      Well, they aren’t, but insider trading is narrowly defined. They need to make it more usefully defined. My sister only answers to the ceo of her company and sold lots of stock recently. …long story but I asked her if she should have published the move ahead of the trade and she said no because she isn’t on the finance team. …I was surprised, and I trade stocks.

      The SCOTUS has historically not batted 1000. The hope is that they get most of the major issues right most of the time. When one of it's members can't define what a woman is, I'd say we're pretty close to being lost.

Enough shenanigans were already obvious at the time meant it was absolutely in order and in fact mandatory for the POTUS to question what had happened.
      He has of course been vindicated by subsequent events with more than half of Americans now agreeing the 2020 election which installed Biden was 'problematic'.

    Challenging an election can be "private" &/or "official". Any CITIZEN must be able to say, "HERE is something that compromises this election; this issue MUST be addressed to ensure the result is valid." But, an individual, who is also a government office holder, HAS, in my view, A DUTY to SPEAK UP if something compromises the outcome.

Mike Pence sought legal advice from Michael Luttig who told him he had no constitutional power to reject the electors.       @@daviddadamo2290here are the problems with your argument: you can ask 10 “legal experts” if the POTUS has authority AND responsibility to challenge a federal election and you will get 10 different answers. IF that POTUS was not a candidate in that election, the answers - with various caveats - would almost certainly favor “yes”. In 2020, though, the POTUS was a candidate, so the answers would probably be evenly scattered across the spectrum from yes, to probably, to maybe sometimes, to probably not, to no. And the ONLY reason for the differing answers is “the appearance of it” because of the POTUS being a candidate. But, it should not matter that the POTUS is a candidate. It should not matter because the issue affects not JUST the candidate. It affects the million citizens who VOTED for him!!! The POTUS has a duty to ALL citizens so, when million citizens are CONVINCED that their vote didn’t count because an election was not conducted according to the RULES, he MUST respond. He is OBLIGATED to either CORRECT the vote count OR be able to demonstrate to those people who feel disenfranchised that the vote count was accurate and fair. I can GUARANTEE you that, if Biden had been the losing candidate and Trump had done for Democrat voters EXACTLY what he did for Republican voters, ALL of you would think is was PERFECTLY PROPER for a POTUS to hold up certification and to prepare to have alternate electors ready to go in case Biden had been proven the winner and to call up the Georgia SOS to ask him to recount Fulton County, and to petition a few other states to have their elections nullified because of illegal rule changes having being implemented by people who had no authority to change those rules. ALL of you would be saying these were things that fall squarely into his JOB DESCRIPTION as the CHIEF law enforcement officer in the country.

This is the same "crime" for which Trump is facing 34 felonies.
      The party that reads "Rules for Radicals" and promotes "projection" and "lawfare" should rethink it and be more egalitarian.

    Please explain. How is it ever unlawful for the chief law enforcement officer of the US (the President) to object to what he believes to be unlawful election processes? Simply because he is a person allegedly harmed should never be weighed. Does the President have a duty to call out injustice (real or not) and demand the system and individuals responsible to adjudicate actually do their job? So far, all alleged acts are simply Trump probing and demanding others act as he believed the Constitution compels. People may not like what he did. People may believe his actions further divided the country. None of that matters when contemplating criminal prosecution.

      Wow, you really haven't been following these cases or the facts regarding your argument right? Swapping the official electors for your electors is an illegal act. Its not just demanding someone to investigate if the election was fair, its several ACTS to actually rob whole states of their votes. Michael johnson actually carried out this plan, but in the end Pence rejected the fake electors at the moment in January 6th. This was orchestrated by Trump and his team. Furthermore, asking another government official to find 11,000 votes that don't exist so that he can win a state is also not legal. And finally, asking/telling, leading a group of people to violently attack the capitol while the election votes are being certified is akin to a military/violent coup. Many of those people were armed, used force, destroyed parts of the buildling attacked police officers defending the capitol injuring several and one who ended up dying from the injuries. and all of this was orchestrated by Trump and his team where in the channels used to communicate, violence was clearly advocated and sought out (they reached out to proud boys and other militant conservative groups).... Are you in love with him? Is that why you ignore all these facts that are so easily verifiable?

    I am surprised that Trump's attorney did not remind the court that Trump is not only a former president, but also the current official nominee for the Republican party, and that Trump has been getting classified briefings since he secured the nomination on super Tuesday.
    I think the court needs to also consider Trump's current status as the nominee, and not just his past status of president.
    The rule about not indicting and prosecuting a sitting president exists because it would be disruptive.
    I believe trying to idict and prosecute a presidential nominee is just as disruptive.

    The idea that you have got an unelected bureau of the executive branch petitioning the Court for a special cut out of executive power to put controls on the office that the Constitution identifies as vested with all executive power, might sound like a pragmatic adjustment, but then again to people who think this, unintended consequences is just a "right-wing talking point", because unintended consequences never happen. (i.e., All consequences are intended).
    Some people try to make the argument that the Constitution is old and out-of-date at the same time as "The Constitution is on our side", but if you're looking for a fourth corner in the separation of powers, that is not in the Constitution. You have to make one or the other--and then don't brand jurists as "political hacks" simply because they're preferring the Constitution over your naive "innovation" (which nobody voted for).

      Not none of them are immune from Impeachment which comes with consequences from the Senate. The Constitution is clear on that. So you have a Grand Jury of 435 and a Jury of 100. Immunity from Article 3 Judicial review which could be referred by the Senate. This was not refered by the Senate but by the politically party in charge.

      Something called Impeachment.... presidential immunity applies until impeachment is completed. Nixon was successfully impeached. Thus, he could be charged. Since they never removed Nixon from office, he pardoned himself.
      And Trump was never successfully impeached, so his immunity should apply. That's the difference.

      Congress is biased. A jury must be impartial. Also anything can be brought before Congress, even without evidence.
      For an arrest, there must be enough evidence to convict, brought to the judge. A crime has to be proven.

    How can a President engage in private acts without forcing the executive branch to exist? A private act would mean no executive branch exists during that time because the President alone IS the executive branch. That would mean the executive branch takes a holiday while the President goes off to engage in private acts. The Supreme Court recently ruled the Constitution does not take a holiday even during a pandemic. This would be no different. The President can only engage in a private act if the VP is first sworn in as acting President to allow the President to engage in a private act. Otherwise all acts are official acts no matter what it is because the President is always in his official capacity. Absent the President taking a leave from office by having the VP sworn in as acting President, there is no such thing as a private act while the President is in his official capacity.

If the President who alone IS the Executive Branch was allowed to go off and act in a personal capacity that would literally mean the Executive Branch becomes abandoned because the President cannot be two things at once. Because the President alone IS the Executive Branch he is always in his official capacity 24/7 even while he sleeps, while he vacations and while he does anything that is even for his own personal benefit. It is in fact an official act by the President, not a personal act as a private citizen. Once the President takes the oath of office he is no longer a private citizen. The ONLY way the President can ever act outside of his official capacity as President is only if he steps down to take a leave of office which would in fact require the VP to be sworn in as the acting President until the President is able to return to office in his official capacity. This is why the VP was sworn in as acting President when President Reagan had to have a medical procedure that required him to be put under and the same when Bush had to and the same when Biden had to and Kamala Harris was sworn in as acting President until Biden was able to return to his official capacity. Otherwise there would not have been any need for them to be sworn in as acting President. If anything did happen where any of those Presidents did not recover they could have sworn the VP in at that time where they would have become President. Why do you think they were sworn in as acting President? Because if they weren't the Executive Branch would be completely abandoned without a President able to serve in an official capacity. That can never be allowed because the Executive Branch cannot be allowed to be abandoned where it would literally cease to exist for any period of time, even if for just a few minutes. The President is the only person that is in his official capacity every second of every day from the moment he takes the oath of office to the moment he leaves office. The only exception is if the President is unable to serve in an official capacity and the VP is sworn in as actine President until the President is able to return in his official capacity.
      See the 25th Amendment
      Section 3.
      Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President.
      If a President acts in a personal capacity then he is in fact unable to discharge the powers and duties of his office since it is literally impossible to do both at the same moment in time. If the President is acting in a personal capacity then he is not in his official capacity. If he is in his official capacity then he cannot be in a personal capacity.
      Since President Trump never stepped aside by having the VP step in as acting President then everything he did was in his official capacity and a Presidential act, not a personal act.

    I think this whole issue is pretty simple but everyone seems to be making it very complex. What I think is that if Congress (both the Senate and House of Rep.) decide and judge by a 2/3 vote that some act by the president is a crime then that president is then impeached and immediately can be indicted and charged with said crime and sentenced to the crime. Otherwise any and all acts of the president are immune from prosecution. It's pretty clear.
    SCOTUS never needed to get into hypotheticals. all they need to do is determine 1 is it the correct Constitutional procedure for 2/3 of Congress to agree that the president could be impeached for his actions, and 2 can he then be charged criminally.

    There’s no grey area . It’s official acts vs private acts . Challenging an election is an official act . There should be immunity for that.

    The phrase “high crimes and misdemeanors” appears in Article II section 4 of the U.S. Constitution: The President, Vice President and all Civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. Non of these cases rise to the constitutional level. 🇺🇸
