00:41 What did RA 11648 amend with respect to Statutory Rape?
Based on the amended provision, these are the following changes:
04:31 (1) It is now statutory rape to have carnal knowledge of a woman under 16 years of age; before, it is statutory rape to have carnal knowledge of a woman under 12 years of age.

06:43 (2) But here lies the exception: The person having carnal knowledge of a woman under 16 years of age will not be criminally liable when the age difference between the parties is not more than 3 years, and the sexual act in question is proven to be consensual, non-abusive, and non-exploitative.

16:08 (3) However, the exception in number (2) above shall not apply if the victim is under thirteen 13 years of age. In other words, even if the age gap between the offender and the victim is not more than 3 years, and even if the sexual activity is consensual, non-abusive, and non-exploitative, the act will still be considered as statutory rape.

Rape can now be made by a woman or transgender to a man :
refer to sec. 1 changing the wordings to read:
"1) By a PERSON who shall have carnal knowledge of another PERSON under any of the following circumstances:"
the exclusion of the man or transgender as victim of rape no longer holds as the text of the law does not specify the offender to be solely be a man, but may be other persons meaning man, woman or trans, who belongs to the classification of "person".

Yes. Generally speaking hindi pwede makipag sex sa minor kasi it can be considered as sexual abuse

What happens with a 17 year old and a person who was in an authority position but no longer is when the act occurred?
If the victim is 17yrs old and he/she gave in to sex because of influence or coercion by an adult, the crime is sexual abuse which is a violation of section 5b of RA 7610.

It will not have any effect. Penal laws are prospective. They will not be given retroactive application unless favorable to the offender.

Minimum age of criminal liability is 15 kaya sa last 2 examples niya, yung sa 14 walang kaso but sa 15 meron.

Hindi pa po kayo pwedeng umalis ng bansa o tumira sa ibang lugar habang hindi pa ho tapos ang period ng probation nyo. Makukulong po kayo pag ginawa nyo yan. Pag under probation po kasi, kelangan nyo pong mag report sa probation officer nyo para ma monitor po kayo.
Pag tapos na po ang probation mo, pwede na po kayong mag trabaho pero depende na po yan kung tatanggapin ka dahil sa criminal record mo.
