POTUS to one of a dictator or king who was above the law, which is obvious nonsense.
Indeed, if the SCOTUS did rule in Trump's favour, then it is legally and morally exposed to a charge of high treason. Or I should say, another charge of high treason?
Rank actually means nothing under the rule of law. It is the appointment that matters.
An example. A solider is in a combat zone. He/she is on sentry duty. Someone approaches, and does not obey protocol. The sentry can shoot the person dead, even if he or she is a 5-star general. So the lowly private on duty outranks a 5-star general, until the person's credentials have been established. It was not the private's fault the general died.
An extreme example perhaps, but it has happened in real life. Several officers have been shot for not following protocol, and rightly so. In 1944, during the Battle of the Bulge, several US and allied generals were detained, sometimes for hours.
Again, it is not all about rank, but appointment. [There was an intelligence scare about a Nazi attempt to assassinate Eisenhower, head of SHEAF].
There is this funny thing called the "social contract". It is implicit and explicit in anything we do socially. It is about doing your job. Even if you flip burgers for a living, it is implied that you don't take a dump, not wash your hands, and then serve food. The law backs this up with health regulations. Like wearing sterile gloves while handling food.
And no one can just go on an airbus, and drive it thousands of miles with a few hundred passengers on board. You need a commercial license, be rated for that aircraft, and have the owner's authority to fly the aircraft.
So POTUS [or EX], billionaire or pauper, we all have to obey the law.
This is almost kindergarten level stuff, and should not have to be explained.
Just a wild guess, but I think that you have a fascist infestation on your hands, up to and including the present SCOTUS.

The best I would offer to Trump is this: No current president will be allowed to start or involve himself in the procecution of a previous president, nor will any prolitcal idiology be involved. Other than that, a crime is a crime. If it can put one of us in jail, the president should not be excused.
I also think this should extend into a modification of the pardon power of a president that he should never be allowed to pardon himself from crimes, nor should any future presidents be allowed to pardon him. Let's face it, given how many presidents have come and gone without a single problem with this, I don't see a reason why it would be a problem going forward. Only one president has violated this so far and as long as he is treated the same as everyone else, it should keep others from wanting to follow his path.
